HomeMy WebLinkAboutORD NO 2501ORDINANCE NO. 2501 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.12.020 OF CHAPTER 17.12 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD, REGARDING PROPERTY KNOWN AS REAL NO. 2 ANNEXATION AND CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE WEST SIDE OF REAL ROAD, AND NORTH OF THE WESTERLY EXTENSION OF VERDE STREET. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a motion to zone certain property now being annexed to said City and a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the west side of Real Road, and north of the westerly extension of Verde Street; and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the hearing for the zoning of said property, that said zoning should be authorized upon annexation of said property to the City. WHEREAS, the Planning Commission as a result of said hearing did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from R-1 to R-2-D and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the P~anning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield, as follows: SECTION 1. 1. All of the foregoing recitals are hereby found to be true and correct. 2. That Section 17.12.020 of Chapter 17.12 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern, located on the west side of Real Road, and north of the westerly extension of Verde Street, known as REAL NO. 2 ANNEXATION, in an R-2-D (Limited Multiple Family Dwelling-Architectural Design) Zone, upon the annexation of said property to the City of Balkersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: TO AN R-2-D (LIMITED MULTIPLE FAMILY DWELLING- ARCHITECTURAL DESIGN) ZONE: A parcel of land situate in the County of Kern, State of California, being a portion of Section 35, Township 29 South, Range 27 East, M.D.B.&M., more particularly described as follows: Commencing at the Southeast corner of said Section 35; thence South 89054'00" West, 1383.70 feet along the South line of said Section to intersect a line 60 feet Westerly of and parallel to the East line of the West half of the Southeast quarter of said Section 35; thence along said line North 00007'30" West, 60.00 feet, to the Southeast corner of Parcel Map No. 2915 recorded on April 21, 1975 as shown in Parcel Map Book 13 at Page 106, in the office of said County Recorder; thence along the South line of said Parcel Map South 89054'00" West, 330.00 feet; thence along the Westerly boundary of said Parcel Map, North 00°07'30" West, 660.15 feet, to the Northwest corner of said Parcel Map, said corner being in the existing exterior Corporate Boundary of the City of Bakersfield and the True Point of Beginning; THENCE (t) departing from said exterior Corporate Boundary and continuing along the Northerly extension of said Westerly boundary of Parcel Map No. 2915, North 00007'30" West, 330.00 feet, more or less, to intersect the Southwest corner of Tract No. 1573 recorded on September 27, 1950 as shown in Book 7 of Maps at Page 119 in the office of the Kern County Recorder, said Southwest corner being in said exterior Corporate Boundary of the City of Bakersfield; THENCE (2) Easterly and along various courses in last named exterior Corporate Boundary to the True Point of Beginning; Containing 1.8 acres, more or less. 3. An environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 4. Section 17.12.020 (Zoning Map) Code of the City of Bakersfield, be and the by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: of the Municipal same is hereby amended FROM AN R-1 (ONE FAMILY DWELLING) ZONE TO AN R-2-D (LIMITED MULTIPLE FAMILY DWELLING- ARCHITECTURAL DESIGN) ZONE: That portion of the Southeast quarter of Section 35, Township 29 South, Range 27 East, M.D.B.M. Being more particularly described as follows: The North 100 feet of the South 920.3 feet of the West 285 feet of the East 1668.7 feet of said Section 35. Containing .65 acre, more or less. SECTION 2. This ordinance shall become effective upon the annexation of the above-described territory to the City of Bakersfield as to the parcel described in Section 1, Part 2 above, and as to the property described in Section 1, Part 4 above, it shall be effective thirty (30) days from and after the date of its passage. .......... 000 ..........
