HomeMy WebLinkAboutORD NO 2493ORDINANCE NO. 2493 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING' OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE SOUTHWEST CORNER OF WEST HALF MOON DRIVE AND ASHE ROAD. an R-1-CH considered and WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the southwest corner of West Half Moon Drive and Ashe Road; and WHEREAS, the Planning Commission as a result of said hearing did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from an R-3-D (Limited Multiple Family Dwelling-Architectural Design) Zone to (One Family Dwelling-Church) Done, and the Council has said findings and all appear to be true and correct; NHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: be true and correct. 2. Section 17.12.020 Code of the City of Bakersfield, by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: (Zoning Map) of the Municipal be and the same is hereby amended FROM AN R-3-D (LIMITED MULTIPLE FAMILY DWELLING- ARCHITECTURAL DESIGN) ZONE TO AN R-1-CH (ONE FAMILY DWELLING-CHURCH) ZONE: That portion of Section 9, Township 30 South, Range 27 East, M.D.M., in the City of Bakersfield, Kern County, California, described as follows: Commencing at the intersection of the centerline of Half Moon Drive with the centerline of Ashe Road as said Drive and Road are shown upon the Map of Tract 3900 as per Map thereof recorded September 22, 1977 in the Office of the Kern County Recorder in Book 27 of Maps at Pages 94 and 95; thence along the centerline of said Ashe Road South 00° 35' 36" West, 670.00 feet to a point; thence North 89° 24' 47" West, 55.00 feet to the True Point of Beginning; thence from said True Point of Beginning continuing North 89° 24' 47" West 300.00 feet; thence North 00© 35' 36" East 625.00 feet; thence South 89© 24' 47" East 280.00 feet to the beginning of a tangent curve, concave southwesterly, with a radius of 20.00 feet; thence southeasterly along said curve through a central angle of 90° 00' 23", an arc dis- tance of 31.42 feet; thence South 00© 35' 36" West, 605.00 feet to the True Point of Beginning.
