HomeMy WebLinkAboutORD NO 2490ORDINANCE NO. 2490 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.12.020 OF CHAPTER 17.12 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD, REGARDING PROPERTY KNOWN AS REAL NO. 1 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a motion to zone certain property now being annexed to said City; and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the hearing for the zoning of said property, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield, as follows: SECTION 1. That Section 17.12.020 of Chapter 17.12 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern located from the west side of Real Road to Oak Street, and between Palm Street and Chester Lane, known as REAL NO. 1 ANNEXATION, in an R-1 (One Family Dwelling) Zone; in an R-2-D (Limited Multiple Family Dwelling- Architectural Design) Zone; in an R-3-D (Limited Multiple Family Dwelling-Architectural Design) Zone; and in a C-2 (Commercial) Zone, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifi- cally described as follows: TO AN R-1 (ONE FAMILY DWELLING)ZONE: A parcel of land situate in the County of Kern, State of California, being portions of Sections 35 and 36, Township 29 South, Range 27 East, M.D.B.& M., more particularly described as follows: Beginning at the northwest corner of Tract 1892 recorded in Book 9, Page 78, June 27, 1956 of Official Records of said Kern County; THENCE (1) departing from said exterior Corporate Boundary and continuing along the Northerly ex- tension of said Westerly boundary of Tract No. 1892, N 00°17'21" E, a distance of 970 feet, more or less, to intersect the Southerly right-of-way line of Garnsey Lane, of 60 feet in width; THENCE (2) along said Southerly right-of-way line N 89052'30" E, a distance of 155 feet, more or less, to intersect the Southerly extension of the Easterly line of the West 75 feet of Lot 25 as shown on the Map of Tract No. 1460 recorded on September 15, 1948 in Book 6 of Maps at Page 147, in the office of said County Recorder; THENCE (3) along the Southerly extension of said Easterly line, N 00007'30" W, a distance of 160 feet, more or less, to intersect the South line of said Lot 25; THENCE (4) along said South line, N 89052'30" E, a distance of 50 feet, more or less, to intersect the westerly line of Lot 2 of said Tract No. 1460; THENCE (5) along said Westerly line and along the Westerly lines of Lots 3 through 13, inclusive thereof, N 00007'30" W, 750 feet, more or less, to the Southerly boundary of Parcel B as shown on Parcel Map No. 532 recorded September 29, 1972 in Parcel Map Book 3 at Page 180, in the office of said County Recorder; THENCE (6) S 89052'30" W, a distance of 5 feet, to the Southwest corner of said Parcel B; THENCE (7) N 00007'30" W, a distance of 60 feet, to the Northwest corner of said Parcel B, said corner being in the Southerly right-of-way line of Chester Lane, of 60 feet in width, and in said exterior Corporate Boundary of the City of Bakersfield; THENCE (8) Easterly and along various courses in last named exterior Corporate Boundary to the Point of Beginning. EXCEPTING THEREFROM the following: (1) All that portion lying easterly of the west right-of-way line of State Route 99 and all street right-of-ways. (2) A parcel of land situate in the County of Kern, State of California being a portion of Section 35, Township 29 South, Range 27 East, M.D.B. & M., being more particularly described as follows: Beginning at the intersection of the East right-of- way line of Real Road and the South right-of-way line of Chester Lane; THENCE (1) East along the South right-of-way line of Chester Lane a distance of 433.7 feet; THENCE (2) Leaving said right-of-way line, South and parallel with Real Road a distance of 310 feet; THENCE (3) West and parallel with Chester Lane a distance of 433.7 feet more or less to the East right-of-way line of Real Road; THENCE (4) North along said East right-of-way line a distance of 310 feet more or less to the Point of Beginning. (3) A parcel of land situate in the County of Kern, State of California, being a portion of Section 35, Township 29 South, Range 27 East, M.D.B. & M., being more particularly described as follows: Beginning at the intersection of the east right-of- way line of Real Road with the North right-of-way line of Palm Street; THENCE (1) East along the North right-of-way line of Palm Street 340.9 feet; THENCE (2) Northerly and parallel with Real Road a distance of 597 feet; THENCE (3) Westerly and parallel with Palm Street a distance of 142.32 feet; THENCE (4) Northerly and parallel with Real Road a distance of 330.72 feet; THENCE (5) Westerly and parallel with Palm Street a distance of 198.58 feet more or less to the East right-of-way line of Real Road; THENCE Southerly along said East right-of-way line to the Point of Beginning. TO AN R-2-D (LIMITED MULTIPLE FAMILY DWELLING- ARCHITECTURAL DESIGN) ZONE: A parcel of land situate in the County of Kern, State of California, being a portion of Section 35, Township 29 South, Range 27 East, M.D.B. & M., being more particularly described as follows: Beginning at the intersection of the East right-of- way line of Real Road and the South right-of-way line of Chester Lane; THENCE (1) East along the South right-of-way line of Chester Lane a distance of 433.7 feet; THENCE (2) Leaving said right-of-way line, South and parallel with Real Road a distance of 310 feet; THENCE (3) West and parallel with Chester Lane a distance of 433.7 feet more or less to the East right-of-way line of Real Road. THENCE (4) North along said East right-of-way line a distance of 310 feet more or less to the Point of Beginning. TO AN R-3-D (LIMITED MULTIPLE FAMILY DWELLING- ARCHITECTURAL DESIGN) ZONE: A parcel of land situate in the County of Kern, State of California, being a portion of Section 35, Township 29 South, Range 27 East M.D.B. & M., being more particularly described as follows: Beginning at the intersection of the East right-of- way line of Real Road with the North right-of-way line of Palm Street; THENCE (1) East along the North right-of-way line of Palm Street 340.9 feet; THENCE (2) Northerly and parallel with Real Road a distance of 597 feet; THENCE (3) Westerly and parallel with Palm Street a distance of 142.32 feet; THENCE (4) Northerly and parallel with Real Road a distance of 330.72 feet; THENCE (5) Westerly and parallel with Palm Street a distance of 198.58 feet more or less to the East right-of-way line of Real Road; THENCE Southerly along said East right-of-way line to the Point of Beginning. TO A C-2 (COM~iERCIAL) ZONE: A portion of land situate in the County of Kern, State of California being a portion of Section 35, Township 29 South, Range 27 East, M.D.B. & M., and is described in two parcels: PARCEL 1: That portion of the North 1493.5 feet of Section 35, Township 29 South, Range 27 East, M.D.B. & M., lying Easterly of the East right-of-way line of State Route 99, lying Southerly of the South right- of-way line of Chester Lane and lying Westerly of the West right-of-way line of Oak Street. PARCEL 2: The South 242.5 feet of the North 1293.5 feet and the West 120 feet of the East 310 feet of Section Township 29 South, Range 27 East. 35, SECTION 2.
