HomeMy WebLinkAboutORD NO 2477ORDINANCE NO. 2477 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHWEST CORNER OF WESTFIELD ROAD AND DESERET WAY. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the northwest corner of Westfield Road and Deseret Way; and WHEREAS, the Planning Commission as a result of said hearing did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from R-2-D to R-1-CH and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due consideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 3. Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-2-D (Limited Multiple Family Dwelling-Architectural Design) Zone to an R-1-CH (One Family Dwelling- Church) Zone of that certain property in the City of Bakersfield located on the northwest corner of Westfield Road and Deseret Way, being more particularly described as follows: From an R-2-D (Limited Multiple Family Dwelling-Architectural Design) Zone to an R-1-CH (One Family Dwelling-Church) Zone: That portion of the Southwest Quarter (SW/4) of Section 33, Township 29 South, Range 27 East, MDM in the City of Bakers- field, Kern County, California described as follows: Commencing at the intersection of the centerline of Westfield Road with the centerline of Quailridge Road as shown on Tract 3885, filed May 26, 1977 in Book 27 of Maps, at Page 54, in the office of the County Recorder of said Kern County; thence along the centerline of said Westfield Road North 82028'42" West 50.00 feet to the beginning of a tangent curve, concave to the Northwest, of radius of 700.00 feet; thence Southwest- erly, on and along said curve, through a central angle of 42© 02'41", an arc distance of 513.412 feet; thence North 34031' 23" West, 30.00 feet to the North right-of-way line of said Westfield Road and the true point of a non-tangent curve con- cave Southeasterly, having a radius of 470.00 feet from which point the radial point of said curve bears North 34031'23" West; thence Westerly on and along said curve, through a cen- tral angle of 34°32'41", an arc distance of 283.372 feet; thence North 89058'42" West 24.980 feet to the beginning of a tangent curve, concave to the Southwest, having a radius of 20.00 feet; then Northwesterly, on and along said curve through a central angle of 90000'00", an arc distance of 31.415 feet; thence North 00°01'18" East 343.653 feet, more or less, to a point on the Easterly right-of-way line of the Arvin-Edison Canal as the same as described in an instrument recorded on December 1, 1966 in the office of the Kern County Recorder in Book 4000 of official records at Page 17; thence along said right-of-way line North 38°43'15" East 174.955 feet; thence South 66001'46" East 147.839 feet, to a point on a non-tangent curve, concave to the Southwest, having a radius of 90.00 feet from which point the radial point of said curve bears South 66° 01'46" East; thence Southerly, on and along said curve, through o a central angle of 79029'27", an arc distance of 124.864 feet to a point of reverse curvature with a second curve, concave to the Northeast, having a radius of 25.00 feet, from which point the radial of said curve bears South 34028'46" West; thence Southerly, on and along said curve, through a central angle of 29°35'31" an arc distance of 12.912 feet; thence South 25055'43" East 198.455 feet to the beginning of a tangent curve, concave to the Southeast, having a radius of 20.00 feet; thence South- erly, on and along said curve, through a central angle of 86° 10'39", an arc distance of 30.082 feet to a point of reverse curvature with a second curve, concave Northwesterly, having a radius of 730.00 feet, from which point the radial point of said curve bears South 29045'04" East; thence Southwesterly on and along said curve, through a central angle of 04°45'19" an arc distance of 60.799 feet to the true point of beginning. .......... 000 ..........
