AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF BAKERSFIELD AMENDING TITLE 13 OF THE
BAKERSFIELD MUNICIPAL CODE, PERMITTING
CERTAIN DEVIATIONS UNDER DEVELOPMENT PLAN
APPROVAL IN LIMITED ZONES.
BE IT ORDAINED by the City Council of the City of Bakers-
field as follows:
SECTION 1.
Section 13.04.060 of Chapter 13.04 of Title 13 of the
Municipal Code of the City of Bakersfield is hereby amended by
adding thereto a new subsection (c) to provide as follows:
(c) The Building Director shall authorize reasonable modi-
fications in the application of this title in connection with a
development plan in a P.U.D., P.C.D. or D Overlay Zone, which has
been approved by the Planning Commission and said approval has
included the consideration of a proposed modification of the require-
ments of this title, together with the reasons for it, and all
factors, specifically including public health, welfare and safety,
have been considered and the Planning Commission has found and
determined that the proposed modification should be approved and
made a part of the development plan, and will provide equal or
better protection for the public health, welfare and safety than the
minimum that is required by this title, and that the same is justi-
fied in furtherance of the approved development plan in a P.U.D.,
P.C.D. or D Overlay Zone. In no event shall such a modification be
approved which reduces the protection for the public health, welfare
and safety below the minimums required by this title.
SECTION 2.
This ordinance shall be published once in the Bakersfield
Californian, a newspaper of general circulation within the city, not
more than fifteen (15) days following its adoption and shall be in
full force and effect thirty (30) days following its adoption.
