HomeMy WebLinkAboutORD NO 2469ORDINANCE NO. 2469 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.12.020 OF CHAPTER 17.12 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD, REGARDING PROPERTY KNOWN AS UNION AVENUE NO. 8 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a motion to zone certain property now being annexed to said City; and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the hearing for the zoning of said property, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield, as follows: SECTION 1. That Section 17.12.020 of Chapter 17.12 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern located south of Air Park on the east side of Union Avenue between White Lane and Pacheco Road and known as Union Avenue No. 8 Annexation, in an R- 3-D (Limited Multiple Family Dwelling-Architectural Design) Zone; in a C-2-D (Commercial-Architectural Design) Zone; in an MH-D (Mobilehome-Architectural Design) Zone and in an A (Agricultural) Zone, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: To an R-3-D (Limited Multiple Family Dwelling- Architectural Design) zone: Parcels 2 and 3, Parcel Map 2754, County of Kern, State of California, as per Map recorded January 16, 1978 in Book 12 at Page 100 in the office of the County Recorder of said County. To a C-2-D (Commercial-Architectural Design) zone: The North 379 feet and the West 656.75 feet of the Southwest 1/4 of Section 17, Township 30 South, Range 27 East, MDB&M. EXCEPTING therefrom the right-of-way within Union Avenue and White Lane. To an MH-D.(Mobitehome-Architectural Design) Zone: A parcel of land situate in the County of Kern, State of California, being a portion of Section 17, Township 30 South, Range 27 East, MDB&M, more particularly described as follows: Beginning at the intersection of the east line of the west half of the northwest quarter of said Sec- tion 17 with the north line of the south 30 feet of the northwest quarter of said section, said inter- section being on the northerly right-of-way line of White Lane 60 feet in width, and a point on the ex- terior Corporate Boundary of the City of Bakersfield; Thence (1) departing said exterior Corporate Boundary, easterly along last named north line 140 feet, more or less, to intersect the centerline of the Central Branch of the Kern Island Canal; Thence (2) generally in a southeasterly direction along said centerline, 2500 feet, more or less, to intersect the east line of the west half of said Section 17, said east line being the east line of Lot 18 of Kern County Sales Map No. 1 of Lands of J.B. Haggin filed May 3, 1889 in the office of the Kern County Recorder; Thence (3) southerly along said east line S. 00003' 13" E., 400 feet, more or less, to intersect the north line of the south 30 feet of said Section 17, said north line being the northerly right-of-way line of Pacheco Road, of 60 feet in width; Thence (4) westerly along last named north line and said northerly right-of-way line, 1313.85 feet to intersect the east line of the west half of the south- west quarter of said Section 17, said east line being the west line of said Lot 18 of said Kern County Sales Map No. 1; Thence (5) along said east line, N. 00°03'13" W., 1321.38 feet to intersect the south line of the north half of the south half of said Section 17, said inter- section being the southeast corner of Lot 15 of said Kern County Sales Map No. 1; Thence (6) along last named south line, N. 89°56'04" W., 1255.36 feet, to intersect the east line of the west 57.75 feet of said Section 17, said intersection being a point on the easterly right-of-way line of Union Avenue, of 115.5 feet in width, said point also being the southwest corner of Parcel 3 as shown on Parcel Map 2754 recorded January 16, 1975 in Book 12 of Parcel Maps at Page 100, in the office of the County Recorder; Thence (7) along said east line and said easterly right-of-way line, N. 00°01'19" W., 495.59 feet, to the northwest corner of Parcel 2 of said Parcel Map 2754; Thence (8) S. 89~55'55" E., 598.67 feet to intersect the east line of the west half of the northwest quarter of the southwest quarter of said Section 17; Thence (9) N. 00~02'16" W., 485.184 feet to the south line of the north 349 feet of the of said Section 17; intersect south half Thence (10) westerly along last named south line, 599 feet, more or less, to intersect the east line of the west 57.75 feet of said Section 17; Thence (11) N. 00°01'19" W., 379 feet, more or less, along said east line to a point on the north line of the south 30 feet of the northwest quarter of said Section 17, said point being in the existing Corporate Boundary of the City of Bakersfield; Thence (12) easterly along said Corporate Boundary to the Point of Beginning. Excepting therefrom the West 599 feet. Also excepting the following described parcel located in the N. 1/2 of the SW 1/4, Township 30 South, Range 28 East: Beginning at the intersection of the centerline of the Kern Island Canal and the centerline of White Lane; Thence West along said centerline of White Lane 202 feet; Thence South perpendicular from said White Lane 430; Thence east parallel to said White Lane 456 feet to said centerline of the canal; Thence Northwesterly along said canal centerline to the Point of Beginning. To an A (Agricultural) zone: The following described parcel located in the N 1/2 of the SW 1/4, Township 30 South, Range 28 East: Beginning at the intersection of the centerline of Kern Island Canal and the centerline of White Lane; Thence West along said centerline of White Lane 202 feet; Thence South perpendicular from White Lane 430; Thence east parallel to said White Lane 456 feet to said centerline of the canal; Thence northwesterly along said canal centerline to the Point of Beginning. SECTION 2. This ordinance shall become effective upon the annexation of the above-described territory to the City of Bakersfield. .......... 000 ..........
