HomeMy WebLinkAboutORD NO 2463ORDINANCE NO. 2463 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD COMMONLY KNOWN AS 245 EYE STREET. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, commonly known as 245 Eye Street; and WHEREAS, the Planning Commission as a result of said hear- ing did make several general and specific findings of fact which warranted a negative declaration of environmental impact and a change of zoning of the subject property from R-3 to R-3-P-D and the Council has considered said findings and all appear to be true and correct; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from the proposed project; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. An environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 3. Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-3 (Limited Multiple Family Dwelling) Zone to an R-3-P-D (Limited Multiple Family Dwelling-Auto- mobile Parking-Architectural Design), or more restrictive, zone of that certain property in the city of Bakersfield commonly known as 245 Eye Street, being more particularly described as follows: That portion of Villa Block "P" of the Lowell Addition, as per Map recorded November 25, 1898 in Book 1, Pages 13 and 14 of Maps in the office of the County Recorder of said County, described as follows: Commencing at a point 30 feet West and 55.25 feet South of the Northeast corner of the North- west Quarter of said Villa Block "P"; thence South 50 feet to a point; thence at right angles West 137.625 feet to a point; thence North 50 feet to a point thence at right angles Easterly parallel to the North line of said Block 137.625 feet to the point of commencement. .......... o0o .......... o I HEREBY CERTIFY that the foregoing Ordinance was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 15th day of Nnv~mh~ , 1978, by the following vote: NOTS: COU~C~L~?~: ..__ ABSENT: COUNC]_LL,~LIJ: ./~/~/~/ ~"~' CITY C R~K~n fficio Clerk of Council of ~e cE~akersfield the APPROVED this _~t~ day of Nov~mhp~ ~~~ity of Bakersfield , 1978 APPROVED as to form: CITY ATTORNEY of ~/he City of Bakersfield 3RD STREET I~100' FILE 3112 ZC ,lAMES BUTLER 245 EYE STREET R-3 TO R--3 -P Afft at t! of osltng ( r tnan es STATE OF CALIFORNIA, f County of Kelm ss.
