HomeMy WebLinkAboutORD NO 2462ORDINANCE NO. 2462 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHWEST CORNER OF PANAMA LANE AND SOUTH "H" STREET INTERSECTION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield, located on the northwest corner of Panama Lane and South "H" Street intersection; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said properties, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: From an A (Agricultural) Zone to an R-1 (One Family Dwelling) Zone: All that portion of the southeast quarter of the southeast quarter of Section 24, Township 30 South, Range 27 East, MDM, in the City of Bakersfield, Kern County, California, being more particularly described as follows: Commencing at the southeast corner of said Section 24; thence N 89° 53' 30" W along the South line there- of, 691.00 feet to the True Point of Beginning; thence continuing N 89© 53' 30" W, 631.13 feet to the south- west corner of said southeast quarter of the southeast quarter; thence N 0° 02' 26" E, 1321.75 feet to the northwest corner of said southeast quarter of the southeast quarter; thence S 89° 53' 39" E along the north line thereof, 1058.41 feet; thence S 0° 03' 10" W, 562.24 feet; thence N 89© 56' 50" W, 427.00 feet; thence S 0° 03' 10" W, 759.14 feet to the True Point of Beginning. Containing 24.668 acres, more or less. From an A (Agricultural) Zone to an R-3-D (Limited Multiple Family Dwelling-Architectural Design) Zone: All that portion of the southeast quarter of the southeast quarter of Section 24, Township 30 South, Range 27 East, MDM, in the City of Bakersfield, Kern County, California, being more particularly described as follows: Commencing at the southeast corner of said Section 24; thence N 0° 03' 10" E along the east line thereof, 759.81 feet to the True Point of Beginning; thence con- tinuing N 0° 03' 10" E along said east line 562.00 feet to the northeast corner of said southeast quarter of the southeast quarter; thence N 89© 53' 39" along the north line thereof 264.00 feet; thence S 0° 03' 10" W, 562.24 feet; thence S 89° 56' 50" E, 264.00 feet to the True Point of Beginning. Containing 3.407 acres, more or less. From an A (Agricultural) Zone to an R-2-D (Limited Multiple Family Dwelling-Architectural Design) Zone: All that portion of the southeast quarter of the south- east quarter of Section 24, Township 30 South, Range 27 East, MDM in the City of Bakersfield, Kern County, Cali- fornia, being more particularly described as follows: Commencing at the southeast corner of said Section 24; thence N 0° 03' 10" E along the east line thereof, 613.81 feet to the True Point of Beginning; thence continuing N 0© 03' 10" E along said east line 146.00 feet; thence N 89° 56' 50" W, 691.00 feet; thence S 0© 03' 10" W, 759.14 feet to the south line of said Section; thence S 89~ 53' 30" E along said south line, 176.00 feet; thence N 0© 03' 10" E, 613.31 feet; thence S 89° 56' 50" E, 515.00 feet to the True Point of Beginning. Containing 4.794 acres, more or less. From an A (Agricultural) Zone to a C-2-D (Commercial- Architectural Design) Zone: All that portion of the southeast quarter of the south- east quarter of Section 24, Township 30 South, Range 27 East, MDM, in the City of Bakersfield, Kern County, Cali- fornia, being more particularly described as follows: o Beginning at the southeast corner of said Section 24; thence N 0° 03' 10" E along the east line thereof, 613.81 feet; thence N 89* 56' 50" W, 515.00 feet; thence S 0° 03' 10" W 613.31 feet to the south line of said Section; thence S 89° 53' 30" E along said south line, 515.00 feet to the True Point of Beginning.
