HomeMy WebLinkAboutORD NO 2453ORDINANCE NO. 2453 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE SOUTH SIDE OF THE ALFRED HARRELL HIGHWAY AND LAKE MING ROAD INTERSECTION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the south side of the Alfred Harrell Highway and Lake Ming Road Intersection; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-1 (One Family Dwelling) Zone to a C-O-D (Commercial and Professional Office-Archi- tectural Design) zone, and to a C-2-D (Com- mercial-Architectural Design) Zone of those certain properties in the city of Bakers- field located on the south side of Alfred Harrell Highway and Lake Ming Road inter- section, being more particularly described as follows: From an R-1 (One Family Dwelling) Zone to a C-O-D (Commercial and Professional Office- Architectural Design) Zone: A portion of the South half of Section 4, Township 29 South, Range 29 East, Mount Diablo Base and Meridian, more particu- larly described as follows: Commencing at the Southeast corner of said Section 4; thence Westerly along the South line of said Section 4, a distance of 3,975 feet to the True Point of Beginning; thence from a tangent which bears South 39° East, Northeasterly along a circular curve concave to the Southeast having a radius of 1305 feet through a central angle of 32° to a point of reverse curvature; thence Northeasterly along a tangent circular curve concave to the North- west having a radius of 945 feet, through a central angle of 64°; thence tangent to the last named curve to intersect the centerline of Alfred Harrell Highway; thence Westerly along said centerline a distance of 2,000 feet; thence Southerly and parallel to the West line of said Section 4 to intersect the South line of said Section 4; thence Easterly along said South line to the True Point of Beginning. Containing 39+ acres. From an R-1 (One Family Dwelling) Zone to a C-2-D (Commercial-Architectural Design) Zone: A portion of the South half of Section 4, Township 29 South, Range 29 East, Mount Diablo Meridian, more particularly de- scribed as follows: Beginning at the Southeast corner of said Section 4; thence Westerly along the South line of said Section 4, a distance of 3,975 feet; thence from a tangent which bears South 39° East, Northeasterly along a cir- cular curve concave to the Southeast having a radius of 1305 feet through a central angle of 32° to a point of reverse curva- ture; thence Northeasterly along a tangent circular curve concave to the Northwest having a radius of 945 feet, through a central angle of 64°; thence tangent to the last named curve to intersect the centerline of Alfred Harrell Highway; thence Easterly along said centerline to intersect with the East line of said Sec- tion 4; thence Southerly along said East line to Point of Beginning.
