RESOLUTION NO. 11 3 - 0 7
A RESOLUTION PROVIDING FOR THE COLLECTION OF
DELINQUENT SEWER CHARGES BY THE KERN
COUNTY TAX COLLECTOR.
WHEREAS, Chapter 14.12 of the Bakersfield Municipal Code authorized
the establishment and increase of fees and charges to recover costs for services
rendered; and
WHEREAS, a public hearing before the City Council was advertised twice
in the Bakersfield California, a newspaper of general circulation; and
WHEREAS, a public hearing was held to determine whether the proposed
fees and charges are discriminatory or excessive; and
and
WHEREAS, the adoption of these charges complied with Proposition 218;
WHEREAS, the City of Bakersfield has directly billed new sewer users the
appropriate prorated amounts and has been unable to collect on certain delinquent
accounts due to being unable to locate prior property owners or if the property is going
through foreclosure.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
The Council of the City of Bakersfield hereby transfers the collection of
delinquent prorated charges for new sewer services for single-family dwellings, multi-
family units and commercial facilities to the Kern County Tax Collector to be billed at the
time of billing of property taxes.
