RESOLUTION OF THE CITY OF BAKERSDFIELD CITY COUNCIL
RECOMMENDING THAT THE BOARD OF SUPERVISORS
APPROVE COUNTY OF KERN GENERAL PLAN AMENDMENT
NO.6, MAP 103-18, AN AMENDMENT TO THE KERN RIVER
PLAN ELEMENT OF THE METROPOLITAN BAKERSFIELD
GENERAL PLAN, GENERALLY LOCATED SOUTH OF ROBERTS
LANE, APPROXIMATELY 1000 FEET EAST OF NORTH CHESTER
AVENUE, FROM MAP CODE 5.5 (RESIDENTIAL- MAXIMUM ONE
UNIT PER ACRE) TO MAP CODE 5.3 (RESIDENTIAL - MAXIMUM
TEN UNITS PER NET ACRE).
WHEREAS, the Kern River Plan Element of the Metropolitan Bakersfield General Plan is a
plan jointly adopted by the City of Bakersfield and the County of Kern; and
WHEREAS, Herb Family Enterprises filed a application with the County of Kern, requesting
an Amendment to the Kern River Plan Element of the Metropolitan Bakersfield General Plan, and
WHEREAS, the request is to change the land use designation of property that is within the
County of Kern as hereinafter described; and
WHEREAS, the Kern River Plan Element mandates that if application is made for
amendment of the plan under the County jurisdiction, notice shall be first given to the City Council
who shall conduct a public hearing and make a recommendation on the proposal to the Board of
Supervisors; and
WHEREAS, the City Council of the City of Bakersfield, in accordance with the provisions of
Section 65353 of the Government Code, held a public hearing on Wednesday, June 6, 2007,
regarding County of Kern General Plan Amendment NO.6 of Map 103-18, notice of the time and
place of hearing having been given at least ten (10) calendar days before said hearing by
publication in The Bakersfield Californian, a local nevvspaper of general circulation; and
WHEREAS, General Plan Amendment No.6, Map 103-18, an amendment to the Kern River
Plan Element of the Metropolitan Bakersfield General Plan, is as follows:
General Plan Amendment No.6. MaD 103-18:
Herb Family Enterprises applied to amend the Kern River Plan Element of the
Metropolitan Bakersfield General Plan consisting of a change from Map Code 5.5
(Residential- Maximum 1 Unit/Acre) to Map Code 5.2 (Residential- Maximum 16
Units/Net Acre) on 8.36 acres. The project site is generally located on the south of
Roberts Lane, approximately 1000 feet east of North Chester Avenue; and
WHEREAS, the City Council found as follows:
1. All required public notices have been provided.
2. The public necessity, general welfare and good planning practices justify the
amendment to the Kern River Plan Element of the Metropolitan Bakersfield General

3. A portion of the subject property is located within the Kern County Airport Land Use
Compatibility Plan and approval of the proposed application should include a PD
(Planned Development) Combining zone to ensure compatibility with that plan.
4. The current land use designation of Map Code 5.5 (Residential - Maximum 1
Unit/Acre is not compatible with the land use designations of surrounding properties.
5. Map Code 5.2 (Residential - Maximum 16 Units/Net Acre) is not the most
appropriate land use designation for the proposed site when assessing compatibility
with land use designations of surrounding properties.
6. A land use designation change from Map Code 5.5 (Residential - Maximum 1
Unit/Acre) to Map Code 5.3 (Residential - Maximum 10 Units/Net Acre) on 8.36
acres is compatible with the land use designations of surrounding properties and is
internally consistent with the Kern River Plan Element of the Metropolitan Bakersfield
General Plan.
NOW, THEREFORE,IT IS HEREBY FOUND AND RESOLVED as follows:
1. The above recitals and findings are true and correct and constitute the findings of the
City Council, incorporated herein.
2. As to County of Kern General Plan Amendment No.6, Map 103-18, consisting of a
change in land use designation from Map Code 5.5 (Residential - Maximum 1
Unit/Acre) to Map Code 5.3 (Residential - Maximum 10 Units/Net Acre) on 8.36
acres as requested by the applicant and generally located on the south side of
Roberts Lane, and approximately 1000 feet east of the North Chester Avenue, as
shown on the attached map in Exhibit A, the City Council hereby recommends
approval of said amendment to the Kern River Plan Element of the Metropolitan
Bakersfield General Plan from Map Code 5.5 (Residential- Maximum 1 Unit/Acre) to
Map Code 5.3 (Maximum - 10 Units/Net Acre).
