HomeMy WebLinkAboutORD NO 2447ORDINANCE NO. 2447 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHWEST CORNER OF COLUMBUS STREET AND UNION AVENUE INTERSECTION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the northwest corner of Columbus Street and Union Avenue intersection; and ~{EREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-3-D (Limited Multiple Family Dwelling-Architectural Design) zone, to a C-2-D (Commercial-Architec- tural Design) zone, of that certain property in the city of Bakersfield located on the North- west corner of Columbus Street and Union Avenue intersection, being more particularly described as follows: Being a certain parcel of land situated in a portion of the Southeast Quarter of Section 18 Township 29 South, Range 28 East, MDB&M, in the County of Kern, State of California and described as follows: Commencing at the Southeast corner of said Section 18, also being the centerline intersec- tion of Union Avenue and 42nd Street (West Columbus); Thence (1) N. 89© 14' 40" W along the center- line of said 42nd Street (West Columbus) a distance of 81.83 feet; Thence (2) at right angles to last named course, N 00° 45' 20" E, a distance of 45.00 feet to the True Point of Beginning also being a point in the North right-of-way line of said 42nd Street (West Columubus); Thence (3) N 89° 14' 40" W along last named right-of-way line, a distance of 177.00 feet; Thence (4) at right angles to last named line, N 00° 45' 20" E, a distance of 200.00 feet; Thence (5) N 77© 22' 47" E, a distance of 124.78 feet to a point in the southwesterly right-of-way line of said Union Avenue (on-ramp to Union Avenue); Thence (6) S 36© 38' 37" E along last named right-of-way line, a distance of 65.00 feet to. a point at the beginning of a tangent curve, concave to the Southwest and having a radius of 168.00 feet; Thence (7) continuing along last named right-of- way line southeasterly along said curve, through a central angle of 35° 48' 43", an arc distance of 105.01 feet to the point of tangency; Thence (8) continuing along last named right- of-way line, S 00° 49' 54" E, a distance of 59.31 feet to a point at the beginning of a tangent curve, concave to the Northwest and having a radius of 20.00 feet; Thence (9) southwesterly along last said curve through a central angle of 91° 35' 14" an arc dist- ance of 31.97 feet to the point of tangency and the True Point of Beginning of this description.
