HomeMy WebLinkAboutORD NO 2446ORDINANCE NO. 2446 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED WEST OF FAIRFAX ROAD AND AZALEA AVENUE INTER- SECTION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located west of Fairfax Road and Azalea Avenue Intersection; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) Code of the City of Bakersfield, be and the same by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: of the Municipal is hereby amended Amending the zoning boundaries from an R-1 (One Family Dwelling) Zone to an R-i-CH (One Family Dwelling-Church) zone, of that certain property in the city of Bakersfield located west of the Fairfax Road and Azalea Avenue Intersection, being more particularly described as follows: A portion of the NE 1/4 of the NE 1/4 of Section 26, T29S, R28E, MDB&M, City of Bakersfield, County of Kern, State of California, more particularly described as follows: Commencing at the northeast corner of said Section 26 which lies on the cen- terline of College Avenue; thence South 00° 09' 48" West along the east line of said Section 26; 643.548 feet to the True Point of Beginning; thence continu- ing along said east line South 00© 09' 48" West 678.371 feet to a point located on the centerline of Fairfax Road; thence South 89° 26' 16" West 390.000 feet; thence North 28° 57' 41" East, 171.874 feet; thence North 00© 38' 27" West, 528.329 feet; thence North 89° 21' 33" East, 314.619 feet to the True Point of Beginning. EXCEPTING THEREFROM: The right-of-way which lies within Fairfax Road. Area consisting of 4.696 acres. .......... 000 ..........
