AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING CHAPTER 3.30 OF THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD
BY ADDING SECTION 3.30.040 AUTHORIZING
CERTAIN EMPLOYEES TO MAKE ARRESTS.
WHEREAS, Section 836.5 of the California Penal Code
permits the City Council to authorize employees, other than peace
officers, to make arrests pursuant to their duty to enforce
certain laws and ordinances; and
WHEREAS, the Chief of Police can assign employees,
other than peace officers, to enforce parking laws and ordinances
and public pound ordinances; and
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION 1.
That Section 3.30.040 is added to Chapter 3..30 of the
Municipal Code of the City of Bakersfield to read as follows:
3.30.040 Powers of Arrest. Those employees of the City of
Bakersfield, other than peace officers, designated by the Chief
of Police with duties to enforce parking violations of state law
and local ordinances, and violations of Chapter 9.08 (Public
Pound) of the Municipal Code are authorized to make arrests and
issue written notices to appear for such violations pursuant to
Section 836.5 of the California Penal Code. These employees
shall not be classified as safety members.
SECTION 2.
This ordinance shall become effective thirty days from
and after the date of its passage.
