HomeMy WebLinkAboutORD NO 2435ORDINANCE NO. 2435 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHEAST CORNER OF STINE ROAD AND PANAMA LANE INTERSECTION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the northeast corner of Stine Road and Panama Lane intersection; and WHEREAS, the City Council has determined after due con- ~ideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-2-D (Limited Multiple Family Dwelling-Architectural Design) zone and an R-3-D (Limited Multiple Family Dwelling-Architectural Design) Zone to a C-2-D (Commercial-Architectural Design) of that certain property in the City of Bakers- field located on the northeast corner of Stine Road and Panama Lane intersection, being more particularly described as follows: All that portion of the South half of the Southwest quarter of Section 23, Township 30 South, Range 27 East, MDB&M, in the city of Bakersfield, County of Kern, State of California, according to the Official Plat thereof, described as follows: Beginning at the Southwest corner of said Section 23; Thence N 00© 01' 18" East along the West line of said Section 23, 460.568 feet; Thence S 89© 58' 42" East, 778.00 feet; Thence S 0° 01' 18" West, 463.763 feet to a point on the South line of said Section 23; Thence N 89° 44' 35" West, 778.007 feet to the True Point of Beginning.
