WHEREAS, in accordance with the procedure s~t forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield, located on the north side of Auburn Street, starting approximately 600 feet west of Fairfax Road and extending one-half mile east; and WHEREAS, the City Council has determined after due con- sidererich cf said petition and the recommendations of the Plan- ning Commission h~rein on file, together with the reasons advanced at the hearings for a change of zoning of said properties, thau a zoning change should be authorized; and WHEREAS, the City Council has determined and found that thls zoning ordiuance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the-City of Bakersfield, be and the same ~s hereby amended by changing the land use zoning of certain properties in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-1 (One Family Dwelling) Zone to an R-2-D (Limit- ed Multiple Family Dwelling-Architectural Design) zone; to an R-3-D (Limited Multiple Family Dwelling-Architectural Design) zone; and to a C-1-D (Limited Commercial-Architec- tural Design) zone, of that certain property in the city of Bakersfield located on the north side of Auburn Street, starting approx- imately 400 feet west of F~irfax Road and extending one-b~%f mile east, being more particularly described as follows: To an R-2-D (Limited Multiple~Family Dwelling- Architectural Design) Zone: Being a certain parcel of land situated in a portion of the Southwest Quarter of Section 13, Township 29 South, Range 28 East, MDB&M in the City of Bakersfield, County of Kern, State of California and more particularly described as follows: Commencing at the Southwest corner of Tract 3867 Unit "A" recorded in Map Book 28 at Page 2 of Official Records, said point also being a point on the centerline of Fairfax Road; Thence North 89° 29' 05" East along the South line of said Tract 3867 Unit A a distance of 200.006 feet to an angle point on said Tract 3867 Unit A; Thence continuing North 89° 29' 05" East paral- lel with the South line of said Southwest Quarter a distance of 345.00 feet to the true point of be- ginning; Thence (1) continuing North 89a 29' 05" East a distance of 701.904 feet to the beginning of a tan- gent curve concave to the North and having a radius of 600.00 feet; Thence (2) Easterly along said curve through a central angle of 07~ 07' 21" an arc distance of 74.586 feet; Thence (3) North 82a 21' 44" East a distance of 96.393 feet to a point on the West line of East half of the Southeast Quarter of Southwest Quarter of said Section 13; Thence (4) South 00° 02' 13" East along last- named line a distance of 431.238 feet to a point on the South line of said Southwest Quarter; Thence (5) South 89° 29' 05" West along last- named South line a distance of 871.936 feet to a point; Thence (6) North 00° 01' 10" West parallel with t. he West line of said Southwest Quarter a distance of 414.658 feet to the true point of beginning. To an R-3-D (Limited Multiple Family Dwelling-Archi- tectural Design) zone: Being a certain parcel of land situated in a portion of the Southwest Quarter of Section 13, Township 29 South, Range 28 East, MDB&M, City of Bakersfield, County of Kern, State of California, and more particularly described as follows: Beginning at the South 1/4 of said Section 13; Thence (1) South 89° 29' 05" West along the South line of said Southwest Quarter a distance of 667.445 feet to the Southwest corner of the East half of the Southeast Quarter of said Southwest Quarter; Tkence (2) North 00° 02' 13" West along the West line of said East half of the Southeast Quarter of said Southwest Quarter a distance of 431.238 feet; Thence (3) continuing Nordh 82° 21' 44" East a distance of 64?.723 feet to the beginning of a tan- gent curve concave to the South and having a radius of 600.00 feet; Thence (4) Easterly along said curve through a central angle of 02© 48' 54" an arc distance of 29.478 feet to a point on the East line of said Southwest Quarter; Thence (5) South 00© 02' 34" East along last named E,~st line a distance of 513.988 feet to the Point of Beginning.
