HomeMy WebLinkAboutORD NO 2431 ORDINANCE NO. 2431 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.12.020 OF CHAPTER 17.12 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD, REGARDING PROPERTY KNOWN AS ANNEXATION NO. 259 (BERNARD NO. 4). WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a motion to zone certain property now being annexed to said City; and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the hearing for the zoning of said property, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield, as follows: SECTION 1. That Section 17.12.020 of Chapter 17.12 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern located between Bernard Street and Pico Street on both sides of Oswell Street and known as Bernard No. 4 Annexation, in an R-1 (One Family Dwelling) Zone; in a C-O-D (Commercial and Professional Office-Architectural Design) Zone; in an R-3-D (Limited Multiple Family Dwelling- Architectural Design) Zone; in a C-i-D (Limited Commercial- Architectural Design) Zone; and to a P.U.D. (Planned Unit Develop- ment) Zone upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: To an R-1 (One Family Dwelling) Zone: A parcel of land situate in the County of Kern, State of California, being a portion of Section 23 of Township 29 South, Range 28 East, M.D.B.&M. and being more particularly described as follows: COMMENCING at the Southwest corner of the Northwest 1/4 of said Section 23, thence along the west line of said Section, North 0© 26' 18" west 878.63 feet; thence North 89° 20' 28" East, 55 feet to the east line of Oswell Street and the True Point of Beginning; thence North 89° 20' 28" East, 460 feet to the northwest corner of Lot 12 as shown on the Map of Tract 2314 recorded July 7, 1961 in Book 12 of Maps at Pages 17 and 18w in the Office of the County Recorder of said Kern County; thence South 0° 39' 32" East along the westerly boundary of said Tract 2314, 70 feet; thence continu- ing along the boundary of said Tract 2314 South 32° 02' 03" west 391.63 feet; thence, continuing along the boundary of said Tract 2314, South 89° 33' 42" West, 195.00 feet to the east line of Oswell Street; thence north 0° 26' 18" west along the east line of Oswell Street to the True Point of Be- ginning. To a C-O-D (Commercial and Professional Office-Architectural Design) Zone: The west 212 feet of the east 567 feet of the south 615.76 feet of the northeast 1/4 of Section 22, Township 29 South, Range 28 East, MDB&M. EXCEPTING THEREFROM the South 469.76 feet. To an R-3-D (Limited Multiple Family Dwelling- Architectural Design) zone. The north 140.76 feet of the South 465.76 feet of the east 355 feet of the northeast 1/4 of Section 22, Township 29 South, Range 28 East, M.D.B.&M. To a C-1-D (Limited Commercial-Architectural Design) zone. The north 150 feet of the south 615.76 feet of the east 355 feet of the northeast 1/4 of Section 22, Township 29 South, Range 28 East, M.D.B.&M. To a P.U.D. (Planned Unit Development) Zone: The south 1/2 of the southeast 1/4 of the northeast 1/4 of Section 22, Township 29 South, Range 28 East, M.D.B.&M. o EXCEPTING THEREFROM THE FOLLOWING: 1) The North 191 feet of the East 567 feet. 2) The East 355 feet. 3) The North 45 feet. 4) The South 165 feet. SECTION 2. This ordinance shall become effective upon the annexation of the above-described territory to the City of Bakersfield. .......... o0o ..........
