HomeMy WebLinkAboutORD NO 2430ORDINANCE NO. 2430 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHWEST CORNER OF MORNING DRIVE AND COLLEGE AVENUE EXTENSIONS. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield, located on the northwest corner of Morning Drive and College Avenue Extensions; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said properties, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain properties .in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: Parcel 1 Parcel 2 Amending the zoning boundaries from an R-1 (One Family Dwelling) Zone to a C-2-D (Com- mercial-Architectural Design) zone; to an R-3-D (Limited Multiple Family Dwelling- Architectural Design) zone; to an R-2-D (Limited Multiple Family Dwelling-Archi- tectural Design) zone; and to an R-S (Resi- dential-Suburban) zone of those certain properties in the city of Bakersfield located on the northwest corner of Morn- ing Drive and College Avenue extensions, being more particularly described as follows: All that portion of land in the East Half of Section 24, Township 29 South, Range 28 East, M.D.M., in the City of Bakersfield, described as follows: From an R-1 (One Family Dwelling) Zone to a C-2-D (Commercial-Architectural Design) Zone: The East 655 feet of the South 1000 feet of said East Half of Section 24. (Lot 34 Tentative Tract 4075) From an R-1 (One Family Dwelling) Zone to an R-3-D (Limited Multiple Family Dwelling-Archi- tectural Design) Zone: East 430 feet of the North 322 feet of the South 1322 feet of said East half of Section 24. Commencing at the Southeast Corner of said East Half of Section 24; t~ence West along the South line of said East half a distance of 655 feet to the True Point of Beginning; Thence (1) North 1° 13' East parallel with the East line of said East half a distance of 437 feet; Thence (2) North 79° west a distance of 396 feet; Thence (3) South 10© 10' West, a distance of 141 feet; Thence (4) North 79° 50' West, a distance of 329 feet; Thence (5) South 1© 13' West, a distance of 427 feet to the South line of said East half; Thence (6) Easterly along said South line a dis- tance of 738 feet to the True Point of Beginning. From an R-1 (One Family Dwelling) Zone to an R-2-D (Limited Multiple Family Dwelling-Archi- tectural Design) Zone: The East 1392 feet of the South 1322 feet of said East half of Section 24. EXCEPTING THEREFROM THE FOLLOWING PARCELS: o Parcel 1 Parcel 2 Parcel 3 The East 655 feet of the South 1000 feet of said East half of Section 24. East 430 feet of the North 322 feet of the South 1322 feet of said East half of Section 24. Commencing at the Southeast Corner of said East Half of Section 24; thence West along the South line of said East Half a distance of 655 feet to the True Point of Beginning; Thence (1) North 1° 13' East parallel with the East line of said East Half, a distance of 437 feet; Thence (2) North 79© Southwest, a distance of 396 feet; Thence (3) South 10° 10' West, a distance of 141 feet; Thence (4) North 79° Southwest, a distance of 329 feet; Thence (5) South 1° 13' West, a distance of 427 feet to the South line of said East Half; Thence (6) Easterly along said South line, a distance of 738 feet to the True Point of Be- ginning.
