HomeMy WebLinkAboutRES NO 142-07 RESOLUTION NO. 1 4 2~ 0 7 A RESOLUTION AUTHORIZING PARTICIPATION IN THE STATE OF CALIFORNIA DEPARTMENT OF GENERAL SERVICES STATE AND FEDERAL SURPLUS PERSONAL PROPERTY PROGRAM WHEREAS, the state of California Department of General Services disposes of salvage and surplus personal property from California state agencies; and WHEREAS, the State of California Department of General Services has been designated by the United States General Services Administration to manage federal surplus personal property as the California State Agency for Surplus Property; and WHEREAS, both State and Federal surplus personal property are made available to local agencies through the State of California Department of General Services on a first come-first served basis; and WHEREAS, the City of Bakersfield City Council must approve and adopt a resolution every three years, authorizing the City of Bakersfield's participation in the State and Federal Surplus Property Program and listing the names of five employees authorized to purchase Federal and State surplus personal property on behalf of the City of Bakersfield. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and incorporated herein by reference. 2. Fax: (714) 558-4480 Dear State/Federal Surplus Personal Property Client: Ernie Medina recently obtained surplus property and our records indicate that your organization's approval to participate in the Federal Surplus Personal Property Program has expired. In order for your organization to renew eligibility for three (3) years, the enclosed Eligibility Renewal Application must be completed. Non-renewal will prevent your agency from receiving any additional surplus property. In the RESOLUTION section of the application, please provide the names of the five (5), or less, individuals you are authorizing to obtain federal or state surplus personal property on behalf of your organization, and include their titles and oriainal signatures. There are no exceptions to this new regulation regarding the limitation of naming only five (5) key individuals who will be recognized as your organization's current representatives. All previous authorizations of personnel have been rescinded. Except for State of California Government Agencies, the RESOLUTION Section B of the application must be completed and signed by the governing board or council secretary. STATE OF CALIFORNIA GOVERNMENT AGENCIES are the only agencies that need to complete Section C without completing Section B. Be certain to enter the agency state billing code. All other agencies must complete Section Band not Section C. In addition to completing the Eligibility Renewal Application, please have your board or council secretary read and sign the enclosed federal form, "CERTIFICATION REGARDING DEBARMENT, SUSPENSION, INELIGIBILITY AND VOLUNTARY EXCLUSION-LOWER TIER TRANSACTIONS." In state government agencies only, the chief administrative officer signs this form. Your agency is the donee. Please submit the original completed application and federal government certification to my attention at the above address as soon as possible. We cannot accept copies of any completed form; and incomplete or incorrectly submitted documents will be returned for resubmission. Instructions for Certification I. By signing and submitting this proposal, the prospective lower tier participant is providing the certification set out below. 2. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective lower tier participant knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department of agency with which this transaction originated may pursue available remedies, including suspension and/or debarment. 3. The prospective lower tier participant sha1l provide immediate written notice to the person to which this proposal is submitted if at any time the prospective lower tier participant leams that its certification was erroneous when submitted or had become erroneous by reason of changed circumstances. 4. The terms "covered transaction," "debarred," suspended," ineligible," "lower tier covered transaction," "participant," "person," "primary covered transaction," "principal," "proposal," and "voluntarily excluded," as used in this clause, have the meanings set out in the Definitions and Coverage section of rule implementing Executive Order 12549. You may contact the person to which this proposal is submitted for assistance in obtaining a copy of those regulations. 5. The prospective lower tier participant agrees by submitting this proposal that, should the proposed covered transaction be entered into, it sha1l not knowingly enter into any lower tier covered transaction with a person who is proposed for debarment under 48 CFR part 9, subpart 9.4, debarred, suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized by the department or agency with which this transaction originated. 6. The prospective lower tier participant further agrees by submitting this proposal that it wi1l include this clause titled "Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion - Lower Tier Covered Transaction," without modification, in a1l lower tier covered transactions and in all solicitation for lower tier covered transactions. 7. A participant in a covered transaction my rely upon a certification of a prospective participant in a lower tier covered transaction that it is not proposed for debarment under CFR part 9, subpart 9.4, debarred, suspended, in eligible, or voluntarily excluded from covered transactions, unless it knows that the certification is erroneous. A participant may decide the method and frequency by which it determines the eligibility of its principals. Each participant may, but is not required to, check the List of Parties Excluded from Federal Procurement and Nonprocurement Programs. 8. Nothing contained in the foregoing sha1l be construed to require establishment of a system of records in order to render in good faith the certification required by this clause. The knowledge and information of a participant is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings. 9. Except for transactions authorized under paragraph 5 of these instructions, if a participant in a covered transaction knowingly enters into a lower tier covered transaction with a person who is proposed for debarment under 48 CFR part 9, subpart 9.4, suspended, debarred, ineligible, or voluntarily excluded from participation in this transaction, in addition to other remedies available to the Federal Government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment. Certification (1) The prospective lower tier participant certifies, by submission of this proposal, that neither it nor its principals is presently debarred, suspended, proposed for debannent, declared ineligible, or voluntarily excluded from participation in this transaction by any Federal department or agency. (2) Where the prospective lower tier participant is unable to certify to any of the statements in this certification, such prospective participant shall attach an explanation to this proposal.
