HomeMy WebLinkAboutORD NO 2422ORDINANCE NO. 2422 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHWEST CORNER OF PANORAMA DRIVE AND FAIRFAX ROAD INTERSECTION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the northwest corner of Panorama Drive and Fairfax Road intersection; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of 'the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-1 (One Family Dwelling) Zone to an R-i-CH (One Family Dwelling-Church) Zone of that certain property in the City of Bakersfield located on the northwest corner of Panorama Drive and Fairfax Road inter- section, being more particularly described as follows: All that real property in the city of Bakersfield, County of Kern, State of California, described as follows: A portion of the Northwest quarter of the Southwest quarter of Section 13, Township 29 South, Range 28 East, Mount Diablo Meridian, being more particularly described as follows: Commencing at the West quarter of said Section; thence South 00° 01' 10" East along the West line of said Section 847.018 feet to a point of intersection with the north right-of-way line of Panorama Drive 90 feet in width (fu- ture); thence North 89° 34' 08" East along said right-of-way line, 20.001 feet to the True Point of Beginning; thence North 00© 01' 10" West, along a line parallel to and 20.000 feet from said West line, 575.000 feet; thence North 89© 34' 08" East, parallel with the centerline of said Panorama Drive, 420.116 feet to a point on a non-tangent curve concave to the West with a radius at that point bearing South 71° 28' 18" West and being the West right-of-way line of Fairfax Road, 110 feet in width (future); thence Southerly along said right-of-way line and curve, an arc length of 563.707 feet, through a cen- tral angle of 18° 30' 32" and having a radius of 1745.000 feet; thence South 00© 01' 10" East, parallel with the aforesaid West line, 0.541 feet to a point of tangency with a curve concave to the Northwest; thence Southwest along said curve an arc length of 31.272 feet through a central angle of 89© 35' 18", and having a radius of 20.000 feet, to a point on the aforesaid North right-of- way line of Panorama Drive; thence South 89° 34' 08" West along said right-of-way line, 490.523 feet to the True Point of Beginning. EXCEPTING THEREFROM: That portion of said Section 13, Township 29 South, Range 28 East, MDB&M being more par- ticularly described as follows: Commencing at the West 1/4 corner of said Section 13; thence South 00© 01' 10" East along the West line of said Section,847.018 feet to the North right- of-way line of Panorama Drive 90 feet in width, and the True Point of Beginning; thence North 89° 34' 08" East along said right-of-way line,390.059 feet; thence North 00° 25' 52" West 20.000 feet to the beginning of a tangent curve, con- cave to the West; thence northerly along said curve an arc length of 402.426 feet through a central angle of 14© 36' 57" with a radius of 1605.000 feet, thence South 89© 34' 08" West, 335.067 feet, more or less to a point in the West line of said Section 13, thence South 00° 01' 10", along said West line, 424.980 feet to the True Point of Beginning. .......... o0o ..........
