HomeMy WebLinkAboutORD NO 2416 ORDINANCE NO. 2416 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTH SIDE OF COLLEGE AVENUE WITHIN THE 5900 THROUGH 6100 BLOCKS. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield, located on the north side of College Avenue within the 5900 through 6100 Blocks; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which propertties are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-1 (One Family Dwelling) Zone to an R-2-D (Limited Multiple Family Dwelling-Architectural Design) zone of those certain properties in the City of Bakersfield located on the north side of College Avenue within the 5900 through 6100 blocks, being more particularly described as follows: A portion of the Southeast Quarter (SE 1/4) of the Southwest Quarter (SW 1/4) of Section 24, Township 29 South, Range 28 East, Mount Diablo Meridian, being in the City of Bakersfield, County of Kern, State of California, more particularly described as follows: Commencing at the southwest corner of that property granted to Pacific Gas & Electric Company, a California Corporation in the deed recorded in the office of the County Recorder of said County in Book 3184 of Offi- cial Records at Page 56; thence south 89° 05' 53" west along the south line of said southwest quarter, 814.19 feet to the southwest corner of said southeast quarter of the southwest quarter; thence north 00° 120' 41" west, along the west line of said southeast quarter, 357.00 feet; thence north 89° 05' 53" east, 817.06 feet more or less to a point on the west line of the aforesaid property granted to Pacific Gas & Electric Company; thence south 00© 07' 00" east, along the last said west line, 357.04 feet more or less to the point of beginning. Containing 6.68 acres, more or less.
