AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY
CHANGING THE LAND USE ZONING OF THAT CERTAIN
PROPERTY IN THE CITY OF BAKERSFIELD LOCATED
ON THE NORTHEAST CORNER OF 40TH STREET AND
"Q" STREET.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission has held a public hearing on
a petition to change the land use zoning of that certain property
in the City of Bakersfield, located on the northeast corner of
40th Street and "Q" Street; and
WHEREAS, the City Council has determined after due con-
sideration of said petition and
ning Commission herein on file,
at the hearings for a change of
the recommendations of the Plan-
together with the reasons advanced
zoning of said property, that a
zoning change should be authorized; and
WHEREAS, the City Council has determined and found that
this zoning ordinance is consistent with the General Plan of the
City of Bakersfield.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
1. That an environmental assessment was made of the
project and a Negative Declaration was adopted by the Planning
Commission after a public hearing thereon and this Council hereby
approves the Negative Declaration.
2. That Section 17.12.020 (Zoning Map)
Code of the City of Bakersfield, be and the same
by changing the land use zoning of certain property in said City,
the boundaries of which property are shown on the map hereto
attached and made a part hereof, as follows:
Amending the zoning boundaries from
an R-2-D (Limited Multiple Family
Dwelling-Architectural Design) to
an R-3-D (Limited Multiple Family
Dwelling-Architectural Design)
Zone, of that certain property in
the City of Bakersfield located on
the Northeast corner of 40th and
"Q" Streets, being more paricularly
described as follows:

A portion of the North 1/2 of the NE 1/4 of
Section 19, Township 29 South, Range 28 East,
MD&M in the city of Bakersfield, within the
County of Kern, State of California, more
particularly described as follows:
Lot 3 of Block 689 as shown on that certain
map dated March 10, 1904, entitled "Sales Map
of the Kern County Land Company, showing sub-
divisions of its additions to the City of
Bakersfield, Kern County, California" and
filed April 19, 1904 in the office of the
County Recorder of said Kern County.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
