HomeMy WebLinkAboutORD NO 2412ORDINANCE NO. 2412 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED NORTH OF STOCKDALE HIGHWAY AND EAST OF THE FUTURE ALIGNMENT OF GOSFORD ROAD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located north of Stockdale Highway and east of the future alignment of Gosford Road; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General P~Lan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Counci~ of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-S (Residential Suburban) zone to an R-1 (One Family Dwelling) zone; from an R-S (Residential Suburban) zone to an R-2-D (Limited Multiple Family Dwelling-- Architectural Design) zone; from an R-1 (One Family Dwelling) zone to an R-2-D (Limited Multiple Family Dwelling-Architectural Design) zone; (Parcel 1) from an R-3-D (Limited Multiple Family Dwelling-Architectural Design) zone to an R-2-D (Limited Multi- ple Family Dwelling-Architectural Design) zone; (Parcel 2) and from an R-3-D (Limited Multiple Family Dwelling-Architectural Design) zone to an R-2-D (Limited Multiple Family Dwelling-Architectural Design) zone of that certain property in the City of Bakersfield located North of Stockdale Highway and East of the future alignment of Gosford Road, being more particularly described as follows: All those portions of Section 33, Town- ship 29 South, Range 27 East, M.D.M., in the City of Bakersfield, being more par- ticularly described as follows: From an R-S (Residential Suburban) Zone to an R-1 (One Family Dwelling) Zone: Beginning at the True Point of Beginning of Parcel 1 aforedescribed, said point be- ing also on a curve, concave northwesterly from which point the radial point of said curve bears North 84© 27' 25" West; thence northeasterly, on and along said curve, through a central angle of 02° 41' 56", an arc distance of 18.84 feet; thence South 69° 55' 38" East, 189.08 feet; thence North 75© 33' 14" West, 184.82 feet, more or less to the Point of Beginning.
