HomeMy WebLinkAboutORD NO 2411ORDINANCE NO. 2411 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED NORTH OF MING AVENUE AND EAST OF GOSFORD ROAD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located north of Ming Avenue and east of Gosford Road; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an A (Agricultural) Zone to an R-1 (One Family Dwelling) Zone, of that certain property in the City of Bakersfield located north of Ming Avenue, east of Gosford Road, being more particularly described as follows: Beginning at the southwest corner of Section 4, Township 30 South, Range 27 East, M.D.M.; thence North 00° 10' 39" West, on and along the westerly line thereof, 2,378.11 feet, thence South 82° 12' 00" East, 764.75 feet, more or less, to a point on the Corporate Boundary of the City of Bakersfield; thence on and along said Corporate Boundary South 15© 30' 00" East, 892.00 feet and South 82° 03' 00" East, 1,322.148 feet; thence leaving said Corporate Boundary, South 68© 35' 11" East, 172.857 feet, more or less, to a point on the aforesaid Corporate Boundary of the City of Bakersfield, said point being more specifically a point on Course No. 21 of that certain annexation to the City of Bakersfield known as "Stockdale No. 8"; thence, on and along said Corporate Boundary South 00° 38' 00" East, 520.148 feet, North 71° 58' 50" East, 188.46 feet, and South 00° 06' 24" East, 1,620.59 feet, more or less, to a point on the centerline of Ming Avenue as proposed and adopted by the City of Bakersfield; thence North 61© 48' 36" West, on and along said centerline, 1,379.10 feet to the beginning of a tangent curve, con- cave to the southwest, having a radius of 2,200 feet; thence northwesterly, on and along said curve, through a central angle of 28© 01' 01" an arc distance of 1,075.773 feet; thence North 89° 49' 37" West, 398.886 feet, more or' less, to the southwest corner of Section 4 and the point of beginning.
