HomeMy WebLinkAboutORD NO 2408ORDINANCE NO. ~4~ NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE SOUTHWEST CORNER OF MORNING DRIVE AND COLLEGE AVENUE INTERSECTION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the southwest corner of Morning Drive and College Avenue Intersection; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That an environmental assessment was made of the project and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves the Negative Declaration. 2. That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Parcel 1: Parcel 2: Amending the zoning boundaries from an R-1 (One Family Dwelling) Zone to an R-2-D (Limi- ted Multiple Family Dwelling-Architectural Design) zone; to an R-3-D (Limited Multiple Family Dwelling-Architectural Design) zone; and to a C-2-D (Commercial-Architectural Design) zone of that certain property in the city of Bakersfield located on the Southwest corner of Morning Drive and College Avenue intersection, being more particularly de- scribed as follows: From an R-1 (One Family Dwelling) zone to an R-2-D (Limited Multiple Family Dwelling- Architectural Design) zone: Commencing at the Northeast corner of Section 25, Township 29 South, Range 28 East, M.D.M. in the city of Bakersfield, Kern County, California; thence West along the North line of said Section South 89© 48' 08" West, a distance of 588.44 feet to the true point of beginning; thence South 0° 11' 52" East, a distance of 122.83 feet; thence South 8© 32' 08" West, a distance of 77.07 feet; thence South 26© 03' 57" West, a distance of 79.79 feet; thence South 19° 37' 25" West, a dis- tance of 128.78 feet; thence South 14° 45' 28" West, a distance of 202.90 feet; thence South 78© 53' 53" East, a distance of 316.06 feet; thence South 65° 09' 29" East, a dis- tance of 28.12 feet; thence North 25© 25' 33" East, a distance of 142.73 feet; thence North 78° 29' 17" West, a distance of 118.42 feet; thence North 87© 00' 02" West, a distance of 52.01 feet to the beginning of a 55.00 foot radius tangent curve, concave Northeasterly thence Northeasterly along said curve through a central angle of 115° 56' 10" an arc dis- tance of 111.29 feet; thence North 28° 56' 08" East, a distance of 49.01 feet to the beginning of a 650.00 foot radius tangent curve, concave Westerly; thence Northerly along said curve through a central angle of 29© 08' 00" an arc distance of 330.51 feet; thence North 0© 11' 52" West, a distance of 65.00 feet to the North line of said Section; thence Westerly along said North line South 89© 48' 08" West, a distance of 147.33 feet to the true point of beginning.
