HomeMy WebLinkAboutORD NO 2403 ORDINANCE NO. 2403 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHWEST CORNER OF SOUTH CHESTER AVENUE AND VILLAGE DRIVE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission has held a public hearing on a petition to change the land use zoning of that certain property in the City of Bakersfield, located on the northwest corner of South Chester Avenue and Village Drive; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Plan- ning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-2-D (Limited Multiple Family Dwelling-Architectural Design) Zone to an MH (Mobilehome) zone, of that certain property in the city of Bakersfield located on the Northwest corner of South Chester Avenue and Village Drive, being more particularly described as follows: From an R-2-D (Limited Multiple Family Dwelling- Architectural Design) Zone to an MH (Mobilehome) Zone: That portion of Parcels B and C of Parcel Map 3948, recorded in Book 19 of Parcel Maps at Page 69, in the office of the Kern County Recorder, in Sectlon 18, Township 30 South, Range 28 East, M.D.B.& M., in the City of Bakersfield, County of Kern, State of California, more particularly described as follows: Commencing at the northeast corner of said Parcel C, which is a point on the westerly right-of-way line of South Chester Avenue; thence along said westerly right-of-way line, south 28°25'31" east, 100.00 feet to the beginning of a tangent curve concave to the northwest, with a radius of 25.00 feet; thence southwesterly along said curve, through a central angle of 53007'48", an arc distance of 23.18 feet to a point which bears north 65© 17'43" west to the center of said curve, and which is the True Point of Beginning for this discription; thence north 28°25'31" west 100.00 feet; thence south 61034'29" west 75.00 feet; thence south 28°25'31" east 105.00 feet to a point on the northerly right-of-way line of Village Drive North (a private street) as the same is shown on the map of Tract 3743, recorded in Map Book 26, Page 61, in the office of the Kern County Recorder; thence along said northerly right-of-way line, north 61034'29" east 60.00 feet to the beginning of a tangent curve con- cave to the northwest, with a radius of 25.00 feet; thence northeasterly, along said curve, through a central angle of 36°52'12", an arc distance of 16.09 feet to the True Point of Beginning. .......... o00 ..........
