AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 12.16.100 OF
CHAPTER 12.16 OF THE MUNICIPAL CODE OF THE
CITY OF BAKERSFIELD INCREASING THE DEPOSIT
REQUIRED BEFORE OPENING STREETS.
WHEREAS, the City of Bakersfield requires a deposit to be
made before opening streets to cover the cost of any uncompleted work;
and
WHEREAS, the present deposit requirement amounts to one
dollar ($1.00) per square foot for paved streets and fifty cents
($.50) for unimproved streets; and
WHEREAS, the cost of labor and material has increased
significantly since the one dollar deposit and the fifty cent deposit
requirement was adopted in 1929.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield as follows:
SECTION 1.
That Section 12.16.100 of the Municipal Code of the City
of Bakersfield is amended to read as follows:
12.16.100 Deposit Required Before O~ening Street. It shall be
unlawful for any person, firm or corporation above referred to, to
open any public street, or thoroughfare of the City of Bakersfield
until he, or it, shall have obtained the proper permit and shall have
deposited with the Public Works Director a sum equal to two dollars
($2.00) per square foot of surface of said excavation c,r excavations,
to be made in the streets, alleys, thoroughfares, or other public
places which are improved with a hard surface having substance of
permanent character; a sum equal to one dollar ($1.00) per square
foot of surface of said excavation or excavations, to be made in such
streets, alleys, thoroughfares, or other public places which are
unimproved; a sum equal to one hundred dollars ($100) shall be the
minimum deposit for each permit; provided further that any person,
firm or corporation intending to make excavations in public streets,
alleys, thoroughfares or other public places may make and maintain
a general deposit with the City of Bakersfield in the sum of
one thousand dollars ($1,000), such person, firm or co'rporation
shall not be required to make the special deposit hereinbefore
provided for, provided, however, that should the special deposit
above provided for exceed one thousand dollars ($1,000), that a
surety bond may be tendered in lieu of a cash bond to cover the
amount in excess of one thousand dollars ($1,000), and upon the
tendering of said bond the Public Works Director of the City of
Bakersfield is hereby authorized to accept the same in lieu of
the additional cash bond, or in his discretion to refuse the
same and require a cash bond for the full amount.
SECTION 2.
This ordinance shall become effective thirty days from
and after the date of its passage.
I HEREBY CERTIFY that the foregoing ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 22nd day of March , 1978, by
