ROLL CALL: Present: Commissioners Blockley, Johnson, Andrews, McGinnis, Tragish Absent: Commissioners Stanley, Tkac. 2. PLEDGE OF ALLEGIANCE: 3. PUBLIC STATEMENTS: None. 4. CONSENT CALENDAR: 4.1 Non-Public Hearing Items Approval of minutes for Planning Commission pre-meeting of June 18, 2007 and regular Planning Commission meeting of June 21, 2007. Commissioner McGinnis moved, seconded by Commissioner Johnson, to approve non-public hearing items on the consent calendar. Motion passed unanimously by group vote. 4.2 Public Hearing Items 4.2a Accept and File Planning Director’s Report for Administrative Review 07-0931 – 9700 Brimhall (Skarphol & Associates) 4.2b Approval of Extension of Time Vesting Tentative Tract Map 6243 (Porter-Robertson Engineering & Surveying) 4.2c Approval of Extension of Time Vesting Tentative Tract Map 6329 (DeWalt Corporation) 4.2d Approval of Continuance of Vesting Tentative Parcel Map 11472 to August 2, 2007 (Nelms Surveying) 4.2e Approval of Planned Development Review 07-0011 (Paul Anchordoquy) 4.2f Approval of Zone Change 07-0999 (McAllister Ranch) The public hearing is opened. No one from the public, nor the commission, requested removal of any consent agenda item. The public hearing is closed except for 4.2d which is continued. Commissioner McGinnis moved, seconded by Commissioner Andrews, to approve the consent agenda items. Planning Commission – July 19, 2007 Page 2 Motion passed unanimously by roll call vote: AYES: Commissioner Blockley, Johnson, Andrews, McGinnis, Tragish NAYS: None. ABSENT: Commissioners Stanley, Tkac 5.PUBLIC HEARINGS – Zone Change/Tentative Tract Maps 5.1 Zone Change 07-0999 (McAllister Ranch) located at the southeast corner of Pensinger Road and Stetson Way in McAllister Ranch. Heard on consent calendar. 5.2 Vesting Tentative Tract Map 7019 (SmithTech USA) The public hearing is opened, staff report given. No one spoke in opposition to Staff’s recommendation. Mike Petrini with PB Ventures stated they are in agreement with Staff’s recommendation. The public hearing is closed. Commissioner Johnson moved, seconded by Commissioner Andrews, to approve vesting tentative tract map 7019 with findings and conditions set forth in the attached Resolution. Motion passed unanimously by roll call vote: AYES: Commissioner Blockley, Johnson, Andrews, McGinnis, Tragish NAYS: None. ABSENT: Commissioners Stanley, Tkac 6. COMMUNICATIONS: 6.1 Planning Department Operations Update – Presentation by James D. Movius, Planning Director. Staff gave their presentation. Commissioner Johnson commented on the benefits to the community from things like the parks and trails plan and the Hillside Ordinance. He stated he is concerned with having adequate parking as depicted in the Smart Growth Infill Implementation Strategy, to which Staff responded that they are not sure how much it will be reduced, but they have noted that on infill projects of that type that there is unused parking which takes up space. Commissioner Johnson also inquired as to what tandem parking means, to which Staff responded it’s what you see in older communities where there is one car right behind the other, and the garage is to the side and behind the house. Commissioner Johnson inquired what a staff run model is for parking referenced on page 2, point C, to which Staff responded that it pertains to G and that the Urban Land Institute has recently updated their shared parking program based on recent parking trends where you have mixed use centers. Staff indicated that they purchase that model and run it on shopping centers. Commissioner Johnson further referenced item E “allow on-street parking to be applied towards parking requirements in existing infill circumstances and developments,” and commented that he doesn’t want to have a situation where people have to walk long distances from their cars to their homes just because of lack of parking. He also asked Staff to define “formed based zoning in downtown area to achieve,” Staff explained that it worries more about the form and public realm, which is considered the way the buildings look in relationship to the street and pedestrian, then it is concerned with the listed uses in a zone, and therefore it is more of a mixed-use zoning concept. Commissioner Tragish inquired as to the status of the traffic impact fees discussed at the July 5, 2007 meeting. Staff responded that the Thomas Roads people are still working on it. Commissioner Tragish requested that Staff report back on this issue. Planning Commission – July 19, 2007 Page 3 Commissioner McGinnis inquired if anything has developed on either of the two downtown condominium projects which proposed the use of the City parking structure. Staff responded there has been nothing to their knowledge. Staff further responded that Wal-Mart projects will be coming up in the near future, as well as the Canyon’s project. Staff also pointed out that the Nichols property at the mouth of the canyon to where 178 drops down at Miramonte will be coming in the next year. Commissioner McGinnis inquired if there is a time line for the improvements to 178 to which Staff responded that the Fairfax bidding was just opened and will be awarded at the next meeting and that some other contracts along Highway 178 have also been awarded. Staff pointed out that it does not include the movement of Highway 178 alignment north. Staff indicated that they could put together a memo outlining the progress of Highway 178. Commissioner McGinnis lastly inquired if there will be a pre-meeting before the August meeting, to which Staff responded that there will a pre-meeting in September before the general plan cycle. Commissioner Blockley inquired if the existing CC&Rs will have any impact on the Smart Growth Infill Implementation strategies. Staff responded that they do not know, however the CC&Rs could not be less restrictive than the ordinance. With regard to parking issues Commissioner Blockley commented that he recently observed a very expensive German automobile parked on the front lawn because of no street parking due to street cleaning. 7. COMMISSION COMMENTS: Commissioner Tragish stated that he is concerned with the development by Cal State on Camino Media, and inquired as to how much input they have on this development as it impacts the surrounding city. Staff responded that they can comment on their EIR. Commissioner Tragish commented that it is his understanding that it will be substantially for private commercial with four to ten story buildings and he would like to know if they have standing to give input. Staff responded that if it is private commercial the City will be able to look at it. Staff also indicated that they are looking to getting involved right now through the City Manager’s office, as well as Public Works with respect to traffic issues. Staff also indicated that Planning reviewed the project in relationship to the General Plan policies and there was nothing against what they are trying to do. Commissioner Tragish inquired if it will come through the Planning Commission at any point, to which Staff responded that it may not. Commissioner Tragish lastly commented that he is appalled with the processing of this development and that he does not understand that if it is suppose to be land dedicated to students why they are partnering up with commercial. Commissioner Johnson inquired if there is a date for the joint City-County Planning Commission meeting. Staff responded they don’t have a date as of yet. 8.
