ROLL CALL: Present: Commissioners: Blockley, Johnson, Stanley, Andrews, McGinnis Absent: Commissioners: Tragish, Tkac 2. PLEDGE OF ALLEGIANCE: 3. PUBLIC STATEMENTS: Mr. and Mrs. Howard stated they will speak on agenda item 4.2(b), which will be removed from the consent calendar. 4. CONSENT CALENDAR: 4.1 Non-Public Hearing Items Commissioner McGinnis moved, seconded by Commissioner Johnson, to approve the minutes for Planning Commission pre-meeting of July 2, 2007 and regular Planning Commission meeting of July 5, 2007. Motion unanimously approved by group vote. 4.2 Public Hearing Items 4.2a Approval of Continuance of Vesting Tentative Parcel Map 11698 (McIntosh & Associates) 4.2b Approval of Vesting Tentative Parcel Map 11472 (Nelms Surveying) 4.2c Approval of Tentative Parcel Map 11554 (Dee Jaspar & Associates) 4.2d Approval of Vesting Tentative Parcel Map 11688 (McIntosh & Associates) 4.2e Approval of Zone Change 07-1114 (Porter Robertson Engineering) The public hearing is opened, 4.2(b) was removed from the consent calendar. No commissioner requested removal of any item from the consent calendar. The public hearing is closed. Commissioner Johnson moved, seconded by Commissioner McGinnis, to approve the consent calendar, public hearing items 4.2(a), 4.2(c), 4.2(d) and 4.2(e). Motion unanimously passed by the following roll call vote: AYES: Commissioners: Blockley, Johnson, Andrews, McGinnis. NOES: None. PUBLIC HEARINGS – EIR Adequacy Hearing 5.1 Bakersfield-Taft GPA/ZC 05-1420 (Montecito Companies) The public hearing is opened, staff report given. Ken Koch with Impact Sciences, the environmental consultant to the city on this project, gave a presentation. No one from the audience provided any comments. The public hearing is closed. Commissioner Johnson referenced page 2.0-27 regarding “the possibility of a severe catastrophe if the Isabella dam were to collapse and that residents in this area would have 12 hours to respond to the flood.” He commented that this number may need to be changed after the Army Core of Engineers updates its inundation map in October. Commissioner Johnson also referenced page 2.0-39 regarding the reference to sewer upgrade that’s suppose to occur with station number three. He inquired what the timing of the sewer upgrade and expansion is to plant number three and if the timing will coincide with this potential development. Commissioner Johnson then referenced page 5.13-11, regarding the discussion about traffic. He inquired about the assertions of the Westside Beltway and Westside Parkway being built out by the year 2016 and specifically with respect to the Westside Parkway, wherein the city received funding for the portion from the Truxtun corporation yard all the way through to Coffee Road and inquired if it will really be funded to Heath Road as the EIR alleges by 2016. Commissioner Johnson also inquired about the Westside Beltway being built from Stockdale Highway to Taft Highway by the year 2016 and if funding will really be there and if not how will it effect the EIR, as there is a strong possibility that the funds will not be there. Commissioner McGinnis moved, seconded by Commissioner Johnson, to refer comments to Staff for preparation of a Final EIR. Motion unanimously passed by the following roll call vote: AYES: Commissioners: Blockley, Johnson, Andrews, McGinnis. NOES: None. ABSENT: Commissioners: Stanley, Tragish, Tkac 6.PUBLIC HEARINGS – Wall and Landscape Plans/Tentative Parcel Maps/Zone Changes Wall & Landscape Plan for Vesting Tentative Tract Map 6850 (Copley Design Collaborative, 6.1 Inc.) The public hearing is opened, staff report given. Claudia Grey, with the Rio Bravo Homeowner’s Association stated that overall the wall and landscape plan is nice and they are in agreement with Staff’s recommendation with the wall on the property line between lots 85-90 in Tract 6850 and the condo private pond be a six foot block, as opposed to the pictured view fence. She stated they feel this is necessary for the welfare and safety of the residents and will provide for protection of the wildlife in and around the pond. Ms. Grey also stated they agree with the textured side of the block wall to face the condos. She also stated that they are concerned with the abrupt ending of the landscaping on Wimbledon Way, as it appears to stop at lot 45 but the property line continues onto the southwest corner of lot 44 and pointed out that is where the access gate is to the condos. She stated they are requesting that the landscaping continue to the end of the property line. Steven Copley with Copley Design Collaborative stated they have no issues with Staff’s recommendations or with the request to extend the landscape down to the entry. He further stated they can extend the block wall along the north side lots. The public hearing is closed. Commissioner Stanley joined the forum. Staff pointed out that Commissioner Stanley will not be voting on this item. Commissioner Blockley inquired if there is language in the condition to address the proposed changes. Staff responded in the affirmative, pointing out that condition number two addresses Planning Commission – August 2, 2007 Page 3 where the block wall must occur and clarified that condition number two where it states, “the split face block wall for lots 39-44 and lots 85” – instead of “290” should say “through 90.” Staff also pointed out that condition number three addresses the extension of the landscaping down to the southwest corner of lot 44. Commissioner Johnson moved, seconded by Commissioner McGinnis, to approve the wall and landscape master concept plan file number 07-0704 with findings and conditions set forth in the attached Resolution, Exhibit “A”, with the amendments as previously stated by Mr. Movius. Motion unanimously passed by the following roll call vote: AYES: Commissioners: Blockley, Johnson, Andrews, McGinnis. NOES: None. ABSENT: Commissioners: Stanley, Tragish, Tkac 6.2 Vesting Tentative Parcel Map 11472 (Nelms Surveying) (Continued from July 19, 2007) The public hearing is opened, staff report given. Ron Nelms with Nelms Surveying stated that he is available to answer any questions. Virginia Howard stated she lives next door to this lot and asked if there could be a privacy fence put in, as she has dogs and they sell animals out there. Ron Nelms stated that with regard to the fence there will be a wood fence required in the conditions and pointed out that the homes will be single family residences. He also pointed out that there are apartments further south zoned R-2. The public hearing is closed. Commissioner Johnson inquired what the condition is for a fence, and further inquired if there is an ordinance that would require a privacy fence. Staff responded that City code does not require fences between lots. Commissioner Johnson asked Mr. Nelms if they would agree to require a fence in the condition. Mr. Nelms responded that the intention is to install a normal six foot high wood fence. Commissioner Blockley inquired if adding a condition would create any enforcement problems, to which Staff responded that putting in a wood fence does not require a building permit. Commissioner Blockley inquired if conditioning a wood fence would cause any sort of planning approval problems. Staff responded that it would be difficult to enforce because the Building Inspectors and Planning Department does not look to make sure fences are in. Staff responded that they see a practical problem of selling a home without a barrier between neighbors, so they cannot see the applicant not wanting to put a fence. Commissioner McGinnis moved, seconded by Commissioner Andrews, to approve tentative parcel map 11472 with findings and conditions set forth in the attached Resolution, Exhibit “A”, and noting for the record that the applicant has agreed to put a six foot wooden fence surrounding the property. Commissioner Johnson inquired if condition 19 could be amended rather than just mentioned in the record. Commissioner McGinnis amended his motion, and Commissioner Andrews amended his second, adding condition 19 which would require construction of a wood fence. Staff clarified that they would interpret the “surrounding” to mean the east and south sides as there are roads on two sides.
