AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY
CHANGING THE LAND USE ZONING OF APPROXIMATELY
2.3 ACRES LYING WITHIN THE RIGHT-OF-WAY OF
STATE ROUTE 99 FREEWAY ON THE NORTHWEST CORNER
OF PIERCE ROAD AND ROSEDALE HIGHWAY.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission and City Council have held
hearings respectively, on a petition to change the land use zoning
of approximately 2.3 acres lying within the right-of-way of State
Route 99 Freeway on the northwest corner of Pierce Road and Rosedale
Highway in the City of Bakersfield; and
WHEREAS, the City Council has determined after due con-
sideration of said petition and the recommendations of the Planning
Con~nission herein on file, together with the reasons advanced at
the hearings for a change of zoning of said property, that a zoning
change should be authorized; and
WHEREAS, the City Council has determined and found that
this zoning ordinance is consistent with the General Plan of the
City of Bakersfield.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield as follows:
That Section 17.12.020 (Zoning Map) of the Municipal Code
of the City of Bakersfield, be and the same is hereby amended by
changing the land use zoning of certain property in said City, the
boundaries of which property are shown on the map hereto attached
and made a part hereof, as follows:
From an unzoned parcel within the Freeway
right-of-way to a.C~D (Comm~clai -
Architectural Design) Zone:
That portion of ~he southwest 1/4 of the south-
east 1/4 of Sectzon 23, Township 29 South, Range
27 East, MDM, described as follows:
Commencing for reference at the southeast corner
of the southwest 1/4 of the southeast 1/4 of said
section;
Thence (1), along the east line of the southwest
1/4 of the southeast 1/4 of said section, north
0o32'47" east, 735.25 feet;
Thence (2), at right angles
north 89°27'13" west, 30.00
of Beginning;
from said east line,
feet to the True Point
Thence (3), along the west line of the east 30
feet of the southwest 1/4 of the southeast 1/4
of said section, south 0o32'47" west, 466.83
feet;
Thence (4), south 6o25'22" west, 218.35 feet;
Thence (5), north 77o19'03" west, 89.32 feet;
Thence (6), north 11o55'04" west, 131.78 feet;
Thence (7), north 4°03'57" west, 538.31 feet;
Thence (8), south 89°27'13" east, 181.41 feet
to the True Point of Beginning.

I HEREBY CERTIFY that the foregoing ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 23d day of November, 1977, by the follow-
