Minutes from last week's Chamber of Commerce Government Review Council meeting are enclosed. There has been a great deal of discussion about the possibility of the Chamber o relocating if the proposed expansion of the Convention Center takes place. The overall opinion is that the expansion would create a positive situation for both the Convention Center and the Chamber. 2. Enclosed is correspondence from the City of Shafter regarding their plans for annexation of the area north of Seventh Standard Road and the development of a Foreign Trade Zone project. 3. Also enclosed is a copy of a letter and mailing list from the County which they will be sending to those people who reside in the Brimhall / Renfro area where the new fire station will be built. 4. Attached is a letter we sent to Burlington Northern Santa Fe Railroad protesting their proposal to close the road crossing at "P" St. There was damage done to the crossing, as a result of a recent derailment, and they propose to close it instead of repair it. 5. A summary of the proposals we received for management of the City parking structure at 18th and Eye Street is enclosed. A recommendation from staffwill be forthcoming. 6. A chronological listing of staff efforts to promote the proposed Chester Avenue streetscape project and to share information on the maintenance district is attached. We received from pension and insurance a one time $750,000 rebate and a cost reduction of $400,000. At this point, I'd suggest facility replacement reserve for both. They are non-recurring revenues and suitable for capital projects. 8. The monthly information report from Development Services is enclosed for your information. 9. Also enclosed is the CIP Status Report for September, as prepared by Public Works. 10. Staffresponses to Council referrals are attached, as follows: · Property maintenance violations at mobile home park at 1500 Pacheco Road; · Status update on traffic control near Eissler School at Auburn and LaCosta; · Update on sight line obstruction at B Street and Highway 178; · Update on placing caution lights near Ridgeview High School. 11. As a reminder, Gail Waiters and I will be attending the ICMA Annual Conference on October 5th through October 9th. John Stinson will be in charge during my absence and will staff the Council meeting. (~ALL TO ORDER - The meeting was called to order at 7:30am by Chakman Schroepfer. 2. CORRECTION TO MINUTES - Weygand moved that the minutes from 9/20/96 show that Murray Tragish was in attendance. The motion was seconded, therefore, the minutes from 9/20/96 GRC meeting will be corrected to show that Murray Tragish was in attendance. 3. APPROVAL OF MINUTES - Arnold moved to apl)rove minutes as amended. Weygand seconded and the vote ,vas unanimous to apl)rove. 4. PROPOSITION 217 - TOP INCOME TAX BRACKETS. REINSTATEMENT. REVENUES TO LOCAL AGENCIES. INITIATIVE STATUTE. - The last of the fifteen state wide ballot measures to be reviewed by the GRC, intends to retroactively reinstate 10% and 11% tax rates, respectively, on taxpayers with taxable income over $115,000 and $230.000, and joint taxpayers with taxable income Over $230,000 and 460,000. It will also provide that the State Controller will be required to apportion revenue from reinstated tax rates among counties. Lastly this measure will require counties to allocate that revenue to local government agencies based on each local agency's proportionate: share of property taxes which must be transferred to schools and community colleges under 1994 legislation. The State Legislative Analyst predicts annual increase in state personnel income tax revenues of about $700 million, xx4th about half the revennes allocated to schools and half to other local governments. Weygand moved that the council vote on whether or not a position should be taken on Prop. 217. Arnohi seconded and the vote was unanimously in favor of taking a position. GRC feels that taxes on businesses in this state are already too high. This tax will also give California the highest personal income tax rate nationwide. This is sure to deter new business from establishing in our state. Many of the Chamber's member businesses file personal income tax. This would directly.effect their ability to produce. GRC feels that a person should not be punished for doing well for themselves. Because of these reasons Weygand moved to oppose Prop. 217, Arnohl seconded, and the vote was called to a question. 9 voted in favor of the motion, 1 voted against it, no abstentions. GRC recommends to the Board of Director's that the Chamber OPPOSE Prop. 217. an GRC MINI-PLANNING SESSION - As xve have come out ora busy 2 months of reviewing various issues d measures related to this November's election, the need to plan for the next fe,v months is in need. Some issue / of concern discussed: Valley Floor Habitat Plau. the PM-10 issue, the nexv Smog Check lmv. It was suggested / that the Chamber begin to take a more pro-active lead regarding local issues. Cole suggested that we start to pave the way for things to happen, leading other organizations to follow along. Examples include: The River Walk Project and many other economic development issnes. It was also suggested that tile Chamber start working with the Doxvntoxvn Business Association (DBA) more closely ill the implementation of the River Walk Plan. Much discussion occurred regarding the possible move the Chamber may make as a result ora new~ addition to tile ctconvention center... As I indicated, we did not expect this annexation to be a concern to Bakersfield. We have generally considered the property north of Seventh Standard Road as Shafter and have proceeded accordingly. As we discussed, Shafter believes it can assist in the development of the Foreign Trade Zone project. Since the FTZ is located on our border at one of the major entrances to the City, we have a unique interest. I am sure we all agree that the jobs produced in the area will greatly benefit Bakersfield, no matter what jurisdiction the project is in. I:reviewed some:of Our files as I said I would. The discussions concerning City boundaries took place late in 1990 and early in 1991. Council Members Zachary and Hiebert represented Shafter. It appears that Council Member Smith from Bakersfield was party to the discussions as was City Manager Dale Hawley. We are unsure of the other Council Member. Wasco also participated in these dicussions which were'initiated by Dale Hawley and Marland Hiebert. The discussions began following a well publicized "Community Visions" project conducted by Shafter wherein the community (including citizens and property owners from within the incorporated City limits and those outside) described Shafter as extending from Seventh Standard Road to Kimberlina. The City's General Plan, completed in September 1993, identified Seventh Standard Road as Shafier's southern boundary. Once again, this effort included significant community involvement and was widely publicized. The current "Visions" project is identifying similar boundaries for Shafter. As I said in our meeting, Shafter is not interested in fighting with Bakersfield. We trust that our differences are few and can be worked out. We believe the area north of Seventh Standard Road in the area of Santa Fe Way is Shafter and we are proceeding with our annexation plans. The Board also authorized County staff to begin a search for a residence to serve as a temporary fire station, or to establish a temporary fire station on the Brimhall and Renfro site during construction of the permanent facility. On September 25, 1996, the Bakersfield City Council also approved the Fire Services Ad Hoc Committee's recommendation to site a fire station near the comer of Brimhall and Renfro Roads. The requirements of the Joint Powers Agreement pertaining to new fire station locations are satisfied and steps have been completed to provide fire protection service from the Brimhall and Renfro area. A residence has been identified to serve as a temporary firestation during construction of the permanent facility. A Conditional Use Permit is scheduled to be reviewed by the Board of Supervisors on October 21. The permit process requires a fourteen day period for public Comment, after Board approval, before the permit becomes effective. We anticipate staffing the temporary fire station by November 15. The actual construction start date for the · permanent fire station is planned for January, 1997. There are several requirements which must be satisfied before construction may begin. Based on a start date in January, completion of the new fire station is anticipated to be no later than July, 1997. However, my staff will continue to explore ways to accelerate the process. Closure of the crossing would be detrimental to the operation of both facilities. 2. Funding for grade separation projects relies on a priority point system. One of the factors considered is the closing of other nearby at-grade crossings in addition to the one being separated. The "P" Street at grade crossing may be utilized as a factor in future grade separation priorifization. Unilateral elimination of this crossing without the benefit of closing it as part of an overall effort to separate other at-grade crossings would be a waste. In reviewing my file, I find that discussions were held during a Public Utilities Commission Hearing, Case 8767, held in 1969 where it was suggested to close t~e "P" Street crossing inasmuch as the crossing was relatively unused, however apparendy nothing was pursued for the road closure after the hearing was held. Proposals were received by Allright Management Services, Ampco System Parking, Executive Parking, Five Star and Zee Parking. On September 20, 1996 city staff conducted interviews with four parking management firms. Zee Parking was not invited for the interview due to an unsatisfactory proposal and reference check. An item that was particularly emphasized in the RFP was marketing the parking structure to increase occupancy:~ All four firms submitted detailed marketing plans to identify potential revenue sources for the garage. Ideas included improving the image of the structure using signage and graphics, advertisement programs, analysis of the current on-street parking situation, complimentary give aways, and services such as car washing and detailing. The following are the management fees proposed by the firms. Staff also asked the firms to include an incentive plan for which firms would be paid a bonus for increasing the monthly lease occupancy rate in the structure. Allright Management Services Management fcc is $1.25 per managed space for monthly parkers and $1.25 for each of the 82 daily spaces. For example, for 300 monthlies and 82 dailies the monthly management price is $477.50. Bonus incentive is 10% of monthly revenue after initial 10% increase from current level. Marketing programs are provided at little or no cost to the city. Ampco System Parking Management fee is $1.95 per space per month with a minimum fee of $1,000.00 per month. Bonus incentive is 10% of the improvement in net operating income. Included in this fee is off-site supervision, overhead allocation, data processing charges, payroll processing, postage services, travel expenses. Ampco will charge for all operational expenses. Executive Parking Management fee is $1.38 per space or $750 per month. Proposed incentive is 10% of increased annual net revenue. EPI would be reimbursed for all on-site operational expenses. The fee provides all EPI's administrative and corporate services including 24 hour supervision. Included in the fee are parking facility supervision, management services, and special purpose consulting services. Five Star Propose to manage and operate the structure for $1.38 per space per month. The current monthly fee would be $630.66 to manage 457 spaces. The incentive bonus fee would be $1.38 per additional space management required if occupancy increases. The maximum monthly fee would be $1.38 x 545 spaces for $752.10. Deletion rate would be $1.38 per space. At the interview, Five Star indicated they would reduce the number of spaces they are currently paid. Randy Anderson indicated he would take a pay cut. Staff will soon be preparing an administrative report for action at the October .23, 1996 City Council meeting. We received a $432 energy rebate check from P.G.&E. for putting reflective film on Windows of the Development Services building. Even without the rebate it was estimated that the $3,270 cost would have been offset by energy savings within 18 months. General Services has the account for these rebates. 2. The new garage gates became operational two weeks ago. Since then we have had the pleasure 0f coming to work without having to park in litter and broken glass or walk through filthy entrances or read the latest graffiti. Nor, have we had any additional theft or vandalism of equipment. We will be putting signs up explaining how to activate the gate opener so people will know how to leave after the gate automatically closes at 5:15 p.m. 3. Relocation of Code Enforcement to the second floor should be complete by the end of October with the delivery of furniture and hiring of two additional staff. General Services staff has done an outstanding job. 4. Representatives of a proposed cardiac care hospital met with staff to discuss the development review process. They expressed a desire to do an EIR and locate the hospital on Select Avenue although other sites may be under consideration. 5. Preparation of the EIR for development of Castle & Cooke's property south of Brimhall and West of Calloway has commenced now that Castle & Cooke has completed the application and settled on a project description. 6. You have seen the news reports on one of our abatement cases. As a matter of information I have included a listing of other active cases we are involved in. Judge Kelly approved our first foreclosure for failure to pay abatement costs. 7. We are in position to issue an RFP to do the EIR for plan line adoption of the south beltway. Public Works and Planning staffs will be meeting soon to define roles and responsibilities of those who will be working with the consultants. Four miles of the proposed 20 mile route pass through the city. You have heard that Caltrans is recommencing the environmental review for ronte adoption of the Kern River Freeway. With more than $300,000 budgeted to complete the last two chapters of an EIR that has been in "production" for four years, they are going to mosey on down to Bakersfield to see why we planners are so negative over their latest thoughts of ripping an alternative route through a mile of brand new homes and the middle of Castle & Cooke's approved senior Fairways project. What a tragic waste of public resources we must participate in to eventually reach an obvious conclusion. A letter has been sent from the Building Official to unreinforced masonry building owners to remind them of the deadlines. So far we are down to 143 from 199. Several were returned so we will do title searches and send the new owners letters just in case the former owners didn't fully explain the rules of URM building ownership to them. 10. Staff is meeting to coordinate a response to the notice by Shafter that the Foreign Trade Zone is the object of their annexation. 11. Representatives of Enron have made an appointment with me to discuss the annexation by Shafter. It will be interesting to hear their thoughts. 12. Staff met with representatives of an investment group on September 20 to discuss possible annexation of the North Bakersfield Sanitation Facility. They were here to see how friendly we could be. 13. A listing of annexations completed over the last 12 months is attached. Also attached is an updated status chart and map of areas we are interested in annexing. I am collecting property ownership information about edge annexations for discussion. 14. As you have noted, North Bakersfield Recreation and Park District has been using each case we hear on development north of the river as an opportunity to point out their need for additional funding for park development. Since our ordinance was adopted contingent upon the county's adoption of it within six months, I can't blame them for becoming anxious. When the computer upgrading of the Engineering Division is completed, all Engineenng staff will be able to access and update individual project progress (i.e. enter completed tasks) from their own computers (currently, this progress must all be entered from only one computer). With completion of this computer upgrading, the Monthly Status Reports will become basically "automated". Upon contacting the owner in space 1, Lori Taylor (833-2874), I was advised that she had replaced her fences to keep her dogs in her yard. The fences are 6 feet tall, wood construction and appear to be legal and consistent with fences in the park. Ms. Taylor allowed me to inspect the camp trailer in her rear yard and it was not connected to electric or water. The trailer had storage items inside and has not been lived in recently. Ms. Taylor stated her grandchildren have used the trailer for a playhouse in the past. A notice and order was issued to remove the junk, trash and debris in the rear yard. Ms. Taylor stated it would be removed within a week. I responded to space 18 and contacted the owner, Randrew Durossette (834-9515), regarding property maintenance violations. A large amount of junk, trash and debris was visible in the front yard along with auto parts. A notice to abate the property maintenance violations was issued along with a correction notice to abate a water leak at a damaged valve. I then responded to space 31 to check for violations. Numerous potted plants were visible on the west side of the trailer. The east side of the trailer had numerous items, however, no trash or debris was noted. It appeared that the owner may have abated the problem. I contacted the reporting party, Thelma Hale, and advised her of my investigation and findings. Mrs. Hale said she appreciated our assistance in getting these problem areas abated. (WARD3) REFERRAL/REQUEST: "SMITH REQUESTED STAFF PROVIDE AN STATUS UPDATE ON TRAFFIC CONTROL NEAR EISSLER SCHOOL AT THE INTERSECTION OF AUBURN AND LA COSTA" RESPONSE: The intersections of Auburn at La Costa and Auburn at Eissler meet warrants for a traffic signal system. Because of the proximity of each intersection to the other, the traffic signal for each intersection will need to be installed at the same time and operate as a coordinated system. Since it may be several years before the locations can be funded, alternate traffic controls to mitigate current operational problems, primarily at Eissler and Auburn,' were investigated. The Traffic Engineer concluded that a 4-way stop at Eissler and Auburn would reduce the operational problems in this area for the immediate future until at traffic signal system can be funded. The 4-way stop has been approved and work is progressing to get the street ready for the stop signs and marking changes. Since the annual contractor must remove the numerous existing school markings on the pavement before the signs and new "stop ahead" markings are installed, the actual stop signs will not be functional for about 10 days to 2 weeks. The Eissler intersection with Auburn has a school crossing guard. Traffic volumes are of sufficient number that the school crossing guard warrant is still met and no changes are proposed to that program at this time. It is probable that when the traffic signal is installed, the school crossing guard will no longer be warranted. Traffic Engineering will re-evaluate the crossing at that future time. REQUEST: Drivers headed northbound on B Street at 24th (State Highway 178) encounter a visual obstruction preventing them from seeing oncoming traffic on 24th due to landscaping or other items in an island area of the roadway. UPDATED RESPONSE: In late June 1996 the State Department of Transportation, CalTrans, was contacted and put on notice of a potential safety problem caused by their landscaping overgrowth in the traffic island. Mr. Jim Davidson of the local maintenance section of CalTrans in Bakersfield was contacted and promised to take care of the problem. Three months have passed and no trimming of the overgrown landscaping blocking visibility has taken place. Mr. Robert Jamison, in charge of traffic safety at CalTrans' Fresno office, was contacted by the Traffic Engineer and informed of the safety problem. He agreed that this was a problem and promised to get the shrubs trimmed and will contact the local maintenance people to expedite the trimming. Based on the operation of the intersection, visibility, the increase in student drivers, pedestrians and base volume of traffic, a 3-way stop was determined to be warranted until a traffic signal is installed in the future. Preparations to the road are being made to remove the numerous school markings and signs by the annual contractor for the City. When those are removed, city crews will install new "stop" and "stop ahead" markings with the stop signs. This is estimated to be completed in 10 days to 2 weeks, if no delays are encountered. Ms Connie Wattenbarger, a Kern High School District Trustee interested in the traffic problems, was informed of the stop sign project and future warning beacons for the school zone. She informed Ridgeview High of the stop signs and beacons. Response completed. If school zone beacons are installed, it will still not mitigate the problem at the Rvzona and Stine interjection which serves as primary, access to the school site and student parking lots.
