SUBJECT: GENERAL INFORMATION
1. The RFP for the design/build team for the Convention Center expansion is being sent out this
Friday. We also met with the Chamber following Wednesday's work authorizations, and we are
active on the other work elements, as well. The schedule is tight on this project. I know you
all have extremely busy schedules, but it might be of great help to us if you would consider one
or two one-topic special meetings on this subject at the time of critical steps. It could save a
month getting started if you would.
2. As some of you were aware, we had a breakdown of ice making equipment at the arena this
week. I'm happy to report that Honeywell accepted full cost responsibility.
3. On Wednesday of next week the department heads and my office will be doing our annual day
long planning session. We will be in town. Dolores Teubner will be in the office that day if you
have issues to deal with.
4. A memorandum from Public Works regarding clean up of a waste tire pile in southeast
Bakersfield is attached. Also attached is the correspondence we sent to the California Integrated
Waste Management Board indicating that we will work with the County LEA to keep the area
cleaned up.
5. Responses to Council referrals are attached, as follows:
· update on the $170,000 of Destec funds being used at Siemon and University Parks;
· inquiry regarding trash pick up at 809 Chester Ave.
6. It appears from indications given to us this week that the bonding company is accepting their
responsibilities on the Police Building and will (soon, we hope) have a contractor on site.

RE: CLEAN UP OF WASTE TIRE PILE IN SOUTHEAST BAKERSFIELD
A pile of thousands of scrap tires at the east end of Watts Drive is currently being removed
by State contractors using California Integrated Waste Management Board (CIWMB) funds.
It just so happens that some of the CIWMB staff thought they were doing so in a County
unincorporated area. Apparently, the County LEA got the CIWMB going on the project.
We learned of the cleanup when the CIWMB wrote the County to request assurance that
the pile will not reappear, and the County Solid Waste Department turned the letter over
to us, thinking that we should be responsible for future enforcement. Instead of accepting
full responsibility, we have prepared the attached response in support of the LEA's true
responsibility.

Dear. Ms. Rice:
The City of Bakersfield has been provided a copy of your 9/30/96 letter to Kern County on
this subject, requesting that the County assure the situation will not be repeated. Because
of our appreciation for your assistance in abating this nuisance, and our intent to keep it
from recurring, the City also offers you its assurance that it will assist the County Local
Enforcement Agency in preventing tire stockpiling at this site.
As you will recall, the City cleared its own property at an early date via an order to the
adjacent land owner to clear their tires and debris from City right-of-way. Now that the
private property is being cleared, the City will use code enforcement efforts, zoning, and
Conditional Use Permit restrictions to the fullest extent possible to prevent reoccurrence.
Once again, thank you for your assistance.

SUBJECT DESTEC FUNDS/PARK IMPROVEMENTS

Councilmember Patdcia Smith has requested an update on the $170,000 of Destec funds
that is being used for improvements at Siemon and University Parks. Below is a
breakdown of the projects by park.
SIEMON PARK
· TENNIS COURTS
Bids are being obtained to repair and resurface the courts.
· BASKETBALL COURTS
Price quotes are being received for the demolition and pouring of a new
concrete court.
eBESTROOM IMpROVEMENTR
Preparing construction package which includes: ADA modifications, repair
of roof, interior lighting, and toilet modifications,
· VOLLEYBALL COURT AREA
Redesigning the court area due to current maintenance problems. The
new design would consist of a concrete border with sand.

UNIVERSITY PARK
eSUMP DRAINAGE PROBLEM
Public Works staff is currently studying the water problem.
e_SECURITY LIGHTING
The northeast section of the park is being reviewed for security lighting and

There are approximately thirty (30) 24" box trees that will be ordered in the
near future. At present, we are checking with nurseries for availability,

Soccer Foundation and Highland High School Stadium Fund. To date the following has
occurred.
KERN COUNTY SOCCER FOUNDATION. ($100.000)
The Foundation has completed their lighting project. There are now. four (4)
lighted soccer fields at the Soccer Complex. On October 3, 1996 the first
games were held utilizing the new lighting, Full payments have been made to the
Foundation.
HIGHLAND HIGH SCHOOL STADIUM PROJECT. ($230,000)
The committee continues their fundraising efforts. The plans and specifications
for the stadium lighting have been completed and are in the process of being
reviewed by the State Department of Architecture. The stadium committee
herd a ground-breaking ceremony on October 24, 1996 at the school.

SUBJECT: DESTEC FUNDS
As you know, Destec granted the City funds to be used for the improvement
or construction of recreation facilities in the Northwest. Council approved a
$100,000 disbursement to the Kern County Soccer Foundation for lighted soccer
fields. This project has been completed and all $100,000 disbursed.
$230,000 is earmarked for the Kern CoUnty High School District for use at the
new Highland High School stadium. This project has not yet submitted any invoices
and is not expected to do so for some time. It is our understanding that the Parks
Department will provide you with a written update regarding the status of
improvements at Siemon and University Parks with the remaining $170,000.
In terms of an update on the Walt Heisey situation, it is our understanding that
Frank Fabbri has scheduled an appointment to meet with Mr. Heisey and his engineer
on November 14, 1996.
Please advise if we can be of any further assistance in this matter.

SUBJECT: Response to Councilmember Carson's referral regarding
Refuse Service ~ 809 Chester Avenue, "Cake Crafter" (Ward 1)
This memorandum is in response to a complaint received from Mr. and Mrs. Wilson of the Cake
Crafter bakery that they dislike automated trash service because the cart does not hold everything,
i.e., cardboard boxes in particular.
However, Solid Waste Division staff has found that the Wilsons have never been billed for trash
service. Staff researched accounts under 809 Chester Avenue; 809 South Chester Avenue; Wilson;
"Cake Crafter;" and anything under "Cake .... "There is no indication that any minimum service has
ever been paid for in the past.
Mr. Wilson told John Wilbum (Solid Waste Supervisor) that he never used trash service, alleging he
took his trash to the dump himself. Mr. Wilson also stated he never paid a minimum monthly trash
bill but instead paid the yearly fee of $57. (It was explained to Mr. I4qlson that the $57 per year
covers the County parcel fee for landfilling costs only, not for curbside pickup and delivery of trash
to the landfill.)
Moreover, the City routing log notes: "809 Chester, 1 can, in the alley." This indicates that staff
did indeed dump trash cans behind the Cake Crafter but never billed the customer. Routing
information is not linked to billing data in the computer. Apparently, the Wilsons were overlooked
and received free service for an undetermined period of time.
Conclusion
It is not the intent of staff to back-bill the Wilsons for past service but only to bill for minimum
service, or any additional service requested, from this period forward.
