Last week the Board of Supervisors voted 4 - 0 to approve the Transportation Impact Fee Ordinance in the same form that our City Council approved on December 4th. The effective date will be February 10, 1997. A memorandum from Public Works is enclosed. 2. A letter of appreciation is enclosed from H.U.D. praising EDCD's Fair Housing Plan as "one of the best efforts coming out of southern California". 3. The latest activity status report from the County Environmental Health Services Department regarding the LEA's regulated projects within the City is enclosed. 4. You will recall that several months ago we had some serious problems with the contractor that was hired by GST Telecom California to install fiber optics on Truxtun Avenue. We revoked their permit, pending an agreement to correct damages they caused. City staff has met with their representatives to identify the problems and discuss solutions, and GST submitted a proposal for consideration this week. We will be meeting with them to further discuss the issues. 5. Responses to Council referrals are enclosed, as follows: · update on the possibility of installing a street light at Beechwood and Stine Road; · inquiry on the time frame for installation of a traffic signal at Beechwood and New Stine Road. 6. I will be taking some time offaround the holidays, including December 23-24, 26, 27, and 30th. John Stinson will be in charge in my absence. Rojas, Public Works Director~ DATE: December 9, 1996 SUBJECT: Proposed Transportation Impact Fee - Board of Supervisors' Action At their meeting today, the Kem County Board of Supervisors voted 4 - 0 to approve the Transportation Impact Fee Ordinance in the same form that our City Council approved last Wednesday at their meeting. The effective date will be February 10, 1997. In addition to their action approving the fee program, Supervisor refered to staff the directive to prepare a study to determine the ADT rates for certain commercial uses. When we received your mailing~last summer I only had time then to quickly scan the pages. I was very much struck by what I saw, especially the extraordinary vision and mission statements. And so on a recent flight to Washington, D.C. I took the time to read the plan more closely. I wanted to show off in Washington one of the best efforts coming ou~ of Southern California...to show what a community could do when they approached the effort with appropriate seriousness and With the view that this was in that community's own best interest. Congratulations on a great job. And forgive this very tardy note of thanks. There are a couple of questions that I have (You knew I would): 1. Did the City Council have any discussion or special briefing regarding the Plan? 2. What formal action did the Council take with regard to the recommendations from the AI? A portion of this network is located within the City of Bakersfield. Locally, our construction to date, consists ora link connecting the MCI microwave site near Taft with the Pacific Bell Central Office in Bakersfield. and a small portion of our planned "City Loop". This City Loop is designed to bring state of the art, high speed, fiber optic technology to the Bakersfield business community. During the course of performing our initial construction, several conflicts arose between the Ci~~ of Bakersfield and Herman Weissker, Inc., our construction contractor. As a result of these conflicts, we find ourselves in an adversarial relationship with the City. We have now applied to the City. for a permit to continue our construction, but have been refused pending our agreement to perform some restoration requirements which we believe to be excessive: specifically, the repaving of t~vo lanes of Truxton Avenue, between Mahawk Street and Chester Avenue, a distance of approximately 14,000 feet. Based on estimates received from qualified paving contractors, this work would cost approximately $270,000. This requirement was not identified in our original permit and, to our knowledge, is unprecedented anywhere else in the city. The impact of such a restoration requirement could significantly impact our ability to complete our planned network. We are committed to the completion of our network and making a meaningful contribution to the development of the information highway. We are equally committed to accomplishing this goal while maintaining a good working relationship with the cities and counties along the way. To this end, we are anxious to resolve our current differences and continue our forward progress. We cannot, however, justify a punitive measure the magnitude of which has been imposed by the City. In an effort to develop an appropriate corrective action plan, we have recently met with various City personnel to identify our current problems and discuss Potential solutions. The result is a plan that we believe will address the CiD:s concerns while allowing us to complete our construction as quickly as possible, with an absolute minimum of disruption. GST Telecom California, Inc. is a subsidiary of GST Telecom, Inc. GST Telecom, Inc. is a subsidiary, of GST Telecommunications, Inc. (AMEX:GST). Therefore, we respectfully submit the following proposal for your consideration: GST will immediately replace Herman Weissker, Inc. with a qualified contractor acceptable to the City. GST will suspend all construction activities (with the exception of on-going cleanup, or emergency restoration), until after January 1, 1997, so as to a~void any disruption during this holiday period. GST will grind and repave one lane of Truxton Avenue, from'a point just east of Mahawk Street, to the railroad overpass, a distance of approximately 4,000 feet, pursuant to instructions from Mr. John Pierce, on October 8, 1996.. GST will perform construction activities during nighttime hours, where appropriate. GST will limit longitudinal construction activities to a maximum distance of 2,000 feet at each location, or as directed by the City. GST proposes to change the method of construction from the "pot hole and bore" method, to the "rockwheel" method. This change will accelerate construction activities, and create significantly less disruption in the process. This will provide approximately three times the illumination. Initially we thought that by increasing the candle power and adjusting the fixture, we would have a temporary fix. However, a night time review by a street light technician verified that the changes luminate the whole intersection; therefore, providing a more permanent solution. I hope to be able to address the concerns you have raised. By way of background, Community Development Block Grant (CDBG) funds are allocated directly from the federal government to any community having a population of 50,000 or more. Bakersfield has been a recipient of these funds since 1977. Currently we receive approximately $2.9 million a year. The federal statutes governing the use of these funds give great latitude to each entitlement community. This latitude allows each entitlement community to decide for itself (as opposed to being dictated to from afar), how to best utilize theses funds in addressing local issues. The Federal government does require that any program established or project funded through the use of CDBG funds meet one of three natiOnal objectives: 1) The elimination of slums or blight. 2) Benefit to low and/or moderat.e income households. 3) An urgent need. In most instances entitlement communities focus on the fh'st and second national objectives. The third national objective is utilized only in the event of some large catastrophe (earthquakes, floods, large scale conflagration, etc.). With respect to the particular activity that has caused you concerns, I wish to assure that it is eligible and falls entirely within the federal guidelines. The activity is designed to benefit Iow and/or moderate income households by creating jobs. Of the number of jobs to be created, fifty-one percent must be filled by a member of a low and/or moderate income household. The percentage of jobs reserved for low and/or moderate income is a federal requirement. Naturally we hope more low and/or moderate individuals will be hired, but 51% is the minimum percentage required. Eligibility as a low and/or moderate income household is determined by the size of the household " and the total annual gross income of the household (i.e., - family of four $29,500). The calculation... of the annual gross income is done at the time of hire. We do not dictate to the company its pay scale. It's focus is to create jobs and encourage development in Southeast Bakersfield. The City is not selectively rewarding these two particular companies. The assistance is available on a first come first serve basis to any company wishing to locate in Bakersfield or expand an existing business and that is willing to make an investment in our community. This program is just one of the City's efforts of ameliorating the cause of poverty. Our efforts also include funding assistance to non-profit agencies which provide essential services to our most needy residents, as well as infrastructure improvements and assisting individual families in securing of affordable housing.
