1. At long last, I think, we are there on the tax split issue! Joel Heinrichs
and I came to agreement this week on a document. It has two steps yet to
go. First, the County Counsel's Office has not yet reviewed it.
Hopefully, that will not become a major problem. Secondly, the other city
managers are coming in on Monday for a joint meeting on it, and a meeting
with Heinrichs. While I have been generally keeping them informed of what
the content of the document is, this will be their first chance to read it
and to directly raise questions. There could be issues there.
2.
Nonetheless, I think the end is finally in site, and it is a relief. The
basic agreement will provide for a master tax split document which allows
most annexations without going through an individual negotiation with the
County on that annexation. For example, it allows residential, vacant
�and, all islands, and lower value commercial and industrial properties.
On higher value properties there would still be individual tax split
negotiations. The agreement also sets up an ongoing process to communicate
between the cities and the County on service duplication and on achieving
efficiencies. It is a compromise on the distribution of taxes for all of
the cities, down from 44% to 37.5� for us; we do not give away any sales
tax. It will allow us to proceed with island annexations and reasonable
development opportunities and is, in the long range, better for the City
than the circumstances we have been under since the County imposed their
freeze on annexation. I will keep you informed as these last two steps are
underway, after which it will be ready for Council consideration if no more
hindrances appear.

4. I have also met with the County CAO on an update of the proposed financing
plan for the baseball stadium. I will make that presentation a part of_
Wednesday's workshop during which the HOK study results will be brought
forward.
5. The Water Resources staff is holding low key decisions with Olcese Water
District on working tagether, combining, or otherwise using our strengths
to enhance the economics of water supply in the northeast Olcese districts.
They are low key discussions which will proceed rather slowly, but we may
be able to bring some strengths which would help development of that area,
help keep water costs favorable and assure adequate supplies.
6. A status report on the Coffee Road Separation of Grade project is enclosed.

the Kart Track located below the bluffs, potholes on Daggett Avenue and Rio
Bravo Drive, traffic accident problems at the intersection of "L" and

Maintenance District Survey showing an increased number of responses from
the memo you received last week.

DATE 28 July 1995
Recently, the Park's Division was notified by the United States Department of the Interior
(see attached letter) that we were selected as one of five winners in the 1995 Leadership
in Water Conservation Awards.
This award recognizes the City of Bakersfield for their use of the computerized Rain Bird
Maxicom Control Center and the Rain Bird Weather Station as a water management tool
to control the irrigation systems in some of the City Parks and landscaped area.

SUBJECT: Central California American Planning Association (CCAPA) - 1995 Outstanding
Planning Award for the Bakersfield Consolidated Plan 2000
The City of Bakersfield recently received a California Chapter CCAPA Outstanding Planning
Awazd for the Bakersfield Consolidated Plan 2000. The City was recognized on July 21, 1994
at the CCAPA nominations and awards program in Fresno for their efforts to promote planning
principles and advance the planning profession. The CCAPA has also nominated the Consolidated
Plan 2000 for a 1995 State APA planning award. The winners of the State APA Outstanding
Planning Awards will be announced in early October, 1995 at the annual State APA conference
in Santa Barbara.
The Consolidated Plan 2000, which was approved by the City Council last April, won in the
Comprehensive Planning Award - Large Jurisdiction. The CCAPA recognized the Plan for its
ability to allow communities to apply for HUD resources under one strategic plan and address
community needs such as economic development, housing, public facility/services, homelessness,
and infrastructure through a clear action plan with specific benchmarks and performance
measures. As you are aware, this is the second year that the CCAPA has recognized the City with
an outstanding planning award with the first year being 1994 for the City's FY 93
Comprehensive Housing Affordability Strategy (CHAS).

Council Referral # 15154 (Kart Track Noise Complaint)
City Council referral #15154 is in reference to late-night noise
coming from the kart track located below the bluffs off of Alfred
Harrel Highway. The referral was made by Council Member Smith
through City Manager Tandy's office.
I made phone contact with the complaining party, Linda Freeman, 4200
Boise #23-8, 872-4715. Mrs. Freeman indicated the noise coming from
the kart track below the bluffs was very annoying as the karts were
running after 10 p.m. Freeman indicated that it was very difficult
for her and her neighbors to sleep, and they can't open their balcony
doors at night because of the noise coming from the track. Freeman
stated the karts run during the week as well as the weekends.
Freeman does not have a problem with the track or the activities
there as long as they stop after 10 p.m.
Mrs. Freeman has called the police department on at least one
occasion and had officers respond due to the noise level.

I have also contacted Bruce Sarver who has an affiliation with the
Kern Kart Club, which is the organization that runs the track. I
advised Sarver of the complaints, and he indicated that the track is
open on Thursdays only during the week for night practice. Members
only use the track at that time, and it usually shuts down before 10
p.m. The only other time the track is used at night is during race
events on the weekends. Sarver indicated that even during events on
the weekends, the track usually shuts down around 10 p.m. Sarver was
going to take the information I provided to the board of directors of
the club and try to eliminate any further problems.
Bakersfield has a noise ordinance, M.C.9.22.010, however it does not
seem to apply to this situation. The source of the noise must be
within 1000 feet of residences. There are other standards that can
be used and are listed in the ordinance, but further study by the
city attorney may need to be done to determine if they apply.

TRAFFIC ENGINEER'S RESPONSE:
Traffic Engineering staff have been investigating the intersection operation in
response to a previous request from the Ebony Counseling Center. Accidents
that have been reported to the Police Department have been reviewed. Based on
staff observations and the Police reports, no specific problem could be identified.
Accidents have occurred from all directions with most drivers not stopping for the
red light.
Since no specific prablem could be determined based on available information,
the conclusion is that the drivers may simply not be seeing the traffic signals.
This location is of an older design and therefore eligible for an upgrade to current
design standards. The upgrade would include longer mastarms with more, and
larger, signal indications. Where this type of modification has been done in the
past, we have seen a drop in accidents, especially where drivers were running the
red light. No estimate has been made of the probable cost at this time. Similar
projects have cost about $100,000 to $120,000 since it requires all poles, vehicle
detectors and conductors to be replaced. We will be adding this project to our
signal priority list for possible inclusion in the 1996-97 CIP.

TRAFFIC ENGINEER'S RESPONSE;
The Traffic Engineer and staff have been working with neighborhood groups in
the Oleander/Sunset Park area regarding speeding and traffic problems for the
past year. As a result, a project for "Channelization, Signing and Marking - Speed
Control Features, Oleander Area" was proposed by Traffic Engineering for the
1995-96 Capital Improvement Program budget and approved by City Council.
During this 1995-96 year, staff will be developing strategies to reduce speeds on
Oleander and channelize traffic to calm traffic. Strategies may include diverters,
striping changes, signs and other devices yet to be determined.
No additional information at this time on the project.

Panorama Hills Park Maintenance District Survey
On July 13, 1995, Public Works and Parks staff sent out a letter and survey form to the property
owners within the boundaries of the proposed Panorama Hills Park Maintenance District. This
letter requested that by July 31, 1995, the property owners respond as to whether or not they would
support the formation of a Maintenance District to pay for the annual upkeep of a park in their
neighborhood. Five hundred thirty-eight (538) surveys were sent out; as of Monday, July 31, we
have received 242 responses (approx. 45°�o response). The majoriry of the responses show that there
is insufficient support for the formation of a maintenance district to support the Panorama Hills
Park.
The boundary of the proposed district encompasses appro�cimately 439 assessable acres and 538
assessable parcels. The response to date is as follows:

Since our maintenance district are based on assessment district law which allows for majority protest
by area assessed, and since 52% by area of the proposed district has responded negatively to the
formation of an assessment district, staff does not recommend that we go forward with the
maintenance district formation procedure.

5TATUS REPORT
July 28, 1995
1. The Planning Commission appointed a committee to meet with the Urban Development
Committee concerning the small lot subdivision issue. Those who will meet with the
Council committee are Commissioners Hersh, Boyle and Brady. They were the
committee members involved in the draft ordinance which was not adopted by the City
Council at its last hearing. Stan Grady, who worked on the prior ordinance extensively,
will also attend the Urban Development Committee on August 16.
2. The Planning Commission also conducted a workshop on the trails plan for northeast
Bakersfield during its last meeting. We had several speak in favor from the equestrian
group and Sierra Club. One property owner, Jim Nichols, suggested some changes to the
trails to be more consistent with the subdivision map which was approved containing trails
and a representative from Cattle King Estates spoke against the trails plan.
3. Kern COG Executive Director, Ron Brummett, has been hosting informal discussions
involving the COG, Richard Russell, representative of the Kern County Assessor's Office
and Mr. Wilbanks, the County Surveyor and myself to promote a memoradum of
understanding or joint powers agreement to designate Kern COG as the central
coordinator of Geographic Information Systems. At the last meeting we discussed an
MOU which the City Attorney's office felt went a bit too far. I suggested that the MOU
under discussion at this point ought to be one which all the governing boards and Council
might consider to either endorse our continued working together towards cooperative
effort in developing the GIS rather than an open end one which might result in
development of an organizational arrangement which the Council should be more
involved in. The Assessor has requested a demostration of GIS to see what kind of
power and versatility it has and what applications it might have to his work. We have
arranged to have a demonstration on August 24 at 9 a.m. in the downstairs conference
room of Development Services.
4. As a result of my discussions with the City Attorney's office about the GIS possible
meging of data and use of our products by others, she directed Janice Scanlon to work
with my staff and have the mapping system copywrited in the computer so that we retain
control of it.
5. In your absence last week, John Stinson and I prepared a response to Bill Turpin's
proposed policy for LAFCO's adoption which would make amendments to Spheres of
Influence very difficult. It seems Bill and his board are intent on adopting some policy.
Our efforts were to argue that his policy went way beyond the law and that the policy's
requirements to be a report of information which is readily available to the city and which
would be applicable to almost all of the amendments thereafter. Once we were to
assemble that information, it would just be repeated for each proposal after that.
6. Another governmental relations issue which I think the Council is already aware of is the
fact that we no longer collect the Department of Fish and Game CEQA fee of $1,250.
Following a discussion of that fee at the Urban Development Committee, Councilwoman
Smith went home and retrieved a newspaper she had picked up in Sacramento which
contained a story about how the Department of Fish and Game had come to a settlment

agreement not to collect that fee any longer. 50, she brought that to our attention and
we checked with Fish and Game and stopped collecting the fee. We arranged to refund
money which we were still holding and had not yet deposited with the County.
7. In Council business, you will see a public hearing coming up on an emergency ordinance
which provides that owner-occupied homes which are destroyed in industrial zones can be
reconstructed within a year without becoming subject to the 'requirements that non-
conforming uses be discontinued upon destruction. This is consistent with recent State
direction after the catastrophes of the Northridge earthquake. The State passed
legislation which gave an extension of time for reconstruction of homes which were
damaged and would have been non-coforming under normal circumstances.
A response to the Grand Jury report on the Bear Mountain Cogeneration Plant has been
prepared by Dolores Tuebner. I have looked it over and it is concise and to the point.
Although the report was generally complementary of our approval process, the Grand
Jury had some misunderstandings about it and those are corrected in the response.
F�cept for a few final details, the plant is essentially completed. We are waiting for the
landscaping to be installed and final measuresments be taken on noise emissions and air
pollutions.
9. A letter was received from the Southeast Neighborhood Association signed by Karen
Shah and sent to Mike Kelly, the Fire Chief. He forwarded it to us to see if we couldn't
do something to help implement a proposal by the committee which would setup five
cleanup crews to abate the weeds on vacant lots around the neighborhood. They had
requested some compensation for that as well as lunches and tools to work with. Our
City Attorney and Risk Manager advised that we should see if we couldn't get an
organization to work with them which carried the necessary liability insurance. Vernal
Jackson of the Senior Center offered to take that role and we are continuing to work
with him and Karen Shah towards getting the program on its feet. This will allow them
to be treated as would any other contractors.
10. John Stinson and I have reviewed the annexation process where there is some overlap
between the City Attorney's office and the City Manager's office. Apparently there is
some confusion in the City Attorney's office as to whose responsibility it is to prepare the
resolutions and administration reports �nalizing the tax split agreements. Generally, we
propose the City Manager's role be strengthened in the tax split negotiation and better
defined. The document preparation whould shift to Planning staff and be reviewed by
the City Attorney's offce. We will be meeting with the City Attorney in the near future
to finalize an agreement as to this new process and also expand our review to include
other departments as well so that we all have a clear understanding of our various
responsibilities in the annexation of territory.
11. Fred Jones, a property owner along the Kern River, contacted Frank Fabbri and asked if
he wouldn't coordinate a meeting of the various departments with him which would be
interested in discussing a land acquisition comprised of properties along both sides of the
river and the river bed. It somewhat intertwined with the new park we are building north
of Truxtun and west of Highway 99 along the river. It was generally agreed that we
would be working with Mr. Jones for a swap of his property from the north bank of the
Kern River south in trade for some improvements and permitting fees, however, in a
follow-up letter which we asked be presented to the ciry defining the proposal, Mr. Jones'

engineer, Jim Delmarter, removed the north bank and river bed properties from
discussion. At this point I will be contacting the department heads and suggesting that
this be processed as a standard land acquisition. Without the river bed and the north
bank, the trade is a lot less attractive although even the smaller part which involves the
park would be a good one to go forward on. I think in that case we would simply
conduct an appraisal and offer him fair market value for the land.
12. I have met with Kevin Barnes and Martha Haslebacher to discuss the coordination of
solid waste cleanup where often times the Solid Waste Division gets involved in issues of
trash in the alleyways and around dumpsters and trash cans. Generally our approach
would be to have the solid waste crew which notes the problem or the supervisor of the
crew initially contact the property owner to see if there isn't something we can do to help
them resolve the collection of trash. If they are uncooperative, then the matter would be
passed on to our code enforcement division and they would begin the official notices that
require people to maintain the property in a clean and sanitary condition.
13. Jake forwarded a request from the Bakersfield Symphony to hang banners on light
standards along Truxtun Avenue. I have responded that we would recommend that the
hanging of banners be coordinated with Public Works Department. I have talked to Ann
Bigler of the symphony and explained to her that our only concern would be that the
banners be hung correctly and not block traffic lights or directional signs or in any way
interfere with traffic.
14. Bill Kush called last week to arrange for another review of files concerning the sanitary
sewer disposal site west of Interstate 5 owned by Valley Communities. He is preparing
for a court appearance on August 22 concerning the Valley Communities' problems with
the Department of Fish and Game over the use of that property because there are some
endangered species alleged to be there.
15. There is a new Von's store opening in the old Builder's Emporium building at the
Mervyns shopping center on California Avenue. The Vice President of Von's called me
concerning a problem he is having with signage on the shopping center's freestanding
identification pole sign. Apparently, Von's and Glickman, the owner of the shopping
center, agreed to reconstruct that sign in accordance with current city ordinances and
Mervyns has been non-cooperative in that project. We have sent notices to Glickman
and to Mervyns informing them of the need to bring that sign into compliance with city
codes. We have given them until January 27, 1996, to replace the sign with one
conforming to the sign ordinance. In the meantime we will allow Von's to hang a
temporary sign on that structure identifying new store location.
16. We have had discussions with Jim Carstensen about developing a hockey practice rink in
Bakersfield. There was a recent newspaper story about it. We are awaiting a solid
proposal to review.
17. David Milazzo also met with me to discussion demolition of a couple buildings in
downtown to be replaced by a new office structure. One of the buildings is known to be
a URM building and the other is suspected by David as possibly being a URM building
so maybe he will be able to take advantage of our incentive which would allow them
come back up with a new building and receive credit for the existing structure.

18. Another project which is on track is the construction of a church on some R-2 properry
located at the southwest corner of Gosford and District Blvd. This properry was the
subject of some contention between the property owners, Castle and Cooke, and the
neighborhood because of the neighborhoods fear that apartments would be built in this
single family neighborhood. I believe the church should be an excellent use of this
property and certainly be a lot less concern to the neighborhood. Later they will be
requesting a Church zone so that they don't have to go through the special permit review
and approval with each adjustment to their development plan.
19. We have also reviewed a proposed U.S. Post Office, about 14,000 sq.ft. to be constructed
at Camino Media and Old River Road. As this is already Federally-owned property and
a Federal project, they are exempt from our requirements and permitting processes,
however, they did ask for our opinion and recommendations on how their project would
ft within the requirements of our codes and are apparently going to try to follow them.
20. Building permit to begin the shopping center at the southeast corner of Hageman and
Coffee Road has been issued. The initial construction was valued at about $810,000.
21. There has also been a permit issued for a sports and recreation center to be located at
the southeast corner Wible and White Lane. This would involve the demolition of some
older structures already on the premises. That's quite a large project - about 51,510
square feet with a valuation of $2,163,420.
22. Dennis, Stan and I will be interviewing candidates for the Business Manager's position in
my office on Tuesday, August 1. I expect that by late August, we will have someone on
board who can give me some much needed help in dealing with financial, budget and
office management issues that seem to be getting more and more complex.
23. I will be leaving for vacation during the weak of August 13 through the 19th to do some
college shopping with my son. Stan and Dennis will be here so things should be in good
hands. Stanley will represent me at the Urban Development Committee meeting
especially on the small lot subdivision topic. He was very much involved in all the debate
concerning small lot subdivision regulations.

Thank you for contacting my office regarding Assembly Bill 318
(Katz), relating to limiting the rates which municipalities
charge to operate public works projects for water and power. I
appreciate hearing from you. Currently, Assembly Bill 318 is
awaiting hearing in the Senate Local Government Committee.
I realize that the impact of this measure would be to reduce
revenues to municipalities operating water and power agencies.
However, I supported this measure because many of these
municipality agencies have been over charging their customers for
services and transferring the funds to other areas of the city
budget. Services should be funded by dedicated taxes and not
shifted from other funding areas. Any taxes or increases that
may be required for general fund purposes must put forth to the
consumers by a vote, as is current law.
Again, thank you for your views. Although this is one issue on
which we disagree, I hope you will continue to contact me with
future concerns.

Thank you for your correspondence expressing your opposition
to Assembly Bill 318 (Katz), which limits rates that my be
charged by a municipal water and power agency.
This measure recently passed the Assembly by a vote of 48-19.
When the bill reached the Senate, I requested that it be
referred to the Agriculture and Water Resources Committee for
hearing. As a result of my request, the Senate Rules Committee
has double-referred AB 318 to the Senate Local Government
Committee and to my committee.
Due to the tremendous amount of opposition to AB 318, Assemblyman
Katz has decided to make the bill a two-year bill, which means
the bill probably will not be taken up for a vote in the Local
Government Committee until next year. If the bill reaches the
Agriculture and Water Resources Committee, I certainly will take
your concerns into consideration.
