SUBJECT: GENERAL INFQRMATION
1. Staff is currently working on exchanging documents with the County relative
to the Fire Fund settlement, as well as the RFP for the consultant study.
We prepared a draft of the JPA revision, and it is in its second in-staff
rewrite. The County prepared the other documents, and we are in the
process of reviewing and revising those. It is a high priority and will be
pursued diligently.
2. Due to the need to coordinate issuance with the Kidder-Peabody deal for the
Hotel, we have probably slipped a week or two from what I previously told
you would be the likely date for pricing our bonds. We are now in the
vicinity of the 7th through 15th of February. Nonetheless, all of the
significant issues are coming to positive resolution. We have, by the way,
set up a meeting between the Trades Council, the contractor and the
developer for next week.
3. At your next Council Workshop, you will see a demonstration and sales pitch
on some technology that would be a great asset to the Police Department -
computer equipment and mobile data terminals. It is something which I was,
initially, reluctant to recommend based upon familiarity with old
technologies. But, having had a chance to view the new technology, I am
very supportive of the Department's request.
4. The Public Works Director applicants closed this week. The oral interviews
will be scheduled on the 18th of February, which would narrow the applicant
pool to three. Norm Roberts' efforts generated ten well qualified
applicants. His efforts will probably produce the vast majority of the
semi-finalists.
5. On a separate note, I am planning to proceed deliberately and cautiously on
the Fire Chief replacement. I think it may be four to six months before
"getting there." In the meanwhile, things will not be stagnant.
Improvements and changes are under way, daily. We will also be gathering
ideas for departmental improvements by bringing in another chief who has
familiarity in larger departments, and who has created management
develdpment programs, in order to provide the chief officers in the
department, and myself, wiih �nput. That will be at travel and living
expense only.

6. Whoops! I misinformed you last week on the specifics of the bond rating.
We did meet all our objectives on the new bonds with A ratings; however,
the ratings above A were clarifications on old issues. The detail is
enclosed in the form of a memorandum from Gregory Klimko.
7. The Public Works Department, and Councilmembe� Brunni, recently had a tour
with the railroad companies and PUC of bad rallroad crossings in the area.
I am told that the PUC people acted responsive and we may get some long-
term benefit out of the effort.
8. You will find enclosed information that our grant for Fire Station #2 has
moved through phase 2 of the process. It is now, apparently, on the
appropriation list waiting for State legislative action.
9. I am pleased to announce Florn Core is the new �at�r Resources Director,
replacing Gene Bogart.
10. Enclosed you will find a memorandum on the subject of pavement undulations
(speed bumps) coming out of the Public Works Department. Installation of
these is proposed for mid-March or Rpril. Please contact Ed, or myself, if
you have concerns about this information.
11. You will find enclosed a letter to Judy Skousen from Patrick Enright, who,
on behalf of our bond attorney, gave us a written opinion indicating that
our Hotel project is not within the province of prevailing wage law.
12. Enclosed is a memo from Jack Hardisty, indicating we are in the process of
re-initiating the annexations which have been frozen as a result of the
Fire Fund dispute.
13. You will find enclosed an update on the graffiti program.
14. Good news--our block grant has again increased by about $200,000 to a total
of $2.5 million.
15. Castle and Cooke came in for a prelimin�ry meeting on doing special
assessment district bonds for northwest and southwest area arterials, and
other public improvements. Nearly a$50 million dollar project, it would
be phased in several issue dates over a few year's time. They are willing
to meet all aur standards. It would add several needed transportation
links and would give them an edge on some of the � annexed west-end

SUBJECT: SELECTION/TRAINING OF POTENTIAL NEW EMPLOYEES

This morning Chief McCarthy and myself inet with Mr. Ray Soto, who
is the Fire Science Coordinator for Bakersfield Community College.
We discussed the concept of a training program which would be
coordinate�l between the Bakersfield Fire Department, Kern County
Fire Department, and Bakersfield Community College. This program
would afford an opportunity for interested individuals in the area
to pursue Firefighter I training. Currently, Firefighter I
training is given to individuals in a ten week academy who have
already been selected, off an eligibility list, and designated as
new employees. These ten week academies are only given when one of
the two fire departments have openings to till.
The program we discussed this morning would be an ongoing program
to establish an area Firefighter I level training program, which
has never been available in this area, but is very actively pursued
in the Los Angeles area. This program would be funded by
Bakersfield Community College.
The specifics of the program as far as instructor selection,
grading process, and generai course content would be decided upon
by the two fire departments and Bakersfield Community College.
Bakersfield Community College would also assume the responsibility
of assuring equal opportunity employment guidelines are given top
priority in the make up of each academy. It is conceivable within
the next year or two this academy process could go on throughout
the regular school year and provide a hiring pool for both fire
departments, as well as interested fire departments in the vicinity
who choose to take part in this program.
This process would be a no cost item for the City, and in the
future could very possibly be structured to provide additional
funding for auxiliary training purposes, such as accumulated
tuition fees being used for specialized classes for Chief Officers,
heavy rescue, hazardous materials, and emergency preparedness.

We are pleased to advise you that your project has been selected for inclusion in the grants list to be
submitted to the Department of Finance (DO�. As stated in the Earthquake Safety and Public
Buildings Rehabilitation Bond Act of 1990, this office is responsible for providing DOF with an
approved list of projects requesting grants. Once DOF approves the list, it will then be sent on to
the Governor for inclusion in the annual Budget Bill.
The Priority Ranking Committee met this past month to review over 170 Part-2 Qualification
applications submitted to the Division of the State Architect (DSA). Of this amount, 113
applicarions were approved for submission to DOF for possible grant funding.
We anticipate partial funds to be available in July 1994, or when the 199495 Budget Bill is
passed. In the immediate future, you will be contacted to confuYn your construction schedule.
Thereafter, you will receive a grant agreement that establishes mutual commitment, as required by
the Bond Act

Florn R. Core has been appointed to fill the vacant Water Resources Director position.
Florn will assume his new duties effective Monday, January 24th.
Florn is a Bakersfield native, graduating from Foothill High School and completing his
college degree from California State University, majoring in Earth Science with emphasis in
groundwater hydrology. Florn began his employment with the City in October of 1980 as Water
Superintendent and has been the Assistant Water Resources Director for the past eight years.
Florn and his wife, Sherry, have two daughters, Amy and Nicole. We congratulate Florn in
his new position!

SUBJECT: Pavement Undulations (Speed Bumps) Proposal
Attached is a copy of the Traffic Engineer's recommendation
for speed bump test locations on City streets. This includes a
test location within each ward.
I was hoping to have some of the speed bumps installed prior to the
end of 1993, but with the colder weather in November and December
it became necessary to delay the installation.
I would appreciate any comments or concems you and the
counciImembers may have regarding the list and the standard
being used.
The plan is to complete the installation of speed bumps
between mid-March and mid-April. Notice will be given to
homeowners in the vicinity of the installations prior to
proceeding.

Thank you for your letter of January 14, 1994 opining that the
prevailing wage provisions of the California Labor Code do not
apply to the Bakersfield Convention Center Hotel project.
As you know, trying to resolve that issue created one of the
principal impediments to finalizing the Disposition and Development
Agreement for the Hotel project. Needless to say, therefore, we
were more than pleased to have your opinion that the Labor Code
provisions did not apply to this project, and we appreciate the
�ime and thought that you put into the question. It is comforting
to have the concurrence of eminent bond counsel in aur own opinion,
and I have enclosed, as a matter of possible interest to you, our
January 10, 1994 opinion on the question.

I met with Bill Turpin regarding requirements for resubmittal of terminated annexation
cases to LA.FCO. According to LAFCO the following annexations that have been
terminated are: Hageman #l, Calloway #5, Brunhall #3, Rosedale #5 and Union #10.
Bill stated that, in an effort to save the city from xeroxin� documents, he could use some
of the materials previously submitted.
For Hageman #1, Brimhall #3, Rosedale #5 and Union #10 the following is required:
1. Certified copy of Resolution of Applicataon previously adopted by City
Council.
2. Copy of ordinance for prezoning.
3. Copy of environmental document.
4. Annexation maps and legal description (foaaa� copies each).
S. Annexation application fees.
F'or Calloway #5 the following is required:
1. The above, plus
2. Five copies of annexation maps and legal description.
City staff (Public Works, City Clerk and Planning) anticipate the resubmittal of the
applications on Tuesday, January 25. 1994. The City Attorney's office has not notified me
whether I need to resubmit Rosedale #5 and Union #10 annexations. However, staff will
continue gearing up to resubmit on Tuesday.

Per your request, I phoned each city within Kern County to determine: 1) The number of
cases each were processing, 2) How large the annexations were in acres, 3) What the
prezoning of the area was, if any, �) Is there a need for Sphere of Influence Amendment
or are they working on Sphere Amendment, 5) What environmental document is associated
with the annexation, 6) What is the tuning and 7) Proper�.y t� negotiation, if any.
Citv of Arvin: Howard Phillips
�'here is one at LAFCO encompassing 1,085 acres south of town. An EIR, prepared by
Quad Consultants, is the environmental document. A Sphege Amendment is associated with
the project. The prezoning of the area is R-1 and A�1 (Agriculture), however, the
agricultnre area has been designated on the General Plan for residential development.
Another annexation is being prepared for submittal to L�]FCO and will be done within two
months. This case encompasses three to four acres and the prezoning is R-1. A mitigated
vegative Declaration has been prepared.
Property tax negotiations have not begun, however, according to Mr. Phillips' conversations
with Adel Klein, of CAO office, since the annexation process has been proceeding for
several years, the property tax split will remain the same.
Citv of California Cit� June Sides
One annexation is in process encompassing 1,760 acres. The prezoning is being
recommended for R-A (Recreation-Agriculture). The annexation has not gone to the City
Council and it is anticipated that it mav be submitted to the Citv Council within the next

Deciaration was prepared. The city is not changing the county general pian designation nor

Citv of McFarland: Abbigail Bryden, Part-time City Plan�er
Processing one annexation with 5,700 acres. The annexation has a corresponding Sphere
of Influence Amendment. The annexat3on has not been prezoned and no prezoning
designations have been looked at yet. The site survey will be conducted within a week. 'I'he
property tax issue has been on the back burner, however, she would be interested in
meeting.
City of Shafter: Marilyn
No annexation cases are anticipated and not working on any.
Citv of Taft: Mary, Secretary and Dan Fissori, Planning �irector
One annexation is in process with 2,200 acres. A 1Vegative Declaration was prepared for
the project. No Sphere Amendment was needed. A Negative Declaration was adopted for
the project. The prezoning is R-1 and NR (Natural Resources). The site encompasses oil
production land. The application has not been submitted to LAFCO to date, however, it
is anticipated it will be submitted within one month. Da�a Fissori is interested in meeting
to discuss the property tax issue.
Citv of Tehacha�i: Darrell Daugnerty, Planning Director
No annexations to date, however, he anticipates 11% square miles may want to annex within
�he next ttvo vears. i-ie will be meeting �.vith Adel :�lein to discuss propertv tax. He is
interested in meeting to discuss the issue.
Citv of Wasco: Wallv Cairns
One annexation at LAFCO which is 1/2 an acre and is categorically exempt from CEQA.

1) The first 2 1/2 weeks of 1994 brought the Graffiti Office 197
calls over the hotline. I am happy to say that most of our work
orders we now process are for delivery of paint- not removal.
However, Bakersfield's parks & signal boxes keep our removal
staff very busy.
2) Louis, the Graffiti Office Volunteer, works 12 hours a week
processing work orders. I am trying to use my 10 hours per week
on program promotion and removal coordination in our no/low
income target areas.
3) I hear the Graffiti Work Order & Tracking System should be
delivered soon. The hardware & Prime software were installed
last week in the Graffiti Office. We will need additional
volunteers to input the data history. After the software is
online, data input should take about 6 weeks.
4) The Graffiti Informational Brochure is in draft mode and
should be complete by next week. This brochure informs the
public on our Graffiti Program, the Penal & Municipal Code,
Removal Tips and has a mail-in volunteer application.
5) The 2nd California Merchant Group Meeting will be held at the
Police Department next Thursday. Captain Matlock will be working
with the group to come up with remedies to stop area decline.
Thus far all merchants wishing to participate have received their
free paint and are keeping their buildings graffiti-free.
However, I have had to make several personal and phone contacts
to achieve cooperation from a few of the merchants.
6) I have completed a 94/95 Budget Wish List for the Graffiti
Program for Jan. we can win the war if we put money into the
battle and use the money in a comprehensive way.

7) I have been asked by Harland Hunter to make a brief
presentation next week at the Gang Task Force meeting at the
County Admin. Building regarding our City Graffiti Program.
8) Highland High has been diligently removing graffiti from
Chester and Mike Salazar's group has been keeping Baker Street
clean for us. South High wishes to sponsor more than their usual
shopping center. The Union Cemetery Paint-Out is now scheduled
for Saturday, February 19th. We have compiled a list of 85
citizens who are utilizing our free paint program to remove
graffiti in Bakersfield.
9) I met with Captain Matlock, Lt. Brown & the Bakersfield
Californian to assist with the generation of a Secret Witness
Suspect Info & Reward Hotline. The number is 322-1717 categories
7777 & 7778. I also have been working with Rachel Meek in Crime
Prevention to promote our graffiti program to her already
established Neighborhood Watch Block Captains.
10) Several individuals from Leadership Bakersfield have
contacted us regarding an annual Bakersfield Graffiti Clean-up
Day this Spring.
11) The Volunteer Center would like to refer court referred
community service folks to our program. However, there are many
legal issues that we must look at first. We must get together on
this.
12) And finally, Louis and I are making contact with and putting
a little pressure on other agencies to clean up their property
i.e. railroad, phone company, bus company and utility companies.
We are also sending graffiti letters to stubborn property owners
explaining Bakersfield's Municipal Code (most are non local
property owners).

at 6013 Fairfax Road City of Bakersfield Property Maintenance
Code 8.27.O10e states:
"It is unlawful and is declared a public nuisance for any
person owning, leasing, occupying or having charge or

property in such manner that any building exterior, wall,
fence, driveway, sidewalk, or walkway is so defaced as to

neighborhood."
To compZy with maintenance codes, you are required to abate the

noncompliance. However, we do have a free paint program and
would be happy to supply you with the paint for continuous quick
removal. The only way to effectively eliminate our city-wide
graffiti problem is the aggressive cooperation of all property

park site in northeast Bakersfield. I have consulted with Lee Anderson who feels the site is well
located and would be a good addition to our park system, and Ed Schulz who has told me that
the acquisition would not be disruptive to the sewer assessment district. It is located near the
future Chavez school and would be in a good location to serve the future neighborhood. Alan
Tandy has directed that we proceed with the acquisition process.
We now need Don Anderson's assistance. Would you please have him take over coordination of
the acquisition. I have explained to the Campbells that I was pleased they thought of ine as an
initial contact but Don would be the most appropriate person to work with in accomplishing this
donation.

SUBJECT: Disposal of Surplus Equipment - Refuse Trucks
In response to Council request regarding the process of reselling salvaged refuse trucks, and how
we determine the value and increase the value of surplus equipment, I am providing the following
information:
The sale of surplus equipmcnt is done as per the requirements of the Municipal Code, under
3.20.120. Items having a value of over four hundred dollars are sold at public auction or to
anather Governmental entity or non-profit organization.
It has been our experience that we do not recover the maximum amount by selling equipment
such as refuse trucks, construction equipment and fire fighting equipment at public auction.
There is the potential to recovcr more funds from the sale of surplus equipment by being more
innovative in the way we scil this equipment. We recently sold a refuse truck for $7,000.00 at
public auction, I later learned that truck was sold to a second buyer for $12,000 and a third buyer
for over $20,000.00. The maximum amount this truck sold for was done by a broker specializing
in refuse trucks. One of the cost saving ideas I recommended during our budget review in
January 1993 was that we need the tlexibility to dispose of surplus equipment by using a broker
who can find the best market for refuse trucks, construction equipment or fire equipment. I
understand this requires some type of amendment to the Municipal Code.
Another option was suggested by Assistant City Manager Gail Waiters. She has mentioned the
idea of joining an innovativc nationwide City group which would advertise our surplus equipment.
We may be able to sell so►ne equipment directly to another city without the use of a broker.
However, I have found that most cities, even smaller ones such as Delano, Taft, Wasco, etc., are
not interested in obsolete rear loading refuse trucks. Most of these cities have already recognized
the benefits of automated refuse collection and arc already fully automated.
There may be other creative methods of surplus equipment disposal such as using brokers, with
intemational contacts, that can market surplus equipment in South and Central America or even
overseas.
