A tour of the Holiday Inn' is planned for the Workshop next Wednesday. We ask that you meet in the parking area behind the Hotel at the contractor's office at 5:15 p.m. - enter on "Q" Street at 16th Street. 2. Castle & Cooke has submitted a site plan for a 345,000 square foot shopping center at the northwest corner of Haggin Oaks and Ming Avenue. That is far larger than. most "neighborhood centers." The land is appropriately zoned. 3. We are getting a "low cost" proposal to get an accurate stadium cost estimate. The "literature" has too broad of a range making it difficult to feel certain about a financial plan. We also believe the Symphony may have some interest in performances there, and are checking with them to verify this. 4. With ten days to go, no County firefighters have applied for the lateral transfer. 5. The December report from Del Smith, our Washington Representative, is enclosed. 6. Enclosed is a Status Report commenting on some of the latest issues in the Development Services Department. 7. We have received two letter of support for the Downtown Business District Zoning Ordinance. They are enclosed. 8. Enclosed is a status report on the tracking of expenditures for maintenance districts. These reports will be issued on a bi-monthly basis. 9. An update on the Coffee Road Separation of Grade project is enclosed from the Public Works Department. 10. Responses to Councilmember inquiries and referrals are enclosed regarding the proposed closure of Elm Street at 24th Street, debris at International Park, various street repairs, mud on Cosmo Street, Bella Drive and Morningside Court, and a pothole on Stine Road just south of White Lane. 11. My evaluation comes up in mid-February - the Council usually does it late - perhaps the first meeting in March. I will send some documents out at a later date. Bureau of Justice Assistance and the 'National Institute of Justice in_Washington to explore federal funding sources for the establishment of an in- p~ut facility -for the'Department to mitigate the high cost of using the County DEVELOPMENT SERVICES STATUS REPORT January 27, 1995 1. North of the River Recreation and Park District has sent a letter to the county seeking consideration of ordinances like the city's for acquisition and development of parks. With that we could include NOR in our funding system. 2. The Planning Commission committee has decided to recommend to the full Commission approval of the Kiosk Sign program. 3. I met with Terri Stoller, Peter Pankie, and Phil Ryall to discuss their concerns over incompatible developments near agriculture, industry and oil fields. Since this matter was referred to the Urban Development Committee I have started review of our policies for discussion. 4. Kern Canyon No. 1 was approved by LAFCO last Tuesday. No significant issues were raised. 5. I have an appointment with Supervisor Perez Friday afternoon to discuss anneXations pending in the Greenfield/Pumpkin Center area. 6. The report recommending a program to bridge the HTE and GIS programs has been submitted to Gail. It would be very helpful and more efficient if the two were linked. Initially, we hope to have Building, Planning and Public Works integrated. 7. The Building Division is drafting an ordinance to help them abate vehicles, etc. left in Unfenced rear yards which face homes across the street. I have asked for a better description of the problem and once there is a full explanation, I would suggest this be referred to committee. For a simple problem, it could get over blown. The primary example is a double fronted lot (runs through the block and fronts two streets) where the back fence is a cross fence with an area on the street side reserved for parking cars and equipment and for junk storage. This looks really shabby from the front yard across the street. 8. Marion Collins has filed an application to have concerts, 'swap meets, auctions and other "special events" at Mesa Matin. The application also covers a request for more buildings and seating. Depending on responses to our environmental noticing, it could be to the City Council by the March 22, 1995, meeting. 9. I will be meeting with John on Monday to discuss organizational changes in preparation for the budget. I am going to propose some shifting around to strenghten administration without a net increase in personnel. 10. Last Wednesday, Vergie Wittie cOmplained to the City Council that the building inspectors wouldn't do anything to beautify a slum house at 1822 Maple Street. To a certain extent, she is correct. Our funding and staffing is set at a level consistent with being able to cope with the most serious threats to health and safety. The inspector received a complaint about a leaky roof at that address. He inspected it and issued a correction notice. We do not take a request to inspect one item in a house as carte blanch authority to search it from foundation to stack for any and ali code violations. 11. We have received a flood of complaints and request from the Union 10 area to clean up the years of illegal accumulated junk. So here we are between the people who went along with annexation feeling that if they were in the city we could help clean up the neighborhood and those who would characterize us as storm troopers if we did. This is the kind of thing that I would like to review with Councilwoman Carson and the neighborhood. Initially, I'll see if Jake has anything in mind for the neighborhood when he returns Monday. 12. There is a church at Milham and Brundage (Union #10) with a raw sewage leak that we are working to correct. A city crew checked the line from our side and it appears the church's sewer line has collapses on its property. Rather than close down the church, we will suggest as an alternative that they clean up the mess they have, discontinue use of the toilets and have the problem corrected in two weeks while temporarily satisfying their requirement for toilets with porta-potts. Willie, C.D. Inspector, knows the pastor and said he'd work with him to get the line repaired. 13. Castle and Cooke came in Wednesday to discuss plans for a 340,000 sq.ft. shopping center between Camino Media Avenue and Ming Avenue west of Haggin Oaks Avenue. They said they would be applying for approval within a couple of weeks. Staff has already received several calls from residents in the area concerned about the quality of its development. This is the third report prepared which means we have been late on a'few reports. Expenditures were summarized from 7/1/94 to 12/11/94 (end of a pay period). This represents 44.93%. of the fiscal year. Approximately 41.30% ($635,012) of the maintenance district budget, after baelCmg out the applicable subsidies but excluding any adjustment for the net deficit, has been expended to date. Special mention should be made of accounting timing differences. These timing differences will exist at the close of each month. For instance, a December invoice may not be processed until JanUary. My business manager has indicated that the required cost calculations are much more streamlined under the consolidated method than under the separate district method. In fact, she has stated that the 1994-95 carryover/deficit cost calculations should take considerably less time than in prior years. We are still in the process of reviewing the project number system used for the districts. We are also in the middle of preparing the 1995/96 maintenance district budget calendar which will be forwarded to your office upOn completion. Due to other time constraints, I request that these reports be issued On a bi-monthly basis. Let me know if this does not meet with your approval. Kloepper, Assistant Public Worl~l~ire~ SUBJECT: Coffee Road Grade Separation Update An Entry Agreement has been obtained from Sunland that allows environmental and appraisal work to get underway. P G & E has permitted entry onto their property also. Kennedy-Jenks has completed their Phase 1 environmental assessment and will be authorized, probably January 26th, to proceed with Phase 2. This phase involves actual trenching and testing to evaluate potential hazards in the surface soils. Kennedy-Jenks will also prepare a mitigation plan if one is required. Phase 2 cost is about $28,000. Barakat and Chamberlain of Oakland, California are "experts" in valuation of refinery type facilities. They have been retained to perform appraisal services on the grade separation project. Their work is to be complete in 45 days. Deleuw, Cather & Co. have performed preliminary engineering work on the project under an $85,000 contract. The final design contract will be authorized soon and will be for about $360,000. It is expected that M & T - Agra will'be contracted to perform geotechnical engineering for the design project. Staff has received verbal information from the CalTrans Permit Office regarding the possibility of closing the Elm Street connection to 24th Street at State Route 178. WALKER, TRAFFIC ENGINEER ~ SUBJECT: UPDATE TO REQUEST FOR PROPOSED CLOSURE OF ELM STREET AT 24TH STREET (STATE ROUTE 178), COUNCIL REF. 14397 Since our last update, Traffic Engineering has received verbal information regarding the possibility of closing the Elm Street connection to 24th Street/SR178 from the CalTrans Permit Office. They have reviewed our information and indicated they would allow the street closure, subject to standard permit procedures of CalTrans, at the intersection. Since the proposal does not interfere with any State traffic signals or the operations of 24th Street/SR178, they consider this a local action and do not anticipate any problems. We will have to prepare standard construction type plans and submit them to CalTrans with a permit application when/if the project moves forward. We have information on the traffic usage of Elm Street, south of 24th/SR178. The traffic counts indicate about 300 cars per day use Elm Street. An average of 80 percent of the traffic is northbound to access 24th Street/SR178. The remaining 20 percent is southbound traffic coming off of 24th Street/SR178. The block has about 12 residences with frontage on Elm Street between 21st and 24th Streets. The residences'could normally be expected to generate about 120 vehicle trips per day. Since the counts are about three times what would be expected, drivers may be using 21st Street to Elm to 24th as a bypass to avoid the State traffic signal at 24th/SR178/Oak Street. Since west to south left turns are prohibited at the Elm Street intersection, Elm does not appear to be used as a bypass for southbound traffic avoiding the 24th/SR178/Oak Street intersection. We would expect most of the northbound traffic now on Elm to divert over one block to Beech Street, if Elm is closed at 24th/SR178. Damaged culvert at the N/E corner of "K" Street and 14th Street has been repaired. 3. Temporary repairs will be made to the broken curb at the N/E corner at Oregon Street and Union Avenue. It will be added to our 1995 concrete repair list and permanent repairs will be made within the next few months. 4. 2$th Street from "F" Street to Alder Street will be resurfaced in the Summer 1995. 5. Curb-Cuts will be installed at the N/W, S/W and S/E corner at 19th Street and Ceder Street in the spring of 1995. Temporary repairs will be made as soon as the weather clears. 6. The asphalt aprons adjacent to the Beale overpass bridge will be patched. Many of the streets were offered for dedication to the county prior to annexation, however, most were never accepted. Consequently, after annexation, many of these streets still do not show a record of dedication. That was a staff observation noted near Highway 178 one mile from the concert. }Vas staff prejudicial in scheduling the public hearing to consider compliance with the CUP? A memo has already been' distributed to the City Council responding to that question. It was not done to prejudice the hearing. In fact, it appears the time has .been used by Mr. Collins to achieve closer compliance. We try to spread' out the hearings so meetings are not overloaded. Is the sewer bond issue, relevant to the hearing on compliance with the CUP? Not in staff's opinion. }Vas the last request for approval to build an 1,800 sq. ft. building denied by the City Council because of the lack of compliance'with the existing CUP? Dear Dennis, i I am sure you usually only hear from building contractors when they have a complaint about your department or inspectors, bUt this is not the purpose of my letter. We recently had a mistake mad~ on a house we are building on McKee ~ Road, our foundation sub-contractor~made a mistake and the garage~ was poured smaller than it should have been. To correct our problem, we worked with Jack Highfill and Charles Lovell. Both men were very helpful in working out a Solution to ouy problem.
