As you probably read in the newspaper, the County, for the most Dart, refused to accommodate our request to reduce the jail booking fee increase. They did guarantee a flat fee, rather than having it be based purely on the number of bookings which, at least, puts a cap on the total. However, it is about $200,000 over what we paid last year. We had most of is budgeted. Separately, my meeting with Joel Heinrichs on the tax split was not conclusive, but it was a positive discussion and there Should be more information on that subject next week. I am still cautiously optimistic, that this situation may be resolvable now. 2. You may recall that about a year ago, a donut firm announced that it was going to Delano, when we thought that we had it. It is worth note that the firm still has not located there, as they ran into roadblocks which were unexpected, with the City, after their announcement. 3. I will miss part of the Budget Workshop on Wednesday, May 31st. The awards ceremony for my son's tennis team at BHS is taking place and I would like to attend that with him. Gail will fill in for me. A few weeks ago, you were copied with a letter from Community First Bank. A response to that letter is enclosed - it concerns the construction of the new downtown parking lot. 5. I am enclosing copies of the new booking Policy at the Convention Center. This is to recognize that our dates will be more fully taken by conventions and that we need to orient our facility to those events which cannot be held elsewhere, such as sports, theater and the like. It should help the revenue situation overall, as we have been giving preference to historical customers irrespective of size or revenue. This, at least based on the date of entering into reservations, gives preference to those larger events which can only be handled at the Center. Please call if you have any questions or concerns about this. 6. On June 14th, we plan to have on your Council Agenda a notice to the contract refuse haulers we utilize, that they have to go to automated, or semi-automated service. Our operating agreements with them allow us, after a test period, to give them that notice. Then, they have five years to convert-out their systems. There will be financial questions raised when we do give the notice, and we will enter into good faith negotiations with i HONORABLE MAYOR AND CITY COUNCIL May 26, 1995 Page -2- the haulers to address those concerns. Our tests, however, show that the automated system is much more cost effective and is more satisfactory to customers after implementation. There is also an equality of service issue involved as it is reasonable to believe that those citizens served by contract haulers have a lesser service than those on automated, due to the provision of containers and the greater cleanliness, etc. The conversion, due to the greenwaste container, is also necessary for our diversion goals. 7. Further research has shown that it may, in fact, be difficult legally to utilize the name of the Bakersfield Oilers for the hockey team. One of the previous ownership groups is threatening suit. The worst case scenario would be if we entered into the hockey season under one name and, due to litigation, had to change it in mid-year. It would seem better for all concerned, simply, to announce a new name early-on. It is the team's decision, but if you have the world's best idea, let me know and I will pass it on to them. 8. The County has been paying us $160,000 per year for use of the greenwaste facility by County residents. We have been doing research on how many County users there are, and what the costs are. That pilot program has been under charging the County. We notified them in a meeting this week that, in order to renew effective July 1st, they would need to pay more. The other option, should they not, is to only allow City property owners to use the facility and to charge County property owners who might be bringing in woodwaste/greenwaste. This item will, undoubtedly, generate more discussion in the not-too-distant future. 9. Status reports on the Coffee Road Separation of Grade project and the repair of 17th Street, west of Union Avenue, are enclosed. 10. The April status report from our Washington lobbyist is enclosed. 11. In response to a Councilmember inquiry, a map showing the current City and County fire station locations is enclosed. 12. An article from a Boulder, CO newspaper is enclosed on minor league baseball and the new stadium in Lake Elsinore. 13. Box 1559 Bakersfield, CA 93302-1559 Dear Ms. Williams: Thank you for your letter of April 28, 1995 regarding various issues involving the "K" Street Landscaping Project. The City of Bakersfield is sensitive to: the concerns expressed in your letter and wants to work with the bank to make the "K" Street project a success story of which we can all be proud. I would like to take a moment.~,to address the issues described in your letter. As you pointed out during the on-site meeting in November 1994, there was a problem with one of the irrigation circuits. The circuit had too many inSgation heads on it. The next day City employees "rerouted" the heads to another circuit. Following this adjustment the employees tested the system to ensure sufficient water pressure and there were no problems with volume or coverage at that time. The Parks Department has visited the site and noticed what appear be broken valves and maladjusted sprinklers. This could be contributing to some of the irrigation and soil erosion problems. Please note that these heads have to be manually adjusted from time to time to maintain proper coverage. As described in your letter, the City has also noticed some settlement since project completion. This soil erosion is most likely the result of the watering and rainfall. The City has noticed that soil erosion is more prevalent in some locations. Further on in this letter, I would like to discuss potential solutions to this problem with you. You mentioned in your letter that no watering wells or berms were placed around the trees. After checking with the appropriate City staff I was told that watering berms were placed around the trees, but not around the ground cover. I was also told that the City used soil amendments throughout the project. It is likely that the soil amendment has decomposed since the last City application. During a recent inspection of the site the City found that some of the Asiatic Jasmine ground cover has slightly uprooted. The ground cover was planted from flats containing seedlings which are normally very small upon purchase. Unfortunately, the ground cover was not planted during the prime growing season making it difficult for the seedings to establish. Until the ground cover is well established, it is very .easy to uproot the young plants. Cost being a factor, seedlings were purchased instead of one gallon containers. We currently are spending approximately two hours per week on the parking lot. Since we do not maintain a constant presence at this lot, we are sometimes unaware of vandalism or accidents to the irrigation system or the plants until the next week. Should you notice anything wrong please feel free to contact the Parks Department at 326-3117 so that we may make any required repairs. The 19th & K Partnership recently contacted me. Their landscaping has been subjected to vandalism. They are currently in the process of negotiating with a landscape maintainer to repair this damage and establish an on-going maintenance program for "K" Street. Regarding the general appearance of the "K" Sureet Landscape Project, the City adheres to a standard of landscaping design that anticipates plants to reach maturity in three to five years. As long as a reasonable level of maintenance is provided the plant materials should being to present their "show" within that time frame. This is done to allow for future growth of the plant materials. With respect to a potenfial'solufion, we would like to schedule an on-site meeting with you and Michael K. Brown to test the equipment and share with you our observations. Mter we have agreed to the cause and potential solutions of these problems the City is offering to replace the broken equipment and readjust the sprinklers. I trust this on-site visit will solve these "K" Street landscape problems and demonstrate our continued cooperation with all parties involved to make this a successful downtown improvement. John F. Wager, Jr. Economic Development Director cc Mayor Bob Price Bakersfield City Council Members Alan Tandy, City Manager. g~orgia.2 MEMORANDUM 17, 1995 /~/ SUBJECT: NEW cO~ENTION CENTER ~.V'ENT BOOKTNG POL'I'C¥ Due to an increasing demand for event space, a new event booking policy has been developed by the Convention Center staff to prioritize the events held in the facility. Currently, only three restrictions are placed on the booking policy; 1) conventions are given priority in the booking of dates more than one year in advance, 2) a three month or longer window is typically afforded to similar types of trade/exhibit shows that are open to the public, and 3) one week protection is given to concerts of the same type of music that are open to the public. A change in the policy for booking events at the Center will enable events to be held that appeal to a larger number of individuals, while not completely locking out events that attract a smaller, more select audience. Currently, larger events that may have been booked during a time period of nine to twelve months in advance are locked out of available dates, in particular weekends, due to the present policy. An example has occurred in recent weeks where a number of school dances and small dinner/dance events occupy both Friday and Saturday nights. These events have now become historical events with only 250-300 people in attendance, with gross revenues to the Center of, on average, less than $2,000.00. With the current policy in effect many of these smaller events, that could very easily relocate to other facilities in the Bakersfield area, will occupy dates that will preclude events that could only be held at the Convention Center. Precluded events over the past two and one half years include concerts, sporting events, trade shows and a number of theatrical productions. With regard to implementation, the proposed policy changes would begin immediately. Those events that have already been booked for the upcoming year would be allowed to remain on their selected dates. The new policy will be in effect for all available dates and will allow events that are being withdrawn, ample time to'find new facilities in which to hold their event. The proposed changes are as follows: First Priority events - Conventions, Exhibit/Trade shows, and Major Sporting Events Alan Tandy May 17, 1995 Page 2 Booking Period - 12 months or more in advance of the date. First Priority events will be afforded first choice on all dates more than one year in advance of the requested date(s). Conventions shall have priority over all dates more than one year in advance. Conventions shall have a minimum of 500 delegates. Exhibit/Trade shows will have a minimum of 50 booths. Major Sporting events shall have a projected minimum attendance of 2000. Deposits will not be accepted for events, except conventions, more than one year in advance. Second Priority events - Concerts (major tours drawing 1500 plus in attendance), Classical Arts (local or national productions drawing 1500 plus in attendance), Family Oriented Entertainment,Banquets of 1000+ or Religious Services drawing 1500 plus in attendance Booking Period - 6 months to 12 months in advance of the date. Second Priority events will be afforded first choice of available dates from 12 months to 6 months in advance of the requested date. Holds can be placed on dates more than 12 months in advance, however, the date can be bumped by first priority event requesting date(s) by filing a base rental deposit. Deposits will not be accepted more than 12 months in advance. Banquets of 1000+ will be charged an added fee of half the original rent if the number of participants drops below 750. Third Priority events - Dinner/Dances 750 & less, School Dances, Seminars, Wedding receptions, School Graduations and all other events not previously listed in the First and Second Priority event lists. Booking Period - 6 months and less in advance of the date. Third Priority events will be afforded first choice of available dates from 6 months in advance of the requested date. Holds can be placed on date(s) more than 6 months in advance, however, those dates are subject to being bumped by a higher priority event wanting the date(s) by filing a base rental deposit. Deposits will not be accepted more than 6 months in advance. By placing this new policy in affect, combined with preexisting conditions already used in booking the Convention Center, a wider variety of events that appeal to a larger portion of the community could be booked. This new policy would allow Second or Third Alan Tandy May 17, 1995 Page 3 Priority events to put holds on dates, thereby giving them the opportunity to hold their event in the Center. However, those organizations that feel compelled to confirm their event more than 6 months in advance will look toward other facilities within the City. At the same time, because smaller events will not dictate the course of the bookings, events that may otherwise bypass the City completely, will have a chance at being held at the Center. Additionally, a higher percentage of cost recovery will be enjoyed by the Center due to the fact that larger events which are open to the public have higher gross revenue potentials. I concur with Mr. Lozano's recommendation to fund this asphalt concrete overlay as a miscellaneous pavement project and perform the necessary work during the Fiscal Year 1995-96. LOZANO, PUBLIC WORKS OPERATIONS MANAGER DATE: MAY 19, 1995 SUBJECT: 17TH STREET WEST OF UNION AVENUE The section o.f 17th Street between Union Avenue and 'Q' Street is Portland cement concrete pavement probably built in the 1920's. It is one of the last sections of this type of street left in the City of Bakersfield. The street is in need of major maintenance work and is very rough riding. I have discussed this matter with Jack LaRochelle, Engineer IV, and we agree that this section of 17th Street needs an asphalt concrete overlay. Our recommendation is to fund this overlay as a miscellaneous pavement project and perform the necessary work during Fiscal Year 1995-96. Asphalt concrete overlays on Portland cement concrete pavement pose a special design challenge. I am told that our Engineering staff has experience with this type of situation and the design work could be performed this Summer. The bid process could happen this Winter with the actual work to be done during the Spring of 1996. Crime Bill Grants - Currently awards are being made under the Cops Ahead program by the Department of Justice. The Congress is preparing new legislation for more DOJ awards to municipalities and this office is monitoring those actions and influencing them to the benefit of the City. 3. EDA Grant-Department of Commerce - This office continues liaison With EDA and.with the Department of Commerce in Washington to:support grant consideration Of the' District level in Los Angeles to follow up on the arrangements originated by this office to seek a water treatment grant from that federal agency. (DeMond) Response: During the 1994/95 budget year the Public Works Operations Manager was given responsibility of coordinating all fuel-related issues for the City. He is currently working with the Fire Department in addressing these issues and coming up with a reasonable strategy that will accommodate the Fire Department's needs. A number of issues need to be addressed prior to a decision being made regarding placement and construction of fuel tanks, such as: · The cost/benefit of having additional city-owned fuel tanks, rather than accessing local gas stations or fuel distributors. · Determining whether above-ground or underground fuel tanks are the most acceptable and/or environmentally safe. · Identifying the potential liability factors. · Assessing whether to maintain the current locations or reassess their placement. Currently there are five located at fire stations #1, #3, #6, #9, #10, and one at the Corporation Yard. · In addition to the above-mentioned locations, the Fire Department has a 110 gallon fuel truck and the Equipment Division has one 500 gallon and one 200 gallon fuel trucks. The Administration overtime exceeded the Budget due to personnel shortages and the learning curve associated with the HTE computer conversion for the budgeting module. Suppression and Training exceeded their overtime because of employee shortages due mainly to extended sickleave, industrial injuries and vacant permanent positions. Page -2- May 24, 1995 Our academy is graduating May 26; this will add a total of fourteen (14) Firefighters to our Suppression force which should decrease our overtime in June. We estimate our total overtime to be $410,000 for the 1994-95 fiscal year in the Suppression Division. We experienced an unusual year in the number and longevity of injuries.. As a note, we have not had any significant overtime expenses for a large emergency this fiscal year. The 1994-95 Suppression overtime was for eleven fire stations. STINSON, ASSISTANT CITY MANAGER SUBJECT: RESPONSE TO BUDGET WORKSHOP QUESTION This memo is in response to the question regarding my responsibilities once the Human Resources Manager position is filled. The primary responsibility of the Human Resources Manager would be the day-to-day management and direction of the Human Resources Division. I would still oversee the general activities of the division and would continue to be involved directly in appeals of disciplinary matters, labor negotiations (we will have Management, General Supervisory, Fire and Miscellaneous negotiations within the next six months), overseeing the work of the health care consultant with the Joint City/Employee Insurance Con~ittee (provider renewals and retiree medical insurance which will involve meetings with retirees and union representatives), overseeing selection of outside consultants (City Physician and Police Psychologist are up for renewal - Request for Proposals, the selection process, interviews and contracts must be prepared). I will be involved in any serious personnel matters which may occur, particularly those which may involve potential litigation. I will perform other duties typical of,a department head overseeing a division such as personnel matters, budgeting and long-range planning. I would also continue my management and oversight of the Risk Management Division in a similar manner. This would include overseeing the transition to an outside claims administrator for worker's compensation. I also review claims settlement documents and will continue our efforts to provide better claims information to City management and the City Council. I am working with the City Attorney to improve communication and tracking of liability claims, particularly those which become litigated. This is to assess potential costs to the City and monitor our claims history for signnificant trends. In addition to these duties, I would continue to perform the following tasks within the City Manager's Office: · Council Committee Staffing I currently staff the Intergovernmental, Personnel, and Community Services Council Committees. This involves preparing agendas, coordination of department staffs on agenda items, and preparing minutes and reports resulting from committee meetings. · Permit Streamlining I continue to make sure the recommendations from the report are tracked regarding staff follow-up and implementation. This involves meeting with departments to make sure implementation and processing required Ordinance changes is occuring. Progress reports to Council are also my responsibility. It will involve meeting with the County and the preparation of the proposed agreement for a flat fee amount. · Property Tax Split I am working with other cities, and the County, reviewing the tax split figures and assisting you with negotiations. I am also negotiating tax splits for annexations in process with the County Administrative Office. This involves significant analysis and communication of budgetary and cost figures for all Kern County cities and the County. · Park Development Fees I am working with North Bakersfield Recreation and Park District regarding the issue of park development fees in newly developing areas. This will involve analysis and research with the Development Services and Community Services departments and discussions with the Recreation and Park District and Kern County to accomplish equity in the fee. · Human Resources Streamlining I am beginning this project to streamline the Human Resources Division to make it more responsive to City departments. This will require liason with department heads, unions, Civil Service Commissions, and a special committee. Recommended implementation will involve significant work with the City Attorney's Office to prepare appropriate revisions to memorandums of understanding, administrative rules and ordinance preparation. There will also be ongoing committee and Council communication. · Emergency Medical Care Advisory Board I am the appointed representative of the Kern County City Manager's Association on this County-wide board dealing with ambulance regulation and emergency response. This includes the involvement of Police and Fire personnel in emergency medical responses. · Intergovernmental Relations I continue to spend time working with other Kern County cities to develop good working relationships and to discuss common issues. This includes attending City Manager and Kern County Association of Cities meetings and performing analysis of current issues. Recently, I assisted the City of Delano in communicating the impacts of the tax split issue to their City Council. The date of this workshop has now been set for Monday, June 12 from 6:30PM to 9:30PM at the Richardson Center. We will be mailing invitations to numerous parties, while providing extra copies of the invitations to community organizations for distribution. In addition, a news release will be prepared to publicize the event to residents. We have invited the County of Kern to be a sponsor and are working closely with them in the division of duties to prepare for the workshop. Major funding for the workshop is provided from the San Joaquin Valley Unified Air Pollution Control District. Councilmember Carson and Supervisor Shell have agreed to provide welcoming remarks.
