I will be attending the American Public Works Association 1999 Congress and Exposition in Denver next Monday, Tuesday, and Wednesday, although I will be back for the Council meeting, on the 22nd. We will be presented with our national award for Centennial Garden at that session. Alan Christensen will be in charge during my absence. 2. At staff level, we believe that CSA 71 contract is done and ready to schedule for action before the Board of Supervisors and City Council in the near future. 3. Regarding the Grand Canal, staff has no information other than that we see in the media. There has been no contact with us in months. 4. Two arena football leagues are in an expansion mode. Ogden is working on it. 5. As an update on doing video broadcasting of Council meetings, we have approximately 75% of the video equipment in. Work has begun on the control room, and we are setting up and testing the equipment that has been received. At the last Council meeting in November, prior to the first live broadcast in December, we will plan to have a workshop before the meeting with a dry run through that night. We'll continue to keep you informed as to our schedule. 6. Staff was asked to provide an example of how property taxes are distributed between the City and County. As you can see from the charts, the County retains a larger share than the City when we annex an area and provide services. 7.Congratulations to Fire Chief Fraze - a memo is enclosed showing grant monies we are to receive for anti-terrorism equipment. 8. Stins~ssistant City Manager SUBJECT: Property Tax Distribution You requested that I provide a brief description of the property tax allocation for the City of Bakersfield and unincorporated county areas. Actual property tax distributions vary between individual tax area codes, however, the illustrations below show how the 1% General Property Tax levy is generally distributed between city and county when properties are annexed. I used a property tax code from the recent Palm-Olive annexation for this example. The charts show the largest portion of property taxes, 59% going to the schools and 11% to special districts. These do not change upon annexation. Before annexation the County received 21% for general government and 10% for fire purposes for a total to county government of 31%. When the area is annexed, the city receives about 8% (which represents 37.5% of the county's local government share) and the county local government share is reduced by that amount to 13%. In this example the County continues to provide fire protection so they continue to receive the Fire Fund. Therefore, in this case after annexation county government will receive a total of 23% of the property tax for this area. These figures reflect the 1% general local government property tax only and do not include any voter approved debt, special taxes, benefit assessments or service fees included on individual property tax bills. '.i_.~,,,,, FIRE DEPARTMENT MEMORANDUM Date: September 17, 1999 To: Alan Tandy, City Manager~ From: Ron Fraze, Fire Chief ///~'~ // Subject: Terrorism Grants The Bakersfield Metropolitan Area is one o fl 57 metropolitan areas that will receive Federal grants to enhance our Weapons of Mass Destruction "Terrorism" response capabilities. These grants are funded through the Department of Justice (DO J) and Department of Defense (DOD). The grants will assist local agencies in becoming properly equipped and trained to respond to incidents of domestic terrorism involving chemical and biological agents, as well as, radiologi'cal devices, explosives, and incendiary devices. The first grant is a $200,000 DOJ grant to be submitted by the County of Kern in September 1999. The second grant is a $125,000 DOJ grant to be submitted by the City of Bakersfield in October 2000. Both DOJ grants are specifically identified as First Responder Equipment Grants. In addition, a grant of $300,000 from the DOD can be submitted by the City between October 1999 and March 2000. This grant will be $40,000 for training and $260,000 for additional equipment. According to FBI's recommendation, a multi-agency task force has been formed and led by the Metropolitan Fire Chief which, in this case, is myself. The task force will prioritize the community's needs, minimize duplication, and provi~de an interagency capability to service the entire metropolitan area. Equipment needs will be prioritized from recommendations by fire, law enforcement, environmental services, environmental health, and emergency medical services. These grants do not involve a transfer of funds from the grantors to the grantees. Rather, the Task Force's shopping list is approved and purchased by the grantor. The equipment is then shipped to the County or the City. No matching funds are required. On September 1, 1999, Jim Eggert visited the site as children were going to Sandrini Elementary School. The property in question is a large parcel with a single family house that fronts on White Lane and Akers Road. There is no sidewalk along the street frontages of this parcel. There is a crossing guard who assists students crossing from the south side of White Lane to the north side. Students crossing the property at 4000 White Lane to get to Sandrini Elementary School could be prevented from doing so if the property owner wanted to place a fence along White Lane or along Akers Road. Council policy has been in the past to allow landscaping of median islands only when there is a method in place to pay for the maintenance of the landscaping. Usually, this method has consisted of a landscape maintenance district. All newly developing areas have as a condition of their development approval the requirement to form a maintenance district, and this district pays for the maintenance of the landscaped parkways and median islands in the newly developed area (BMC Chapter 13.04). A number of years ago, an analysis was conducted and it was determined that annual administrative costs to form, notify, and maintain even a very small maintenance district were about $1,000. As such, Council elected to allow landscaping of small areas (such as Gorrill Street) where annual maintenance costs did not exceed $1,000 without the requirement to form a maintenance district. There are many existing median islands throughout the City that are covered with asphalt and that have trees spaced at about 200' intervals. As funds have allowed, this asphalt covering has been replaced with other better-looking Iow-maintenance hardscape treatments such as concrete, river rock, or stamped concrete. This often occurs concurrently with an adjacent street construction project such as along California Avenue between Chester Avenue and Union Avenue. Currently the initial cost to install landscaping is about $3.50 per square foot, while the initial cost to install hardscaping is between $5 and $7 per square foot depending upon treatment. However, once installed, the annual on-going cost to maintain a square foot of hardscape is virtually zero, while the current annual on-going cost to maintain a square foot of landscaping is about $0.25. They proposed redevelopment, new residential and commercial development of an area in Southeast Bakersfield. The project proposal was conceptional and envisioned the use of existing canals and drainage features to create water elements around which neighborhoods would be developed. The intent was to present ideas that would be relevant to other areas in the State, but still appropriate for the selected study area. A copy of the map depicting Blackbirds submittal is being obtained but was not available to be submitted with this update. At the Hale Street intersection, a house is located on the north side of Filson Street and a vacant lot is located on the south side of Filson Street. Staff concluded that constructing an off-set cul-de- sac into the vacant lot to the south would be the least disruptive to the existing residences, and the right-of-way would most likely be less expensive to purchase. The cul-de-sac was designed and a legal description for the right-of-way was prepared that indicated about 400 square feet of area would be needed from vacant lot which has an area of about 6500 square feet. Since March of this year, the Pr6perty Management Division has been tracking down the seven title holder's who are located throughout the State who own varying interests in the lot. Only five of the seven owners have been located so far, and to date only three of these five have agreed and signed documents. It is hoped that the two other located property owners will sign shortly, but the City Attorney's Office opinion is that all seven must sign or the City may have some potential liability due to inverse condemnation. Last month, based on the difficulties in obtaining right-of-way from the vacant lot, the homeowner on the north side of the street was contacted regarding realigning the cul-de-sac to the north. Their residence is fairly close to the street, and they indicated that they did not sign the petition to cul-de- sac the street and had no interest in having the cul-de-sac offset to the north. Staff explored dead-ending the street without a cul-de-sac, but turning around large vehicles such as refuse trucks or emergency fire apparatus would be very difficult to impossible. Staff is continuing to pursue finding the remaining two owners and obtain all signatures for the right-of-way. The right-of-way could also be condemned and acquired through the condemnation process. Property taxes have not been paid for over 5 years and the City currently has two liens for weed abatement. Joan Schraff of Senator Costa office extended a personal invitation to me in order to insure my attendance at the August 2Th Bakersfield meeting. Additionally Ms. Schraff is looking to me for continued input on matters coming out of the Economic Development Committee (one of five planning committees working on summit topics). The next meeting for the Economic Development Committee had been scheduled for September 10th, but I was advised that it was canceled. At issue isthe ne,,',' downtown school and a possible closure of a portion of M street. Some points to be made if I may: 1) Our new downtown school is one of the best things that ever happened to Bakersfield. A friend in Pads remarked to me once that the singular most important requisite for maintaining the health and beauty of a city is to keep people living in its center. What we have here is a well designed and highly attractive replacement to a dreary, run down, part of the city. The school is well built and will be there to benefit from (and enjoy) for years to come. 2) Recent years have seen steady movement of the public sector into the city center, which has been followed by private interests, so that we now see an enormous payroll downtown. This means that young families are struggling to raise their children and work at the same time. Where? Downtown. Having the school handy is an enormous plus for them and their children. 3) The school, however, is not large enough. I guess we didn't see that coming, perhaps we should have, but we didn't. The school needs more land to expand and M street could provide it. In my view, the street should not only be closed but permanently removed from service and classrooms constructed on i~. i inspected the area and concluded that there are few, if any, businesses that would sustain a negative effect from such a closure. I suspect that the root of the problem lies with nearby highway 178 on and off ramps. It's sort of a high speed runway. 4) The Californian reported that some entities might sue the city if M street were closed. I have moved to Seven Oakes and drive up and down Ming Ave. each day. Today the Pruners were at Buena Vista and Grand Lakes chopping away! The Seven Oaks regular crew are doing a good job out here on the mowing and some pruning has gone on. We have told the crew.boss that we don't want the bushes cut short and they seem to be listening.---Now its fall and another group seem to be doing the radical pruning. Please Stop this!!! Earlier this year the crew came and raised the pine trees to the top of the wails in areas that didn't even get mowed around----we need the trees to be allowed foliage so that we will have reduced pollution.. The bushes fi.om Stockdale to Ming on Old River road need to be allowed to grow evenly. The pruners just keep cutting even though the bushes need to be allowed to be grow taller, The bushes on Ming from Old River Road to the Library look just beautiful now---but it is about this time last year that they were leveled to nothing but stubs---just before the Business Conference. I have been working on this site for over 2 1/2 years. It is currently owned by the State of California (Cai Trans) and it is one of their "retention basins." We noticed, 2 1/2 years ago, that this retention basin .appeared considerably larger than the volume of water that may need to be retained in it. So, we contacted Cai Trans and began a process of acquiring the front 1/2 of the retention basin (in order to buiid a Sonic on it) and to re-build the back 1/2 of the retention basin for Cai Trans. One of the interesting things is that, by charter, Cai Trans cannot deal with me, an individual, directly. They stated that they could only deal with "municipalities." So, this project has been funneled back and forth via the City of Bakersfield. Early on.. I had to sign a contract with the City of'Bakersfield that stated that the City of Bakersfield would not incur any costs for Sonic by being the "middleman." This was (and still is) a reasonable request. Additionally, even though this is Cai Trans' retention basin, they want the City of Bakersfield to · "maintain" this retention basin until the time that Cai Trans deeds all_of Rosedale Hwy. to the City of Bakersfield which they estimated to us would be approximately 7 years. Here is the issue. The City of Bakersfield wants me to post a letter of credit for $10,000.00 for the maintenance of this retention basin while the State owns it. I had my engineer, Mike Callagy at Cornerstone Engineering, call the City Maintenance Dept. to find out how much the annual expense would be to maintain a hole in the ground (retention basin). They told us approximately $400.00 annually. Why would I post a Letter of Credit, or any other vehicle, for $10,000.00 over a $400.00 annual bill that I will gladly pay? I contacted Richard Fanucchi at Mission Bank to determine how much a Letter of Credit would cost me. The tab?... $200.00 per year !! Now, I am not trying to be difficult or unreasonable, but this is ridiculous. I don't think I should expend 50% of a cost just to insure that the $400 bill will be paid. i mean my City of Bakersfield trash bill at each Sonic is over $4,000.00 per year and ! don't have to post a Letter of Credit, C.D. or lein for it. ! keep thinking, "just have the Maintenance Dept. bill me and I will pay it !! How simple can this be?" i mean this isn't a $20,000 street fight-of-way issue or something like that. Mike Callagy has contacted both Public Works and the City Attorney's office to see if we could eliminate this unreasonable requirement and' all they give back to us is another $10,000.00 option. The last one being a $10,000.00 lein against the property with the lien being in first position ! After I contacted Richard Fanucchi at Mission Bank, he too thougt this was ridiculous and he told me he WOuld contact'you on my behalf. And, here we are. What I would like to see happen is to have the $10,000 requirement waived completely and to have the Maintenance Dept. bill me annually. Where am I going? I have 5 Sonics in town. I have built the last 3 in 17 months. I have paid the City over $100,000.00 in fees alone in this timeframe. Plus, I just signed a contract to build another 5 Sonics in Kern County. SHELLABARGER RESIDENTS AND HOMEOWNERS PETITION This is a petition to open the west end of Shellabarger Road. The west end of our street has been closed because of a petition. Everyone thought it was going straight through to Jewetta. The housing track has 5 tums before we get to Jewetta and 3 turns before we can get to Palm. The housing track is very neighborhood friendly. It is a very good option. In case an emergency arises during the Calloway construction, or any other time, this would be the only other way out. We have had mishaps in the past causing our road to be closed to through traffic, where we couldn't get to the end of our street in either direction. We have waited for hours until P.G. and E. had the repairs completed. In an emergency the street will be closed until .the fire dept or other authorities feel it is safe. It does not matter to them what we say, we will not get through until they feel it's safe. When the road is torn up and repaved we will have another option. We could go .west and avoid all the construction completely. In two or more years when Shellabarger has access to a light at Slicker (formerly Art Street) and Calloway, it will be a very congested intersection. We will be sharing this with Palm and other neighborhoods. We will be forced to use this route to enter and exit Shellabarger, by the traffic light. Shellabarger Road will be a dead end street, at the east end. We will probably only have one lane for a left-hand turn, Slicker and Langley will also be adjoined at this intersection. Langley is a commercial area with many businesses, some businesses have many vehi_cles and equipment, that will be entering and exiting Calloway. We could avoid this intersection completely by using the west end of Shellabarger, especially during.the rash hours. By September, the Calloway Drive project will be complete.with six lanes from Rosedale Hwy to the railroad tracks. We will be living with this traffic for up to 2 years with only one way out.-THINK ABOUT CALL0WAY! Have you seen the new housing tracks being built tO the north and south? They would like the city to authorize the release to Mr. Gagosian and Mr. Clay Koerner all information regarding the city's benefit plans, claims information, premiums and renewal offerings. There are several concerns regarding this request. It is inappropriate for the city to utilize city letterhead and employee signature to authorize a private interest or enterprise to have access to confidential city information, absent authorization by the City Council. Such City Council authorization could only occur within an open and competitive process. To do otherwise could subject the City to legal challenge. The City currently has a contract with Buck Consulting to act on behalf of the City regarding health care consulting and contract renewals with health insurance vendors: The city has had a long standing policy and practice of using health care consultants rather than insurance brokers to assist with the review, marketing and renewal of city health plans. Council action to use consultants rather than brokers has been consistent since 1988. The City is not currently marketing its health plans, but is negotiating renewals with our existing vendors. Buck is currently in the process of obtaining information and negotiating with the City's health insurance providers for 2000 calendar year renewals. Having a third party involved in these negotiations would unnecessarily complicate and possibly delay an already complex and important process. Mr. Gagosian and his associates were given the opportunity to provide proposals when the existing city health plans were marketed and when the current health care consultant was selected. Their proposals were not selected at that time by the City Council. $:~JOHN~Co~n¢il Rct'erils\Couch~brokerl wpd There are also concerns regarding the appropriateness of providing such special access only to Mr. Gagosian and Mr. Koerner and not to other insurance brokers in the area who would also want such an opportunity. If the city were to only .give such access to Mr. Gagosian and Mr. Koerner the city could possibly be subject to legal challenge. The City marketed its health plans in 1998 and provided opportunities for all brokers to bid on city health plans. Based on the quotes received at that time the City Council determined it would be more cost effective to deal directly with the health insurance companies utilizing a consultant rather than use a broker. I am providing a copy of a letter from the City's health care consultant at that time, Herb Kaighan, which describes the role of the consultant versus use of a broker. The proposed letter also seems to imply unlimited access to city health insurance records. There are concerns regarding the privacy of medical information. Medical information on individuals covered by city health insurance plans is very sensitive and any right to access should be very clearly and legally described. I do not recommend providing Mr. Gagosian the requested letter for these reasons. The City has cooperated with and provided publically available information to Mr. Gagosian and Mr. Koerner in the past. Recently, information was provided at Councilmember Couch's request regarding the City's health plans. In reviewing a memorandum from Mr. Gagosian from the most recent referral from Councilmember Couch, it was determined that the monthly claims experience information requested was not complete. We have obtained the remaining information requested from our health care consultant. It should be noted that the format is somewhat different from that prepared by our previous consultant, however it should provide the requested information we have available. There is no claims experience available to the city for vision or mental health benefits as they are paid on a capitated (fee per person not claims) basis. cc. We were hired April, 1992~ City Council made its decision to use Aon Consulting-for this current marketing task for several reasons, not the least of which is our successful strategic approach in helping to guide City staff, the insurance committee, the personnel committee and City Council toward decisions that have been very. effective in managing benefit costs as well as maintaining employee satisfaction with the programs. The City Council agreed with the 1997 marketing strategyto allow for the realignment of retirees participation due to the changes implemented 7-1-96 and again announced in the open enrollment for an effective date of 1-1-97. Thus, an appropriate evaluation of risk can be made by competing vendors as well as the existing vendor. There are several reasons why an employer chooses to work with a consultant rather than a broker with regard to both obtaining employee benefit advice and/or performing certain tasks such as marketing the coverages: · A consultant is objective in that its compensation is derived from agreed upon fees paid directly by the City,. A broker receives compensation from commissions paid by a vendor with whom coverage is placed. This is usually based on a percentage of premium. The rates determined by the underwriting vendor would take into account this financial liability. Rates developed through the consultant would be net of commissions and therefore lower than those developed by a broker. In addition, some brokers have override commission agreements with certain vendors which are not disclosed and could influence the evaluation performed by the broker and the final recommendations. · A consultant has full access to the entire marketplace. Therefore, a consultant is able to receive competitive proposals from all vendors qualified to submit one. · When an employer uses a single consultant to perform the marketing tasks, unitbrm benefit specifications are submitted to the market place and a single source of-evaluation and analysis produces an objective "apples to apples" comparison of vendor proposals. · When dealing with a consultant such as Aon, the City is taking advantage of size and leverage, both locally and nationallv. Aon Consulting is the fourth largest consulting firm in the United States and one of three largest Health and Welfare practices in Cali/brnia. We are responsible tbr placing a tremendous volume of business with vendors and theretbre are able to develop very cost competitive .proposals as well as demand the best vendor service teams. The benefit analysts are all senior underwriters from insurance companies and have been trained to understand plan design .and benefits pricing. · The fee paid to a consultant for the marketing task is a one time fee. Commissions paid to a broker are 'included in the rates and are paid annually. · The continued use of Aon is based on a track record of expertise and satisfactory performance. · lfCity Council were to use a broker as a possibl~'altemative it would need to determine the process of selection, both locally and non-locally, which could become very. political. The purpose of the last personnel Committee meeting was to review and approve the Request for Proposal. the list of carriers and the marketing timetable which had already been approved by City staff and the insurance committee. The decision concerning who would perform those tasks had been decided by City Council over nine months ago. Based on the City's desire to do a due diligence competitive bidding of its programs and the possibility that one or more of these programs will be replaced with another vendor, it is essential that the timetable be adhered to. Prior to' hiring Aon Consulting, the. City. had consistently experienced the chaotic results of last minute renewal negotiations and new vendor implementation. The next level of activity aimed at the continued improvement of the larger downtown area is the recruitment of complementary uses. The addition of synergistic enterprises such as food, specialty retail, and entertainment would enhance existing businesses and complement the success that the arena has brought to the downtown area. Other cities with similar facilities have found that such recruitment further energizes the downtown area. Economic Development staff have spoken with a number of firms experienced in providing such services. Based on cost considerations and demonstrated experience, staff recommends GRC Associates, Inc. (GRC). GRC has provided economic consulting services to cities and redevelopment agencies for over 15 years and currently is.providing housing consulting services to the CDDA. With the experience learned from hundreds of commercial projects, GRC has assisted over 50 cities in identifying and locating businesses, including many restaurants and retail shopping. '1501 Truxtun Avenue Bakersfield, CA 93301 Dear Councilman Couch: I am writing to you in regards to our recent conservation about the traffic situation at the intersection of Scarlet Oak Boulevard and Ming Avenue. As you are aware, this is a very busy intersection. Over the last several years, the traffic has steadily increased due to the opening of "The Marketplace" shopping center, the development of the area around the Seven Oaks Golf Course, the opening of the bridge over the Kern River on Old River Road which allows easy access to the southwest and northwest areas of Bakersfield, and the large employers, etc. such as Castle and Cook, Aera Energy, Mercy Southwest Medical Complex, State Farm Insurance, and CSUB which are all in the immediate vicinity of this intersection. As a result of the increased volume of traffic which passes through this intersection, I have personally witnessed several near misses (accidents). I use this intersection every day to go to my job at CSUB. I have great difficulty trying to cross Ming Avenue from Scarlet Oak Boulevard due to speeding motorists, all of the traffic that the aforementioned employers create, pleasure traffic; non signaling motorists, and people trying to either cross the intersection or make left: tums against very heavy traffic on Ming Avenue. Also, in a conversation with one of my neighbors, they informed me that the man of the house and one of his small children were nearly involved in a serious accident at this intersection due to several speeding teenagers. The other evening, my wife and I, canvassed the neighborhood to seek out our neighbor's input about the situation that exists at the intersection of Scarlet Oak Boulevard and Ming Avenue. Overwhelmingly, they voiced their concern that something should be done to make for a safer traffic situation at the aforementioned intersection. It is my understanding that this intersection is currently in the number six posiiion of priority to receive a traffic signal. However, I also understand that it could be at least anywhere from six months to a year before there is funding to have traffic signals installed. Also, we are aware that this priority rating could slip due to available funding and/or other intersections moving up on the priority list, which is due to the rapid development of the southwest side of Bakersfield and other traffic situations that exist in other parts of metropolitan Bakersfield. We, on the attached petition, believe that there is an immediate need .for traffic signal lights at the intersection of Scarlet Oak Boulevard and Ming Avenue. However, in lieu of the immediate installation of traffic signal lights at the subject intersection, we would be willing to accept the immediate installation of stop signs on Ming Avenue, in effect making this a "Four Way Stop" intersection. The acceptance of a "four way stop" at this intersection would be only a "temporary" solution to the traffic situation at this particular intersection. The City of Bakersfield, Traffic Engineering Department should at the earliest possible opportunity install traffic signal lights at the Scarlet Oak Boulevard and Ming Avenue intersection. During the past ~ year or so we have had several telephone conversations with Mrs. Cody regarding the pruning of our landscape areas in the city in which she has given us her ideas as to the best methods in which to prune our trees and shrubs. This department has taken her : concerns into consideration. i' We are trying to create, balance between our need to provide responsible maintenance for our plant material which includes trees, shrubs, flowers and other landscape materials with the available resources we have. In the past year, we have been evaluating our maintenance practices throughout the city and through this process have developed a maintenance standards handbook. These standards should address the concerns of Mrs. Cody. Staff has spoken with Mrs. Cody to address her concerns and explain what maintenance practices we have changed in the past year due to her suggestions. We will take her written suggestions under consideration. We have informed her of our written maintenance standards manual that has just been completed which should give her a better understanding of our maintenance practices. Staff will stay in contact with Mrs. Cody in an effort to keep her informed of any new standards and also deal with any future concerns before they develop into issues. The west end of our street has been closed because of a petition. Everyone thought it was going straight through to Jewetta. The housing track has 5 turns before we get to Jewetta and 3 turns before we can get to Palm. The housing track is very neighborhood friendly. It is a very good option. In case an emergency arises during the Calloway cc~nstruction, or any other time, this would be the only other way out. · We have had mishaps in the past causing our road to be closed to through traffic, where we couldn't get to the end of our street in either direct/on. We have waited for hours until P.G. and E. had the repairs completed. In an emergency the street will be closed until the fire dept or other authorities feel it is safe. It does not matter to them what we say, we will not get through until they feel it's safe. When the road is torn up and repaved we will have another option. We could go west and avoid all the construction completely. In two or more years when Shellabarger has access to a light at Slicker (formerly Art Street) and Calloway, it will be a very congested intersection. We will be sharing this with Palm and other neighborhoods. We w/II be forced to use this route to 'enter and exit Shellabarger, by the traffic light. Shellabarger Road will be a dead end street, at the east end. We will probably 0nly have one lane for a le~-hand mm, Slicker and Langley will also be 'adjo/ned at this intersection. Langley is a commercial area with many businesses, some businesses have many vehicles and equipment, that will be entering and exiting Calloway. We could avoid this intersection completely by using the west end of Shellabarger, especially d,,,'ing the rush hours. -' By September, the Calloway Drive project will be complete.with six lanes from Rosedale Hwy to the'railroad tracks. We will be living with this traffic for up to 2 years with only one way out.' THINK'ABOUT CALL0WAY! Have you seen the new housing tracks being built to the north and south? Its is really growing out here in Rosedale and so is the traffic. We must have another way to enter and exit safely. Our only option will be to open the west end of Shellabarger. Descary, City Treasurer DATE: September 16, 1999 SUBJECT: CITY INVESTMENTS This is in response to a referral from Councilmember Couch to address the amount of City investment monies which have been placed with local banks and brokerage firms. Six banks responded to our survey indicating an interest in having City deposits: Bank of America California Federal Bank Mission Bank San Joaquin Bank Sanwa Bank California Union Bank of California On July 8, 1999 these banks were asked to quote rates on deposits of $100,000 and $1,000,000 for a term of one year. One bank quoted 4.70% on $100,000 only. Two quoted 4.75 % on either amount. One quoted 4.80% and 5.05% respectively. Another bank quoted 5.25% on either amount, and lastly, one quoted 5.45% on either amount. These rates were compared to 5.12% at the Local Agency Investment Fund (LAIF) and the one year Treasury Bill yielding 5.04%. The high quote was from Mission Bank which is a new bank that began operating in October 1998. The Finance Director and I determined that depositing public funds in a new bank that had not reported a profit would not be prudent. A deposit of $1 million for a one year term at a rate of 5.25% was made at the local branch (5201 California Avenue) of Sanwa Bank California. On September 17, 1999 a $1 million certificate of deposit matures at Washington Mutual Bank. Local banks will be surveyed again for rate comparisons. Investment orders have not been placed with local brokers for two reasons. First, in order for me to execute my public funds fiduciary responsibility, the City needs to have a custody/safekeeping agreement with a bank trust department to keep proper records of these transactions and ensure transactions are settled on a delivery versus payment basis. Second, based on cash flow and the current interest rate environment, there has been limited need for broker investments (bankers acceptances, commercial paper, treasurys and agencies). In July we did four agency investments, two with Bank of America and two with Union Bank. We did no such investments in August and none are anticipated in September and October. Cash needs are satisfied by daily revenue collection and LAIF withdrawals. In fact, the next agency investment matures in January 2000. I mention this activity only to point out that typically our investment transaction volume is not large this time of year, and local brokers should not expect a large volume of City transactions. With regard to a custody/safekeeping agreement, a request for proposal (RFP) was prepared and sent to ten banks that provide this service. Five responded by the August 27, 1999 deadline. These RFP's are being evaluated. Initial indication is that custody/safekeeping will cost $6,000 annually. Under current investment procedures this service is included at no charge. I met with Kyle Carter and his engineer, Harold Robertson on Wednesday September 15, 1999, at 8:30am to discuss the project. Mr. Carter is still pursuing his options regarding the project. Through conversations he has had with Ralph Huey and the concerned chemical and oil refining companies there appears to be a discrepancy regarding the appropriate safe zone. Mr Carter has scheduled a meeting with industry representatives, City and County Fire Marshals to discuss the issue and seek resolution. The meeting will take place at his office on September 30, 1999, at 8:30am. I will be attending that meeting. The scoping session for the EIR was continued to October 7, 1999. There is a strong desire to resolve this matter by October 7, 1999.
