SUBJECT: GENERAL INFORMATION
1. Fire Chief Kelly has promoted Assistant Chief Fraze to the Deputy Chief position.
2. As noted in the enclosed memo from EDCD, we have been advised that two
homeless service providers, Clinica Sierra Vista and National Human Service
Coalition, have formally stated their interest in the Federal Building at 800 Truxtun.
Both agencies have until the last week in July to submit their full applications to the
federal government. We will keep you informed as we get more information.
3. The latest report from the County Environmental Health Services Department on the
LEA's regulated projects within the city is enclosed.
4. Responses to questions posed at the budget workshop sessions are enclosed.
5. The County has notified CalTrans that they wish to withdraw their funding request
for the 7th Standard Road Overpass project until FY 1997-98. They have also
indicated they would like to proceed with the Calloway Drive Underpass on the basis
of a partial allocation of State funds in 1996-97, with a balancing allocation from the
1997-98 budget. Their letter is enclosed.
6. Responses to Council referrals are enclosed as follows:
· Police Department to investigate the feasibility of implementing an alternative
number to the 911 emergency system
· An update on the conditions at Tevis Park;
· Response to a constituent regarding use of Destec and other recreation funds.

7. PG&E will be doing a project this summer that will encompass the area between
Truxtun Avenue, 24th, Elm, and P Streets. It will include an area on Truxtun between
A and I Streets that GST has agreed to repave. We do not want GST to repave that
area and then have PG&E come in afterwards and pothole and patch it, so GST will
not commence repaving Truxtun until PG&E completes their work. A memo from
Public Works is enclosed.
8. I will be taking some vacation time June 4th, 5th, and 6th. During my absence, Gail
Waiters will be in charge.

In a telephone conversation held this morning with Rhonda Rance, GSA Realty Specialist, I was
advised that two homeless service providers have formally stated their interest for the use of the
Federal Building (800 Tmxtun avenue). The two organizations are:
1) Clinica Sierra Vista, Bakersfield, Califomia
2) National Humafi Service Coalition, San Francisco, California
Ms. Rance advised me that Clinica Sierra Vista has until July 23, 1997 to submit a full application
to the federal government and that National Human Service Coalition has until July 24, 1997.
Shortly after receiving this information I was able to contact Steve Schilling, the executive director
of Clinica Sierra Vista. Mr. Schilling confirmed Clinica's interest in the building. He indicated that -
at the present time Clinica intends to use the ground floor for a community clinic while the second
and third floor would be used for a variety of community services and administrative functions.
With respect to the second organization, after placing numerous phone calls to San Francisco,
Sacramento, and Los Angeles, I was finally able to obtain the name of the organization's chairman
and a phone number. I left a message on an answering machine and I am waiting for a remm call..
I will continue to monitor this situation and apprise you of any additional information.

Subject: Fiscal Year 1997-98 Budget Workshop Questions/Responses
The following are answers to the questions pbsed by the City Council during budget workshop
sessions on May 20.
2. Provide a cost estimate.for the operating and capital costs associated with developing a
new .fire station.
The projected amount to establish a temporary fire station, excluding personnel, is
$481,000. (This includes a new pumper.) The t6tal annual operating cost is
approximately $900,000. This includes a personnel expenditure of $830,000 for
nine (9) personnel. The construction of a new permanent station is projected at
$1,205,000. This amount includes an expenditure of $70,000 for land. There will
not be a cost for the land to build a permanent station in the vicinity of White Lane
and Allen Road.
3. Provide a list of which schools chose not to participate in the fire department's Adopt-A-
School program attd why.

4. Provide an update on the status qf developing a dunior Firefightetxs' Program.
This morning I met with Mr. Charles West from Bakersfield College to discuss the
Summer Youth Employment and Training Program. This summer the fire
department will be provided with four students between the ages of 17 and 21 who
will be attending Bakersfield College or are currently enrolled at Bakersfield
College.

The students will work a 40-hour week throughout the summer with limited
classroom time at Bakersfield College during the summer school session. There
will be no cost to the City while these students are involved in this training session.
Bakersfield College will pay their insurance, transportation if necessary, books,
materials, and will also pay the students minimum wage.
Mr. West indicated that he will be actively involved in selecting the students and
will consider both gender and ethnicity. Our goal will be to heighten the students
interest in the fire service as a career and help identify the necessary career path.

Subject: Adopt-A-School Prog~'am
When the fire department initially selected th~ schools for the Adopt-A-School Pilot Program, the
reluctance expressed by some schools was based on a concern o~' available time and workload in
regard to their existing Curriculum. I am not positive, but I believe the schools that expressed
reluctance in adopting this program were not in your Council ward.
We have modified the Adopt-~A-School Program slightly to be more in line with the."Learn
Bum" Program which was developed by the National Fire Protection Association (NFPA).
program recently was endorsed to be adopted in all Kern .County schOols. By adjusting our
program to conform with the program that has been adopted as part of every school's curriCulum~
I do not anticipate any schools will be reluctant to participate.

The following is in response to City Council questions from the Water Resources Depamnent budget
hearing on Monday, May 19, 1997:
Question (Listed under "Water"//6 in May 19, 1997 Memo): Investigate possible types of evergreen
shrubs/trees that could be used along the fencing on Truxtun Avenue, with input from the Kern River
Parkway Committee. (McDermott)
Response: As part of the landscape plan that occurred at the new water well site along Truxtun Ave., the
parkway volunteers planted native trees and shrubs and sixteen evergreen live oak trees. The Kern River
Parkway volunteer group has indicated that they have scheduled to plant an additional twenty "Toyon"
evergreen tree/shrubs along the canal fence located south of Tmxtun Avenue. This landscaping design is
similar to the Cal-Trans scheme used on the local freeway system. These additional shrubs and the
irrigation system will be added in the fall of this year.
Question (Listed under "Water"//7 in May 19, 1997 Memo): Provide a listing of repairs needed to the
fencing along the canal on Seventh Street behind McKinley School and when it will be funded. (Carson)
Response: This canal section between 4th and 10th Street is part of the Kern Island Canal system and
owned by Kern Delta Water District. In cooperation with Kern Delta WD, the City has a 5-year plan to
replace mn-down or dilapidated fencing throughout the City. As part of this on-going program the
following intersections and street locations have had replaced or repaired fencing installed since the fall
of 1995:
California Avenue at the Kern Island canal crossing (north and south sides)
"Q" St. from California to 10TM St. (west bank)
10th Street (north and south sides of the intersection)
8th Street (north and south sides of the intersection)
7th Street at canal crossing (at end of street)
6th Street (north and south sides of the intersection)
4th Street (north side at Bakersfield Senior Center)
4th Street (south side) at McKinley School
Brundage Lane at south end of school grounds
Additional fence work will be completed in this area over the next two year period.

SUBJECT: CANAL FENCING
Approximately ten years ago the City of Bakersfield sued Kern Delta Water District,
among others, in an attempt to force these water districts to fence their canals running
through the urban areas of the City of Bakersfield. Alan Daniel of the City Attorney's office
handled the suit. The canal companies defended the suit on the grounds they were a state
agency and the City of Bakersfield could not force them to fence their property. The canal
companies had cases concerning school districts where local entities had been
unsuccessful in attempting to get the school districts to fence their property in order to
protect the children on the school grounds from mishaps with automobiles, et seq.
A summary judgment motion was brought by the canal companies in the Kern
County Superior Court and the judge granted the motion and dismissed the City's suit.
The City of Bakersfield filed an appeal and the Fifth District Court of Appeals again ruled
against the City of Bakersfield stating that the City could not force the canal companies to
fence the canals because they were an agency of the State of California. It was as if the
City of Bakersfield was trying to tell the State of California what to do with its property.
Thereafter, the City .ceased in its attempts to force the canal companies to fence their
canals. ~

The following information is provided in response to questions of the CitY Council during
the May 19, 1997, Budget Workshop.
Question #~ - Provide original construction completion date for Colombo Construction
to finish the new police building wing and progress report on the actual completion date

The original completion date for Colombo Construction is May 23, 1997. A "substantial
completion walk through" was completed and signed off by the architect today. The
City Building Department is scheduled to conduct the final inspection on May 23, 1997,
however contractors will be on site through June 9, 1997 to complete minor finish work
and cleanup.
Question #2 - Detail the Department's program to train officers in handling domestic
violence calls and what partnerships the Police have with outside domestic violence
agencies. (DeMond)
Officers receive on-going training in the area of domestic violence. Informal training is
provided through briefing presentations; and formal training through state mandated
Advanced Officer Training courses. In order to facilitate this effort, the department has
collaborated and signed a Memorandum of Understanding with the Alliance Against
Family Violence and Sexual Assault, who will provide crisis intervention support and
assistance with training and education. A copy of the MOU is attached.
Question #3 - Provide a summary of the plan for retiring and replacing dogs used in the
Canine Program and what funding source will be used. (DeMond)
There are currently three basic criteria which are used to determine when a dog is
ready for retirement. They are age of the dog, abilitY to carry out its function as a police

dog and the overall health of the dog based on the recommendation of the veterinarian,
handler and trainer. The approximate working life of a police dog is five to eight years,
with tho dogs being put into service between two and three years of age.
The last dog to retire, in July 1996, was Donja who is a cross trained Malinois/German
Shepherd mix. Since Donja's retirement the department has functioned with six
canines which has thus far been sufficient.
The next dog to retire is Blesk, who could be retired as early as July, 1997. Blesk will
be replaced with a new cross-trained canine.
Historically, the Canine Program has been funded through Asset Forfeiture monies.

Dear Mr. Elcock:
Pursuant to a Board of Supervisor's order on May 20, 1997, Kern County respectfully wishes to withdraw our ·request for ·
allocation for the 7th Standard Road Overhead Project under the State Grade Separation Program for the 1996-97 fiscal
year. Please retain all submitted materials under my cover letter of April 1, 1997, since it is our intent to request funds
from the 1997-98 fiscal year for this project.
It is now our understanding that the Cailoway Drive Underpass at the BNSF, No. 18 on the PUC priority list, will be
eligible for a partial allocation from the 1996-97 State budget in the amount of $2,896,608.71. A balancing allocation of
$1,231,391.29 ~vould then be anticipated from the 1997-98 State budget. It is our desire to proceed ~vith the Cailoway
Drive project on this basis.

Subject: 911 Emergency System Alternative (Council Referral WF0013350)
During the Council Meeting of May 7, 1997, Council Member Sullivan requested the
police department to investigate the feasibility of implementing an alternative number to
relieve the overburdened 911 emergency system.
Background:
Since its creation in 1968, the 9-1-1 emergency telephone system has operated
successfully. However, as reported by the Department of Justice "the system is in
trouble in many parts of the country because of excessive non-emergency use". Police
departments everywhere are reporting growing demands on officers to respond to all
9-1-1 reports, including those that are non-emergencies. In an effort to address this
critical issue, a pilot project initiated in Baltimore, Maryland in 1996, introduced a 3-1-1
non-emergency number and an aggressive public education campaign urging citizens
to utilize this three digit system for non-emergency calls. In order to expand the use of
the 3-1-1 system, Attorney General Janet Reno and other national leaders assisted the
law enforcement community in securing the 3-1-1 system with the Federal
Communications Commission. As recent as last week, the FCC had authorized 3-1-1
as a national number for non-emergency police services.
Status:
While 3-1-1 non-emergency number systems offer one alternative to the overburdened
9-1-1- system, implementation of the system will require considerable research and
analysis. Communications personnel in our department will explore the various issues
affecting implementation of 3-1-1 within our system. These issues include:

1. Cost - It will be important for us to determine costs for additional equipment
and/or costs for conversion of existing communications systems.
2. ~ - It would appear that for the 3-1-1 system to be effective county
wide application would be most desirable. During our research efforts, we will
evaluate these options for application.
3. Results of the Baltimore, Maryland study - Before a determination is made to
implement 3-1-1, it will be advantageous for our staff to evaluate the pilot project
in Baltimore, Maryland. We should be able to better analyze costs, impact on
call volume and officers time commitment to calls.
We have just begun to explore the 3-1-1 system and we will pursue a thorough analysis
for future consideration. I will keep the Council apprised of our study and
recommendations as research efforts progress.

The City of Bakersfield was scheduled to accept Tevis Park on March 25, 1997, however for several
reasons which are listed below, we have not done so.

® Failure to mulch shrub beds completely

· Lower all irrigation heads

On April 24, 1997, the City extended the time for a period of two (2) weeks so the developer, GSI,
could correct the items above. The corrections were made, therefore we gave GSI another 30 days
to establish the bermuda and eradicate the weeds. This deadline for completion is May 23, 1997.

Highland School Stadium' Committee are currently reviewing their bids for the lighting of
their stadium. It is expected that the entire $230,000 will be expended by the Committee.
The City of Bakersfield is currently working on its portion $170,000, at Siemon and
University Parks upgrading the facilities. I do anticipate the above projects expending all
of the allocated monies.

The Destec Funding amounted to $500,000 that was required to be spent in the Panorama Hills
area. These monies were divided among three areas; Highland High School Stadium Committee,
Kern County Soccer Foundation and Siemon and University Parks. They have currently expended
the following:

Kern County Soccer Foundation has completed installation of field lighting for five (5) soccer fields
at the soccer complex.
Highland High School Stadium Committee has gone out to bid on their stadium lights and final
results have not been announced. The Committee has not spent any of the monies allocated to
them.
The City has spent about $23,000 to this point. Siemon Park has received a new concrete surface
on the basketball courts, new sand volleyball area and some new playground equipment.
Approximately 16 new trees have been planted at University Park, along with some new security
lighting. Also, we are looking into resolving a drainage problem in the sump area.

SUBJECT: Truxtun Avenue Repaving by GST Telecomm
Earlier this week my staffwas informed by PG&E of a phased project they are working on for the downtown
area. They are converting the low-pressure system now serving the area between Truxtun Avenue, 24t~ Street,
Elm Street and "P" Street to a high pressure system. One of the final phases will involve working in Truxtun
Avenue between "A" Street and "I" Street in the lane that is to be repaved by GST. Because of staging and
safety considerations, this segment of the PG&E project cannot be completed until August. However, GST
is ready to start the work in Truxtun right away.
I do not wish GST to grind and repave Truxtun Avenue and then have PG&E come in and pothole and patch
that same segment of Truxtun three months later. Staffhas discussed this with GST and has come up with a
proposal to accommodate PG&E. GST would provide a performance bond for the entire Truxtun paving
project and would start their construction after PG&E is finished with their project. Once GST has submitted
their bond and the bond has been approved, we would consider GST to be in compliance with the City's
requirements and would issue new street permits to them.
