SUBJECT: GENERAL INFORMATION
1. A committee from my office, Legal, Planning, and Public Works has been meeting on
the changes we need to make to the site plan ordinance, in light of the recent court
decision. We believe we are making excellent progress. The new system would use
a new process that includes a matrix to analyze the type of environmental review
necessary. It would have more administrative hearings and administrative appeals.
We believe, at this early point, that it would withstand further court challenge. It would
also not be anti-development in nature. We'll be writing it up and bringing it before
Council committee and Council in the not too distant future.
2. We received three proposals on privatization of the arena/convention center. We'll
interview next week and will have a status report for you on the October 8th agenda.
3. An arena very similar to ours is opening in the Salt Lake City area. I'm going to take
two days to learn about problems of completion, FF&E (furniture, fixtures, and
equipment), bookings, sales, and opening night issues. I think it will be very useful
regarding our opening next year at this time. The opportunity to see one of our size
open is rare.
4. The streetscape has started downtown. There is a lot of construction disruption
downtown - a short term problem and a long term benefit.
5. An update on sales tax is enclosed. Revenues for the first quarter of the 1997-98
fiscal year are running approximately 1.5% above budgeted amounts.
6. A memo is enclosed from EDCD providing details on the upcoming Good Neighbor
Festival, to be held on Saturday, October 18th.
7. The County's August Activity Report for LEA regulated projects within the City is
enclosed for your information.

8. The lease is in place for the Lowell Recreation Program, and tenant improvements
are currently being done at the Bakersfield Senior Center. Staff is planning to move
into the facility on October Ist.
9. Updates to Council referrals are enclosed, as follows:

· traffic/speeding problems at Hilton Head and Moffit.

The State Board of Equalization has provided information regarding our sales tax make
up, after three advances, for the first quarter of the fiscal year. Our 1997-98 budget
projected a 4.7% increase. Actual increases have been as follows:

Please note that the 1st Quarter increase is consistently higher than the increases for

SUBJECT: Good Neighbor Festival - October 18, 1997
On October 18, 1997, the Bakersfield African American Cultural Association (BAACA) and
the Economic and Community Development Department will hold the sixth annual Good
Neighbor Festival at the Martin Luther King Jr. Park from 10:00 a.m. to 4:00 p.m. This is a
unique multi-cultural event. It provides a great opportunity to get involved with the
community. We are inviting all departments to participate in this annual community event.
Booth fees will be waived for all City departments. This year's theme is "Good Times with
Good Neighbors." If you are interested in participating, please complete the attached
application and return to this department by September 30, 1997.

more information on the festival.

the booth area. We hope to have innovative 'and interactive booths, so surprise us with your
talents and ideas! Items given away at your booth must be listed on the Response Contract

SUBJECT: Lowell Recreatiolt Program
The HUD Amendment process for the Lowell Recreation Program is now completed. The
environmental review and the release of funds finalized. The funds are now available to implement
the program.
According to Essie Blue, Acting Director of the Bakersfield Senior Center, the tenant improvements
which were included in the City's Agreement will be completed on or before October 1, 1997.
Henry Shipes from Recreation has indicated that staff is available to move into the facility on
October 1, 1997. According to Mr. Shipes, it will take two to three weeks to plan, schedule, and
advertise to the area schools that the Lowell Recreation Program is open for business.

Subject: Council Referrals - WF0016721 & WF0015748
Councilmember Smith has requested information regarding the program for apartment
complexes and public safety issues.
The fn'e department is working closely with the Crime Prevention Unit of the Bakersfield
Police~ Department to provide home fn'e safety training and literature as part of the
program once it begins.
Councilmember Smith at a previous Council Meeting also discussed a fh'ebreak in the
vicinity of Fairfax Road and Panorama Drive.
I have previbusly responded to that issue indicating the resources were not available at
that time. Since my response, the activity level has slowed down enough that a fh'e crew
has been able to complete a firebreak along Fairfax Road near the structures from
Panorama Drive north to tie in with the area that recently burned. This should provide an
additional level of safety should any problems occur in this area prior to the rainy season.

SUBJECT: APARTMENT COMPLEXES AND PUBLIC SAFETY
Although I will be unable to attend our August 6, 1997, meeting, I request that you .refer the
issue of Public Safety in and around apartment complexes to the Police Department.
Development Services Department and City Attomey.
There are a number of apartment complexes in our city which have become blighting influences
on neighborhoods, because of threats to public safety and dilapidation. These complexes place
a disproportionate burden on our Police Department. Fire Department and Code Enforcement
Division. This is something I have learned from working to solve problems in my ward. but I
have heard that other areas of the city have the same problems. Much of this is attributed to
poor apartment management as far as tenant screening and enforcement of rules to ensure a
decent living environment.
In other cities, especially notorious apartment complexes have been put in good order by suing
them as public nuisances. Based on complaints I have received and the high volume of police
responses, I believe that it would be appropriate to ask the City Attorney to evaluate if such an
approach would be applicable in Bakersfield. She has been provided with a description of the
problem and I ask that she bdef the City Council on her findings under potential litigation at the
next City Council meeting.
I have been told that our Police Department has been looking into a program that has been
successful in other cities called the crime-free multi-family program. So, secondly, I ask the
City Council to not only encourage implementation of this program but to also request a
workshop and that any necessary ordinances and resolutions be drafted for City Council review
and approval at our September 10, 1997, meeting. Such a program should be the result of a
collaborative effort by the Police Department, Fire Department, Development Services
Department and City Attorney so that it addresses issues from design to operation and
management.
Finally, I request that those departments review their efforts with the Urban Development
Committee at its next meeting on August 13, 1997. Thank you for your consideration.

Currently we are in the final stages of developing a Crime Free Multi-Housing program for the City of
Bakersfield. I am in the process of adapting the national landlords manual to address local concerns as
well as the inclusion of state law and local ordinances. I hope to have the manual complete by October 1
at which time the individual components will be distributed to each of the presenters for revision or
comments. Sgt. Taylor is coordinating the presenter agenda and has tentatively scheduled a meeting
with all of the presenters for Monday, October 6. We hope to conduct the first class in late October or
early November. We are still undecided as to the fee we are going to charge to attend the training but
expect it to be $20 or less [vhich will cover printing costs, of the manual as well as any other incidental
expenses associated with the training. The BakersfieM Californian ran an article on the proposed
training program on October 22, and there has been an overwhelming response from landlords and
property managers expressing interest in attending the program.
