SUBJECT: GENERAL INFORMATION
1. Attached is a letter of support from the DBA regarding the Amtrak station. They are
in full agreement with the City that the "S" street location is the best site.
2. A status report on the Chester Avenue streetscape is attached. We have offered free
parking in the 18th and Eye Street structure for merchants, their employees, and
customers during the construction period. Work is on schedule, with completion
scheduled for mid-January.
3. We have sent out letters to 188 property owners about possible annexation of the
unincorporated area between Olive Drive and the Kern River, between Riverlakes and
Highway 99. Based on the favorable responses received from those in the area south
of Rosedale Highway, we will focus on that region. A memo from Development
Services is attached.
4. A memorandum is enclosed from the Fire Chief regarding the process and cost of
cleaning up the waste tire site at 3400 Hale Street. As further information becomes
available, we will communicate it to you.
5. An update on staff assistance to the Teen Challenge housing project is attached.
6. As mentioned several weeks ago, we have booked a motor sports event in the new
arena for January, 1999. The confirmation letter from PACE Motor Sports is
enclosed.
7. A response to a Council request for an update on youth curfews and fines imposed
is enclosed.

SUBJECT: Status Report of the Chester Avenue Streetscape Improvement Project
Construction on the Chester Avenue Streetscape Project continues to progress. As of October 20,
1997 Granite had 50 more working days in which to complete the project and Elite had 60 days.
Pending no bad weather or unforeseen problems, this puts estimated project completion at mid-
January 1998.
The utility trench has been excavated on both sides of the street. If all goes well, the trench will
be covered by October 31. This will give the on-street parking back to the merchants. The few
merchants without parking lots or without close proximity to east/west directional streets for
parking have expressed no store front parking as a great disadvantage to the profitability of their
businesses. To help this situation I have offered them validation stickers at the 18th and Eye
Street Parking Structure and temporary parking for them and their employees during construction
at no charge.
I continue to visit the merchants on a regular basis and provide them with updates on the
project's progress. Many business owners communicate freely with the contractors if they have
questions. As you know, they also have my business card should they need to reach someone
immediately. To keep the merchants and property owners informed, this effort will continue
throughout the construction project.

SUBJECT: ANNEXATION OF INDUSTRIAL ROSEDALE BETWEEN/EIVERLAKES
AND HIGHWAY 99
Between August 29 and October 3, 1997, I have sent letters to 188 owners of property in the
unincorporated area between Olive Drive and the Kern River between RiverLakes and Highway
99. I outlined the City's concern that problems of water service, sewage disposal and circulation
were very difficult to resolve because of the need to convince the county that they should
coordinate the solutions with us. Of the 188 letters, 26 were returned as undeliverable, 16 were
negative on further discussion of annexation and 20 indicated a willingness to continue
discussion of the benefits of annexation. Most of the positive response came from the area
south of Rosedale Highway.
As you have directed, I will focus promotion of annexation on the area south of Rosedale
Highway while your office negotiates a tax split.

Subject: Waste Tire Site - 3400 Hale Street
At the Council meeting of October 8, Councilmember Carson mentioned a problem
relating to illegally dumped and burned tires at the location of 3400 Hale Street. She
indicated in her remarks the cost required to clean up this location might run in excess of
$270,000.
The Environmental Services Division has been researching this problem to identify what
alternatives might be available to assist with the clean up at this site and attached is a
memorandum from Hazardous Materials Coordinator Ralph Huey which indicates the
clean up could be accomplished in three tiers. If the proposal Ralph has identified is
workable, the estimated clean up price would be approximately $34,000.
There is also the possibility that state funding can be obtained to pay for the clean up at
this site.
As soon as more information is available and the clean up process is confn'rned, I will
provide you an update.

SUBJECT: Waste Tire Site Located at 3400 Hale Street
In July of 1997, the city annexed the property located at 3400 Hale Street, which has been the
site of illegal waste tire dumping and a fire involving those waste tires. The result of the fire was
a deposit of hazardous waste on the site resulting from the tire ash. We have had this ash
analyzed and determined that this material does qualify for the recycling exemption of Section
25143.2 of the Health and Safety Code for use as an agricultural nutrient. We have also located
a local firm that would be interested in processing this material. The clean up of this site, could
therefore be simplified into three basic operations.
1. Approximately 800 whole used tires still remain on site. These tires need
to be removed and properly disposed of.
2. Approximately 1,000 cUbic yards of burnt tire and wire debris remain on
site. This material qualifies as a regular solid waste and can be disposed
Of at the Kern County Landfill.
3. Approximately 300 cubic yards of zinc enriched soil and burn ash are
present on site. This is to be removed and transported to a local chemical
company and recycled for its agricultural nutrient value.
We have solicited informal quotes from qualified vendors for equipment, labor, transportation
and relative fees associated with this problem. A brief summary is as follows:
Whole Tire Disposal Cost $ 1,920
Landfill Charge (1,000 cubic yards $10,875
~ $29.00 per ton).
Disposal (recycling cost) of 200 cubic $ 5,600
yards zinc enriched soil and bum ash).
Equipment, Transportation and Labor $15,600
Estimate Total $33,995
We have requested the Cai EPA Integrated Waste Tire Management Board to fund this clean up.
Although we have no commitment at this time, this board has previously allocated $90,000 to
Kern County to fund tire removal, at this site, which was never spent. We do feel there is a good
possibility that State funding can be obtained.
In addition to this clean up, we are currently pursuing regulation and policy to aggressively
regulate waste tire facilities and illegal tire dumping in the City.

SUBJECT: Teen Challenge Housing Project Status
As mentioned in the memo dated September 19, 1997, the City Attomey's office has confirmed that
Teen Challenge (TC) is primarily a religious organization. This determination was reached by
reviewing TC's Articles of Incorporation and By-Laws.
Both HOME and CDBG regulations specifically prohibit funding to religious organizations for any
activity including rehabilitation, construction, or acquisition with federal funds.
Staff has also investigated whether the Central District Development Agency's (CDDA) housing
set-aside funds could be used for their project. However, similar restrictions exist.
Staff has notified TC's representatives and an alternate applicant was proposed to undertake their
project. However, that applicant is also affiliated with religious activities and is also not eligible for
government assistance.
We are continuing to explore other avenues to assist Teen Challenge and resolve their CUP on
Kentucky Street.
Earl Gibbon from TC has asked that the Planning Department continue their CUP hearing until this
can be worked out.
You will be updated as staff continues with its TC application.

In the meeting held October 13, 1997, attended by Janice Scanlon from the City Attorneys
Office, the City of Bakersfield's Curfew Ordinance was reviewed. As a result of recent
court decisions from the San Diego area, the language of our Ordinance, along with the
feasibility of cost recovery, was discussed.
It was felt that the present .language used in the Ordinance was within guidelines and
specific enough to fall within recent court decisions. A change in our present hours (going
from 10:00 p.m. on Friday and Saturday to 12:00 p.m. ) was also discussed and felt to be
reasonable for the weekends in order to facilitate social events attended by individuals
under the age of eighteen. Using 12:00 p.m. appears to be consistent with other
jurisdictions enforcing curfew laws.
The feasibility of attaching a cost recovery for repeat offenders ( 90 days ) will need further
discussion in order to address issues such as billing, enforcement, and criteria to be used
to establish cost. Current cost recovery programs could be used as a guideline for this
purpose.

Public Works Director R'aul Rojas announced today the closure of "N" Street
between 14"~ Street and Truxtun Avenue for construction in the roadway immediately
north of the railroad tracks.
The closure will be from October 27 through 5:00 p.m. on October 31, 1997 and
November 3 through November 7, 1997.
