SUBJECT: GENERAL INFORMATION
1. As of this date, the County has not submitted the agreement for funding the Mt.
Vernon Recycling Center for 1997-98. Last year, the County paid $343,701 for
county residents and businesses to use the facility without paying a gate fee. An
enclosed report analyzes alternatives if they continue the position of not executing the
agreement.
2. We are pleased to inform you that the Division of Recreation and Parks won first
place in the Special Volunteer Division for their entry in the Christmas Parade.
Attached is a list of the those who participated in the project, as well as several
pictures of the float and the awarding of the trophy.
3. Correspondence from Olcese Water District is enclosed in reply to a letter the Mayor
sent them several months ago stating the City's concern about their ability to assure
a water supply to their customers and to notify them of shortages during emergency
situations. The deficiencies in their system became apparent during the grass fires
last summer.
4. The second annual HUD Community Assessment Consultation was held on
Thursday, December 18th. A summary is enclosed from EDCD.
5. The County's December report on LEA regulated projects in the city is enclosed.
6. The latest Graffiti update is also enclosed.
7. Responses to Council referrals are enclosed, as follows:
· summary of the Keep America Beautiful program;
· update on the repairs being made on North Laurelglen;
· check feasibility of a traffic signal at Rio Mirada and Pierce Road;
· do warrant study for a crossing guard at Truxtun and A St;
· check feasibility of a 3-way stop at Camp Street and Fairview Road;

Oleander;

· provide paper trail regarding speeding on Elm Street;
· communicate with the railroad companies to improve the crossings for public
safety.

SUBJECT: COST RECOVERY OF COUNTY PARTICIPATION AT THE MT. VERNON
RECYCLING CENTER
Kern County Waste .Management Department staff has, as of this writing, failed
to submit the City/County agreement for funding the Mt. Vernon Recycling Center
for FY 1997/98. Assuming County staff is unwilling to request the Board of
Supervisors to participate for this fiscal year, the shortfall to the City would be
approximately $350,000.
The County paid $343,701 last fiscal year for county residents and businesses to
bring their green and woody waste .to the facility, without paying a gate fee.
However, t° allow participation without a contribution or a gate fee would burden
city ratepayers, and constitute a subsidy for county residents.
If the County does not participate this year, one of the following scenarios may
mitigate the problem. However, since it is staff's belief that there is no practical
way to eliminate unauthorized participation from county residents and businesses
completely, some form of City subsidy will exist.
Scenario #1
Exclude county residents and businesses from participating, without
provision for any gate fee. The administrative difficulties, it can be
argued, outweigh attempts to charge residents. These residents and
businesses would be directed to the landfill.
Scenario #2
Attempt to charge county residents and businesses who wish to participate,
based on the size vehicle they drive. Since Mt. Vernon does not have
scales, a general volume-based price would have to be derived. The
attached notes small vehicles charged at $1 versus $22 for medium-sized
vehicles. This is based on staff estimates of roughly $22 per ton to
process green and wood waste received .at the gate.
Scenario #3
1. Attempt to charge county residents who wish to participate, based on the
size vehicle they drive. Same as Scenario #2(1).
2. Attempt to charge county businesses, based on the attached. However,
only city businesses known to generate waste on their own premises, such
as old pallets from warehouses, sawdust from cabinet shops, etc., will be
admitted for free, with proof of business license. Floating city and county
businesses, such as gardeners, haulers, etc., which haul waste from either
city or county areas would be charged, per the attached, or directed to
the landfill. The assumption in the case of floating businesses is that the
loads are mixed city/county, pure city or pure county; and, cannot
therefore be accepted for free at the gate.
City residents would continue to participate, free of charge, with proof of
residency, i.e., utility bill plus driver's license. An annual sticker or decal can
be provided to avoid long waits in line for identification.
The attached spreadsheet notes the "maximum revenue anticipated", which
assumes everyone will participate honestly. The "anticipated revenue" assumes
the most likely revenue that will be generated since many, if not most, will dump
illegally or find other alternatives.
Recommendation
Scenario #1 is the least expensive administratively to implement but has no hope
of recovering any lost revenue. Scenario #2 may prompt some county residents
and businesses to participate to avoid county landfill trips/gate fees but this
option will raise less than 1/3 of the County's contribution, and do little to deter
possible rate increases. Scenario #3 is the only scenario that attempts to
address the issue of mixed commercial loads but may prompt gardeners to
increase their costs to homeowners, and blame it on the City.
Staff recommends Scenario #2, if needed, as the least problematical method of
recovering some of the lost revenue. However, there are no identifiable means
of collecting the full amount previously contributed by the County. As shown
on the attached, staff realistically expects to generate about $121,000 with this
scenario, though if all county residents paid for the service they now enjoy for
free at the gate, the revenue would exceed $500,000.

SUBJECT: Bakersfield Christmas Parade
Approximately one year ago, I discussed the possibility of the division's participation
in the annual Bakersfield Christmas Parade with Lee Andersen. I initiated this
discussion because I had just attended the 1996 parade and believed that our
participation in the 1997 parade would meet one of our goals which was to become
more "visible" (and recognizable) to the public. Additionally, it would be good for
the staff to participate in a community event. Lee agreed and since that time we
developed plans for this years' parade.
The staff began working on a design this past. summer and later on the construction
of our float. The attached list indicates the individuals involved with the construction
of the float and those that rode on the float during the parade.
I am pleased to inform you that our entry earned first place in the Special Volunteer
Division of this years parade. Attached are copies of photographs of the float and of
Ed Lazaroti receiving our trophy.
The city's Roster indicates that the Mayor handles awards and recognition. I have
contacted the Mayor and asked him to consider recognizing the staff for their efforts
on behalf of the city.

was due to several ~actors. We actually operate two(2) separate
water systems and one system did not run out o~ water. Ii both
systems had run out o~ water, loss o~ homes and property would

The emergency back-up system ior power has been addressed
and the ~ast situation should not recur. We are meetin~ with the
eight(8) different Homeowner Associations and Management Groups
to re-e~iorce notiiicat~on procedures. Portable loudspeakers are
now operational on all three(3) District vehicles.
In addition, co~unications with P.G.&E., Pac~i~c Bell,
Bakersfield Fire Department and other a~encies and services will
be much improved in the ~uture.
We take our responsibilities very seriously and are
constantly strivin~ to improve. I stand personally willin~ and

SUBJECT: 2nd Annual HUD Community Assessment Consultation - Program Year 1996
On December 18 the referenced meeting was held at the Convention Center. The consultation
was between HUD representatives, community leaders, elected officials and other stakeholders
interested in Housing/Community Development (H/CD) programs for Bakersfield. The
purpose was twofold: 1) to review the City's performance for fiscal year 1996-97 in light of
the goals and objectives outlined in our Consolidated Plan 2000 (a five year strategic plan);
and 2) to determine how HUD can better assist the community in addressing its H/CD needs
in the future.
Elected officials and representatives at the consultation included Mayor Bob Price,
Councilmember Jackie Sullivan, and Mr. David Strong, field representative for County
Supervisor Pete Parra. HUD representatives included Ms. May Lee Sameniego, and Ms. Mary
Ann Soos. Ms. Dolores Teubner represented the City Manager's Office.
According to HUD, the overall performance for the City last fiscal year was satisfactory and
we were acknowledged to have the continuing capacity to implement H/CD programs. HUD
gave the City excellent ratings for content and format concerning our FY 96 Consolidated
Annual and Evaluation Report (CAPER) and our Fair Housing Plan 2000.
Positive comments from the audience regarding our performance and customer service was
received from the following agencies: Community Service Organization, Kern Economic
Development Corporation, Restoration Community Project Incorporated, Bethany Services,
Kern County Economic Opportunity Corporation, and the Police Activities League. Other
agencies at the consultation included Clinica Sierra Vista, Housing Authority of the County of
Kern, and Greater Bakersfield Legal Association.

In the month of November, the amount of work performed is substantially less than in the past due
to the rainy weather.
It is difficult to know the number of graffiti removal activities done by Adopt-A-Wall volunteers.
The Anti-Graffiti office does not require the 200 Adopt-A-Wall volunteers to report, or take a picture
of, every instance of graffiti they remove. We know they often remove graffiti from their adopted
areas, and that they are pleased to be able to make a difference in our town. The attached letter
'demonstrates the volunteers' enthusiasm and dedication to the betterment of the community.
Anti-Graffiti Newsletter
Attached is a copy of the latest "Graffiti News." This office is very pleased to be able to send this
newsletter to sponsors, local judicial system offices, businesses, schools, community leaders,
officials, and the general public. The newsletter is a valuable promotional and informational tool.

Amendment to Municipal Code
On November 19, 1997 an amendment to section 9.36.070 of the City's Municipal Code was
approved by City Council. This action will allow the City to pursue civil and criminal charges
against graffiti vandals.

It gives me and my family great pleasure with serving our community. Since the time I've became a
"GRAFFITI ~BUSTER" volunteer, my family and I have removed graffiti throughout our neighborhood.
Our efforts have been successful due to the reduced amount of repeat graffiti incidents.
Not only am I concerned about graffiti clean-up, but I am also concerned about repairs to our city parks.
Currently, Silver Creek Park needs repair to the mens restr°°m, and Wilderness Park needs repair to the
"WILDERNESS PARK" sign. Although park repairs are not within your department, it would be
appreciated ffyou could refer me to the correct departments telephone number.
Together, our efforts will make Bakersfield a better place to live, and one we can be proud of.

SUBJECT: Keep America Beautiful (KAB) Program
Pursuant to your request, the following is a summary of the KAB program and the
components that I believe should be incorporated into a local program.
The KAB system is a behavior-based approach to prevent littering at the grassroots
level through education, community-wide involvement, and public-private
partnerships. It is offered to communities on a certification basis. From my
experience with the program, I feel that the educational component (in public
schools) is the most important in affecting change. It improves the community
because it provides long-term solutions, rather than focusing on one-time cleanup
events. The systems' five-step approach is: (1) getting the facts, (2) involving the
people, (3) planning systematically, (4) focusing on results, and (5) providing
positive reinforcement.
KAB initiatives that we would probably want to have locally are: (1) Glad Bag-a-
Thon which is an annual cleanup day or week, (2) Build America Beautiful where
we would help builders reduce job-site litter and waste, (3) RJ Reynolds/Vantage
Brands Portable Ashtray Program to reduce cigarette litter, and (4) "Close the Loop,"
a program to educate consumers about the benefits of"buying recycled." There are
two other initiatives that we could potentially partner with. other departments to
implement. They are Graffiti Hurts and NiCad Battery Recycling.
If you need additional information about any of these components of the program,
please let me know.
I spoke with Alan Tandy alter our recent conversation and he feels that the
appropriate next step would be for you to make a referral to staff so that we may
research the KAB program further and analyze what it would take to implement a
program for the city.

I wanted to provide you an update on the repairs being made on North Laurelglen
Blvd. The sidewalk repairs have been completed. The bricks on the perimeter of the
tree wells will be installed by early next week. Once this is completed, the new
irrigation system will be installed and then new trees planted (the trees are already
here). This should begin by December 19, 1997 and be complete by January 15,
1998. Normally, the work would be completed in less time but we are allowing for
staff vacations around the holidays.

Councilmember Rowles requested staff provide information on the
feasibility of a traffic signal at Rio Mirada and Pierce Road and
advise of the time line.
Traffic Engineering conducted a signal warrant study earlier this month in response to a
request from a resident. The location meets warrants and is feasible for a traffic signal.
This project will be added to the list of proposed traffic signal locations for consideration
of funding in the next capital improvement projects list.
Currently, there are over thirty locations that meet warrants for a signal and are unfunded.
It is estimated that the signal may be constructed within five years, depending on available
funding priorities.

Traffic Engineering will be conducting a school crossing guard warrant study after the
winter holiday break for the school system. Due to inclement weather and other studies
already in progress, the warrant study could not be scheduled prior to the winter holiday
break period. The intersection of Truxtun Avenue and "A" Street has a pedestrian actuated
traffic signal installed to accommodate students of Franklin School.
We will notify the Police Department, as the lead responding department, of the results of
the school crossing guard warrant study. Attached is a copy of their response to this
referral.

The Traffic Engineer has reviewed the intersection operation as requested. The
intersection does not meet volume warrants for a 3-way stop. Further review of the
operation of the intersection and pedestrian use would support the use of a 3-way stop to
create adequate gaps in traffic for left turns, out of the residential area, and allow
pedestrians and students to cross in an orderly manner. Because of internal changes in
traffic flow south of the intersection on Camp Street, traffic must now use the Camp and
Fairview intersection to access a major street out of the neighborhood.
Because of the operational improvements to be realized with a stop, I will recommend that
the intersection be converted to a 3-way stop.

intersection of 8* and "T" Streets did not meet any warrants for stop sign control. Since
the intersection appears to operate satisfactorily, no changes are proposed.
The intersection of Oleander at Chester Lane was also reviewed by the Traffic Engineer
as requested. The intersection does not meet warrants for a 4-way stop control. The
intersection is also a school crossing guard location for students crossing Oleander. Since
the installation of stop signs would eliminate the warrant for school crossing guards,
another study of the intersection will be made after the winter holiday school break. We
will make recommendations after the second review of the intersection.

Councilmember Sullivan requested staff t~rovide her with a memo
informing her when the 3-way STOP sign was placed at the
intersection of Planz and Real Roads and why it was necessary.
The intersection was changed to a 3-WAY STOP control in September 1994.
The intersection was analyzed as the result of a 1994 City Council referral/request to have
stop signs installed. The resulting study showed that stop signs were warranted and that
traffic volumes would more than double the minimum volume needed to meet the stop sign
warrant.
In addition, the intersection met several warrants for a traffic signal. Since the intersection
would not be funded for a traffic signal for several years due to higher priorities, the
intersection was made into a multi-way stop as an interim solution. Because of the
installation of the stop signs, the traffic has stabilized and the number of reported accidents
reduced.
No changes are proposed.

Traffic Engineering ordered the installation of additional speed limit signs in 1996 at each
end of Elm Street as requested by residents of Elm Street. In late 1996 additional curve
warning signs with speed warnings were installed at the north end of Elm Street after a
traffic study indicated that speeds exceeded 35 miles per hour on the posted 25 mile per
hour street.
In February 1997, an application for speed bumps was sent to Mrs. Barnett. A few months
later an incomplete petition form for speed bumps was returned to the City. Traffic Staff
contacted Mrs. Barnett and instructed her to obtain signatures from at least 75 percent of
the residents on all streets intersecting Elm between F Street and 24th Street as well as
those fronting on Elm Street. Additional information was not received and the file was
closed.
In August 1997, Mr. Wade Tavorn, a signer of the petition, informed the Traffic Engineer
that they were still waiting for a response from the City on their application for speed
bumps. I tried contacting Mrs. Barnett, the official contact person for the application, and
did not receive any responses. Traffic Engineering staff recontacted Mr. Tavorn requesting
the current phone number of Mrs. Barnett. Upon obtaining the correct phone number from
other sources, Mrs. Barnett was contacted. She advised the Traffic Engineer, Mr. Walker,
that they had complied with the request for additional signatures and petitions and had

turned them in this past summer. The additional petition information that was sent to the
City has not been found and may have been misdirected during the time the engineer
position handling this petition was vacant. Traffic Engineer Walker told Mrs. Barnett that
we will search our files to be sure it had not been mis-filed. She was amenable to waiting
for our search and may be able to provide a copy if the original cannot be found. Mrs.
Barnett was agreeable, accepting our sincere apologies for the inconveniences, and pleased
with our response. Messages have been left for Mr. Tavorn.

SUBJECT: COUNCIL REFERRAL-- RAILROAD CROSSINGS
In response to the Council Referral regarding railroad crossings, the City Attorney's
Office, with information provided by the Public Works Department, prepared a draft formal
complaint to the Public Utilities Commission specifying the existing problems at railroad
crossings that the railroads have failed to correct. This draft was presented in closed
session at the December 3, 1997 meeting.
At that meeting, the City Council directed staff to prepare a letter to the railroads
nicely threatening to file a formal complaint if the problems are not corrected. The City
Attorney's office is currently preparing those letters pending further information from Public
Works.
