SUBJECT: GENERAL INFORMATION
1. The City Attorney interviews are scheduled for a special Council meeting beginning
at 11:30 on Thursday, November 5, 1998. It is, of course, an executive session.
2. The County has set a date of November 9th to consider the proposed ordinance for
the NOR Park Development fee which would establish a $615 per dwelling unit park
fee on new development.
3. A memo from EDCD is enclosed regarding the effects of Proposition 7 on Enterprise
Zone legislation. There are several distinct advantages that would accrue to our
enterprise zone, if the proposition fails. The memo outlines those provisions.
4. I will be out of town from Sunday, October 25th through Wednesday, October 28th to
attend the International City Management Association annual meeting. Alan
Christensen will be in charge during that time, and my office will have a number to
contact me.
5. All of the annexation policy changes directed by Council have now been
implemented.
6. At the Arena, some of the finishing touches are being done. The waterwall is now
working, the railroad has repaired the grade crossing at "N" Street, and repairs to the
sound system have been made. Ogden is finding creative ways to make money.
During some non-event days, for example, we are renting out for a sound and light
practice for a musical group - no performers, but the technical people pay the rent
anyway.
7. A response to a Council request for information on the process for notifying residents
when their trash service changes from manual collection to an automated program
is enclosed.

SUBJECT: Effects of Proposition 7 on Enterprise Zone legislation
Bakersfield's enterprise zone may gain an additional five years of life, and be able to expand by
an additional 5%. The deciding factor on whether these benefits will come to pass rests with
Califomia voters and how they react to a statewide proposition on November 3.
During the past legislative year, Senator Jim Costa introduced SB 2079, a bill supported by the
California Association of Enterprise Zones. In the final days of the legislative session, the bill's
language was incorporated into AB 2798 (Machado) and signed by Governor Wilson. However,
the enterprise zone provisions were tied directly to the future of Proposition 7. If Proposition 7 is
approved by voters, the provisions of AB 2798 pertaining to enterprise zones will be dead.
Proposition 7 is California's first air pollution initiative that would provide $210 million in the
form of business tax credits to promote cleaner-burning technology and encourage the purchase
of new vehicles. Only if Proposition 7 fails will the enterprise zone provisions of AB 2798 be
enacted.
These provisions are as follows:
· Older zones like Bakersfield would receive a five year extension of life. While our zone
designation is set to expire in October 2001, the bill would extend this designation to
October 2006.
· Smaller zones like Bakersfield will be allowed to expand the area of the enterprise zone
by an additional 5%. We currently have the authorization to expand up to 15% of our
original area. Due to previous expansions, only 4.6% of our zone's original area is
available for future expansions.
· Authorizes the Trade and Commerce Agency to audit any enterprise zone at any time
during the period of designation, or at least every 5 years, and would provide for the
revocation of an enterprise zone designation.

· Expands the definition of qualified property to included specified data processing and
communications equipment and specified motion picture manufacturing equipment that is
used for production and post-production.
· Clarifies the definition of the term "qualified employee."
· Provides for a change in the apportionment formula from a four-factor formula to a two-
factor one (this will enable businesses to take their earned credits twice as fast). It also
limits apportionment of California-based income instead of worldwide.
If Proposition 7 fails, the above provisions would be enacted effective January 1, 1999.
The comments I have heard from colleagues throughout the state is that, since Proposition 7 has
no organized opposition, it has a good chance of passage. However, the Los Angeles Times
recently took a position opposing Proposition 7.

SUBJECT: AUTOMATED TRASH AND RECYCLING SERVICE
Councilmember Rowles inquired as to the notification process in changing service from a
manually collected trash system to an automated program. Staff hand-delivered "Coming Soon"
brochures to every door of affected residents, during the week of October 12th. The brochure
describes the change and also notified them of the neighborhood meeting (held in the Council
chambers at 7 pm, October 22, 1998), to cover additional questions or concerns not covered in
the brochure. Councilmembers Rowles, Smith and Sullivan received samples of these brochures
since' the rollouts will occur in their wards.
Additionally, staff will attach another brochure to the carts, describing how the carts should be
used and placed, and a phone number, if they need more information. Delivery of carts begins
the week of October 26, 1998 in the Howard's Garbage area; followed by Superior's area and
then Varner & Sons. Ail of Howard's area will then be automated. Roughly half of Superior's
area will be covered and about 1/3 of Varner & Sons. Superior and Varner & Sons will be
finished off in the final phase, which will occur around April 1999.
