SUBJECT: GENERAL INFORMATION
1. We are moving over the half way point on the Panorama home sales; 8 down and 7
to go.
2. We did receive an inquiry about relocating the Union Avenue Bakersfield sign. We
will gather the facts to prepare a response to the inquiry, since it's privately owned
and, at its current location, controlled by the State.
3. Some of the teal colored pavers at the Plaza have broken up, which attracted a TV
press story. Weather permitting, those in the service drive will be replaced with a
more durable teal concrete cut to the same 12 inch pattern. "Named" bricks are not
involved.
4. Per the attached memo from Public Works, during an audit of sewer users, staff found
a significant number of dwellings that were not being charged for sewer fees,
particularly in areas of Sewer Assessment Districts. The attached letter will be sent
to those parcel owners to verify that they are being serviced by the City's sewer
system.
5. A press release is attached from Burlington Northern and Santa Fe Railway Company
regarding a track and bridge maintenance program on its main line between
Bakersfield and Fresno. The project is scheduled to begin next month.
6. A memo'from the Planning Director is enclosed regarding the zoning of properties at
1100 Union Avenue and 708 Lincoln Streets. The State sent us notices (also
enclosed) that they have received applications for both locations to be licensed as
residential alcoholism and/or drug abuse recovery facilities.

SUBJECT: Sewer User Fees
During an audit of sewer users, staff has found a significant number of dwellings that were not being
charged for sewer fees, especially in areas of Sewer Assessment Districts. In these areas, sewer mains
were constructed in the streets with laterals to each property; however, owners were not required to
connect to the sewer. It is possible that some owners may have connected without a building permit
as required. Consequently, Wastewater staff would not have been notified to add it to the user-fee roll
since they use building permit information.
We have about 260 parcels in the Rio Bravo area (Parcel books 386 and 387) and 125 parcels in the
South Union Avenue area (Parcel books 413) that need to be verified of sewer connection. There are
additional parcels scattered around the City's sewer service area that need to be evaluated.
There are several methods to verify the connection, such as dye and smoke tests. A dye test is 100%
accurate but labor intensive and time consuming. A smoke test is about 90% accurate and cost about
$1200 a day using a contract service with assistance from city staff. Neither method is ideal;
therefore, we would like to take a different approach using the attached notice letter to achieve the
same goal.

Since January 1996, property in your area has been serviced by the City of Bakersfield's sewer
system. Because of an administrative oversight, some of these properties have not been charged
the sewer service fee.
As of January l, 1999, we will be assessing your property residential sewer fees unless you
contact our office immediately to inform us that your property is not serviced by the City's sewer
system and you are still connected to a septic tank. Once confirmed, your property will be
deleted from our billing records. Cun'ently, the annual sewer service fee is $110.00.

BNSF Plans Track Maintenance Blitz Between Bakersfield and Fresno
FORT WORTH, Texas, December 1 I, 1998 -- Thc Burlington Northern and Santa Fe
Railway Company (BNSF) will begin an $11 million track and bridge maintenance project
on its main line between Bakersfield and Fresno, Calif., on January 18, 1999.
To minimize th~ impact on customers and communities, work that could have been
spread across many months will be completed in a two-week period. This is one of the
larger BNSF maintenance projects that will be accomplished in a compressed time frame.
In the summer of 1998, BNSF successfully completed a similar track maintenance
blitz project from Springfield, Mo., to Memphis, Tenn., within 15 days. In January 1998,
BNSF also closed down a stretch of u'ack near Guernsey, Wyoming, and tore down a 93-
year'old tunnel and replaced the single-track with thre~ miles of double track and new
siding.
The Bakersfield blitz project includes replacement of six track miles of steel rail
using five welding gangs to create continuous welded rail. Approximately 76,000 wood
cross ties wfll be installed. Surfacing work is planned for 100 track miles, and ballast
cleaning and undercutting is planned for 70 track miles. The total project is approximately
120 miles long.
To achieve the compressed schedule for th~ project, BNSF will bring ia 250
additional employees from various parts of the railroad that will be assigned to specific
track, rail and bridge renewal projects across the line. The communities affected between
Bakersfield and Fresno will be: Rosedale, Shelter, Wasco, Pond, Delano, Sandrini, Alpaugh,
Corcoran, Guernsey, Hanford, Conejo, Oleander and Visalia.

The only tl'~inx l'lmning along the route during the blitz will be BNSF work train_~
carrying ballast and other materials to maintenance crews. Other BNSF freight trains will
be re-routed along Union Pacific Railroad tracks in the San loaquin Valley. Customers
have been notified about any temporary changes in their freight schedules. BNSF is
working cIosely with customers along the "blitz" route to provide alternate modes of service
if necessary. BNSF freight service is scheduled to resume January 30, whetx the main line
between Bakersfield and Fresno is reopened,
Some highway-rail grade crossings along this rail line will be closed temporarily as
maintenance crews reconstruct track. In most cases, an affected crossing will only be closed
a few hours on a particular day. BNSF has worked closely with all the communities and the
California Department of Transportation (Caltrans) to plan crossing cIosure s~hedules and
identify alternate routes for traffic. BNSF will ensure all crossings are returned to service in
the same or improved condition, and BNSF engineers have designed alternate mutes to
allow emergency vehicles to traverse selected crossings during construction.
During the maintenance project, BNSF will confirm closure schedules 16-24 hours
in advance through the local media. Updated grade crossing closures will be posted to a
special "Bakersfield blitz" update on BNSFs web page at http://www, bnsf. com.
The highest safety and environmental standards will be maintained throughout the
project, starting with five days of safety meetings beginning January 11. On Sunday,
lanuary 24, crews will be given a rest day. BNSF expects to spend more than $200,000 in
lodging and food along the route during this 'project,
A command center will be situated in Fresno where BNSF and Caltrans personnel
will be stationed around the clock. If heavy fog develops along the "blitz" route, Caltrans
will caution motorists traveling along Highway 43 that BNSF workers are ahead. However,
if the fog gets too thick, BNSF will cease working until it lifts,
BNSF's line between Bfl<ersfield and Fresno is a key rail route. BNSF employs
about 150 people in Bakersfield, 250 in Fresno and more than 3,200 employees statewide.
BNSF operates one of the largest railroad networks in North America, with 34,000
mute miles of track covering 28 states and two Canadian provinces.

TREATMENT FACILITY - ! 100 UNION AVENUE AND 708 LINCOLN STREET
The property at 1100 Union Avenue is zoned C-2. Hospitals and Sanitariums are permitted
uses. The subject use, although not the same, is similar in that it provides treatment to patients
recovering from alcohol and/or substance abuse. No further review or approval from the City
is required for use except for any remodeling requiring building permits.
The property at 708-714 Lincoln Street was approved with a conditional use permit, as a home
for battered women in 1987 on property zoned R-1. The subject use would change the
property from a b~ittered womens shelter to a recovery facility for males. A conditional use
permit is an allowance for a specific use and does not give that use the same status as uses
permitted by zoning. A letter was sent to Nancy Walker, applicam for the license at 708
Lincoln Street. It erroneously stated, based on a telephone conversation, that no further
permits would be required. A new letter is being sero to clarify why a new conditional use
permit would be required.

'Ihe Department of Alcohol and Drug Programs has received an application tot
licensure from Foundation House, Inc, to operate a residential alcoholism and/or drug abuse
recovery or treatment facility and an approved fire clearance from the local fire authority.
The facility is to be located at 708 Lincoln Street, Bakersfield, CA 93305. The fire
marshall has approved a total occupancy of the entire facility as 30 (which may include up to
6 ambulatory children).
Pursuant to Health and Safety Code Sections 11834.22 and 11834.23, if the licensed
capacity of the residential facility was limited to six or fewer resident beds, it would not be
subject to business taxes, local registration tees, use permit fees, or other ~imilar fees to
which other single-family dwellings are not likewise subject, and is considered a residential
property use. However. since the capacity for this facility is greater than six beds, it is not
exempt from these requirements. Therefore, you may wish to review the facility for
compliance with your jurisdiction's local business taxes, registration fees, use permit
requirements, etc.
-The Department does not enforce the above local requirements and, by law, does not
condition the issuance of the state license on conapliance with these requirements. These city
requirements arc solely for local control and enforcement.
