FROM: Alan SUBJECT: General Information 1. A Request for Proposals has been sent regarding the proposed sale of the farm property. The submittal date is January 31 st. 2. The draft Cooperative Agreement relative to the Thomas Roads Project has been forwarded to CalTrans for their consideration. We have amended the original to revise them as a "funding partner'', in light of their fiscal constraints. 3. In the General Information memo of October 21st, I referenced a possible refinancing of the debt on the arena, which has the potential to yield a gain between $1.5 and $1.9 million that can be used for capital items within the structures. Currently, we anticipate presenting it to you at the meeting of November 30th. It is subject to change based on interest rates! This also requires an action by the Redevelopment Agency. To get it to market, I will be on a tight schedule. Please call if you have questions or concerns. 4. Enclosed you will find our PERS rates for 2006/07 and a projection for 2007/08. The rate for miscellaneous employees has a -.5% reduction from this year. Fire goes down -4.6%; Police goes down -4.4%. The projections for 07/08 are essentially constant with the new 06/07 numbers. After several years of sharp increases, this is positive information. 5. As a reminder, the special meeting to be held next Wednesday, November 16th will be on a different schedule than we usually follow. We will begin the meeting at 5:15 p.m. and take a short recess at approximately 7:00 p.m. for a light dinner break. General Plan Amendments will be the only business conducted at the meeting. 6. Rojas, Public Works Director ~, DATE: November 7, 2005 SUBJECT: Nina Street (Ward 1) m'U&TE COUCIL RElqERR/LL ~1244 (9/07/05 meeting) Previously a request was made by Councilmember Carson to determine what could be done to inStall curb and gutter and paving on Nina Street. Staff has researched this request and found that none of the street right of way has been dedicated and only a small segment of the street has an offer of dedication which has not yet been accepted. This area was previously annexed by the City from the County in July 1997, and apparently the County did not request or require the necessary street dedication. The standard street dedication for a residential street is 60' in width. The street currently has a paved width of 26' with power poles on the north side and telephone poles and fire hydrants on the south side. These poles and fire hydrants would need to be relocated as they are only 36' apart, which would be the minimum curb to curb width for this street. It is likely the cost to relocate the poles would be the responsibility of the property owner or the City, as the utility companies would have prescriptive right. In addition, there are many structures, fences, mailboxes and trees that are within the 60' right of way area that would require removal or relocation. Staff has estimated the total cost for improvements to be $1,100,000. This street is located within an area that qualifies for CDBG funds and a request for funding was sent to the Economic and Community Development Department. If this project is to be completed, the City Property Manager should first obtain all necessary street right of way prior to construction of street improvements. Underwood Public Works Operations Manager City of Bakersfield 4101 Truxtun Avenue (661) 326-3781 B A K E R S F I E I~ D OFFICE OF THE CITY MANAGER MEMORANDUM November 8, 2005 TO: Alan Tandy, City Manager Alan Christensen, Assistant City Manager~__~ FROM: SUBJECT: ABC Compliance at Montgomery World Council Referral #001320 Councilmember Benham requested staff respond to attached correspondence from Diana Shackelford, regarding a pending application for alcohol sales at the Neptunes Seafood Restaurant inside the Montgomery World Plaza. Staff contacted ABC to determine if an alcohol permit application has been received from the restaurant in question. In fact, the business was permitted for beer and wine as part of the restaurant effective November 1,2005. While the City does have the power to make a finding of public convenience and necessity for alcohol permits within the city limits; unfortunately, the city has no jurisdiction over applicants applying for a liquor license where the establishment also includes a restaurant operation. Such is the case with Mr. Ramirez. His application is made to ABC directly because a restaurant is involved. This circumstance has existed in state law for many years. TO: Alan Tandy, City Manager FROM: ~ Stanley Grady, Development Services Director DATE: November 4, 2005 SUBJECT: Re: Weeds and Trash At Various Locations Referral # 1303 Councilmember Couch referred to staff the problems of weeds and trash at the following locations: 1) Calloway and Olive: 2) Calloway East Side just north of Rosedale: 3) Renfro and Jenkins, south of Stockdale Hwy: 4) Stockdale Hwy. south side in front of chain link fence in front of CSUB). The Code Enforcement Officer investigated the areas of Calloway and Olive, the eastside of Calloway north of Rosedale Hwy and areas including properties northwest of the Kern County Fire Station at 9420 Rosedale Hwy., and found violations of overgrown weeds, trash, debris and a boat. Also, a fire break is needed around the perimeter of the vacant lot southwest of the canals of the Calloway and Olive Dr. location. Seven Day Notices have been sent to the owners to abate the nuisances. If not abated, these cases will be brought before a Hearing Officer at the Building Dept. When the Code Officer arrived at the Renfro and Jenkins location south of Stockdale Hwy. and the area by the fence in front of CSUB on Stockdale Hwy., no violations were observed during multiple inspections of this half mile stretch of the south side of Stockdale Hwy. (including inspections along the southerly ends of Renfro and Jenkins). The Code Officer noted that the fence in front of CSUB is monitored on a continuous basis.
