SUBJECT: General Information
1. Several developers, including 'some new to the area, have recently asked us about
Development Agreements, which have been rarely used here. Typically, such
agreements give the City some things it may want (such as contributions for
infrastructure) in exchange for things developers may desire (such as vesting
periods) that are outside the normal regulatory process. Based on the requests
received, staff is forming a task force to look into the issue and see if a net gain is
possible for us in our booming local economy and with the developer interest in the
subject. We will report back to you.
2. The Police Department has announced that as of Wednesday, November 10th, the
intersection of California and Oak is up and running with red light camera
enforcement. This is the fifth intersection to be fitted with the devices and more are
planned.
3. Responses to Council requests are enclosed, as follows:

SUBJECT: STRIPING / TRAFFIC FLOW MALL VIEW RD.

Councilmember Maggard requested staff discuss with him striping and traffic flow
on Mall View Road in the vicinity of the Home Depot store.
A meeting was held with Councilmember Maggard on November 1, 2004 to discuss
concerns regarding traffic flow, signal timing on Oswell Street and Mt. Vernon Avenue in
the area of East Hills Mall and the Home Depot Center and pedestrian issues in the
shopping center.
The Traffic Engineer will be conducting traffic studies on Oswell Street to improve
coordinated flow of traffic on both peak and non-peak travel times of the day. This study
should be completed in about 4 to 6 weeks, weather permitting.
A project will b'e developed, with Caltrans, to add a right turn lane for northbound to
eastbound traffic at the intersection of Mt. Vernon and the eastbound on-ramp to
Highway 178 in an effort to reduce traffic congestion on Mt. Vernon. Caltrans engineers
will be consulted to address access and right of way needs and scope of traffic signal
modifications that will be required. This will be a longer term project with a construction
target date of 2005-2006.
Traffic Engineering will also contact the Home Depot shopping center management to
address a concern for pedestrian traffic along the Mall View Road connection to the
East Hills Mall complex. Some pedestrian facilities are already required as part of the
.development near Home Depot, but these do not make a direct connection to the upper
East Hills Mall.

SUBJECT: BLOCK WALL ON GARCIA COURT
Follow-up on Council Referral #967
Councilmember Salvaggio requested staff respond in writing to Doria Ornelaz and
address her concerns in detail regarding the hole in the cul-de-sac block wall on
Garcia Court.
When the wall was constructed in 1987, the Panama School District bus stopped on
Panama Lane at Garcia Court. The block wall was intentionally constructed with an
opening at Garcia Court to allow the students getting off the school bus a shortcut into
the neighborhood which is on the south side of Panama Lane.
Due to numerous complaints from the residents on Garcia Court and the increased
traffic on Panama Lane, the Panama School District bus no longer stops at this location.
Bushes were planted at the opening to discourage people from using it. However, this
has not worked out.
Our Street Superintendent has contacted the City's annual fence contractor and
directed him to close off the opening in the wall by installing a chain link fence with vinyl
slats that match the color of the fence. The fence has been ordered and it will be
installed as soon as the fencing contractor receives it.
Mr. Peralez also contacted Mrs. Doria Ornelaz and informed her as to how the opening
was going to be closed off. Mrs. Ornelaz was satisfied and happy that the opening in
the wall would finally be closed off. She and her neighbors stated that they would like to
give Councilmember Salvaggio a very big THANK YOU.
