I'm pleased to announce the appointment of Nelson Smith to the position of Finance Director. Nelson will continue as Assistant Finance Director until he assumes his new duties in July when Gregory Klimko retires. 2. Councilmember Couch has requested that you bring your calendars to the Wednesday, April 13th council meeting for the purposes of scheduling public meetings regarding the half-cent sales tax proposal. 3. The list of High Five Award recipients for January through March is enclosed. We congratulate those employees for their excellent service. 4. As th(~ media has reported this week, the Governor has decided to hold off on any pension reforms this year, but to start over with the discussions of all the involved parties. He is now looking to the November 2006 election to place a constitutional amendment on the ballot. Related articles from the Sacramento Bee and the League are enclosed. 5. A brief update from the League on the status of CDBG funding is attached. While the situation is looking much better than previously reported, the Senate and House actions are not absolute yet. 6. A "Q and A" article with the executive director of the California Redevelopment Agency is enclosed, which mainly focuses on the adjustments agencies have had to make due to the State shifting of ERAF funds. 7. Staff is working on a program to enhance the urban forestry program through a closer relationship with the Tree Foundation, more contract work, additional field staff, and a reorganization. Smith will replace Gregory Klimko, who is retidng in July. City Manager Alan Tandy announced the appointment today and said, "I'm confident that Nelson's experience as Assistant Finance Director for the past five years will result in a very smooth transfer of responsibilities when he assumes full management of the department." Smith will oversee all divisions of the Finance Department, including Accounting, Treasury, Purchasing, and Property Management and will have a key role in the preparation of the City's annual budget. He is a 1982 graduate of California State Polytechnic University in San Luis Obispo, where he received a Bachelor of Science Degree in Business Administration, with a concentration in accounting. He completed a Master's Degree in Business Administration at California State University - Bakersfield in 2003. Nelson Smith began his career with the City in 1990 as an Accountant, and was subsequently promoted to the positions of Accounting Supervisor and Assistant Finance Director. His professional affiliations include membership in the Government Finance Officers Association and the California Society of Municipal Finance Officers. Arnold Schwarzenegger on Thursday backed off his plan to overhaul the public pension system this year. The Republican governor, whose plan to shift public pensions to a 401(k)-style plans for employee hired in 2007 and beyond, had been battered by critics, said he would try again next year barring a legislative agreement. "Let's pull it back and do it better," the governor said in a surprise news conference at the Capitol. The move represents a huge political defeat for Schwarzenegger that illustrates the perils of governing by initiative. Unions and Democrats said the governor's retreat would help open the way for discussions of problems they said were more pressing to most Californians. The governor said he had listened to the concerns of survivors of public safety officers killed in the line of duty and others who claimed the initiative would end death and disability Payments. While the governor said the initiative was never intended to end the special benefits, he acknowledged that the criticism had clouded the issue. He denied that he was swayed by public pressure. "The protestors or poll numbers have absolutely no impact on what I do," he said. The pension overhaul was one of five proposals the governor has proposed for a special election ballot this year, along with plans to change the way political districts are drawn, give more budget-cutting power to governors, eliminate teacher tenure and institute merit pay for teachers. Keith Richman and other local.officials this morning in which the governor announced that'he plans to pull back his ballot.measure on pension reform (ACAX1 1-Richman), and start discussions that "put everything on the table". The governor's proposal, carried in ACAX1 1 (Richman), has also been circulating for signature gathering as an initiative so that ~it could be placed on a ballot for a special election next fall. His proposal essentially would require that new state and local government employees be provided a "defined contribution" pension package - a 401 (k) self-directed savings package - in lieu of the "defined benefit" pension currently available to public sector employees. The governor's decision to pull back his proposal evidently came after several days of discussions with various local government and other parties about their concerns with the proposal. League representatives had met with the governor's representatives last week, discussing the recommendations of the League Pension Reform Task Force at some length. Those proposals call for retaining the defined benefit plan model for public pension systems, but with some key reforms. (See the League's website for a copy of the task force r. eeport ,and an analysis of reform alternatives by tile task force actuary.) The-recommendations provided by the League's Pension Reform Task Force will continue to serve as the League's .basic framework from which to participate in discussions. We are also working closely with 'CSAC. The governor has stated that he wants to engage all concerned parties - state and local employers, CalPERS, employees and their survivors, pension plan experts and legislators -- in these discussions. Several speakers at the press conference also reiterated the importance of consulting with all parties, including employees. Key issues to be addressed include long term cost savings, reducing the financial risk of pension systems to taxpayers, and reform of the disability payments system. The governor also stated that he is receptive to a schedule that would place a constitutional amendment on the regular November 2006 ballot, rather than pressing for a special election in 2005. How have redevelopment agencies been affected by the state's ongoing budget crisis, and especially the loss this year and next of $250 million each year as part of the Prop 1,4 agreement? There's been no direct impact on our ability to spend money on affordable housing, because the state laws that govern the ERAF shifts for redevelopment agencies have been written to exclude housing set-aside funds. Those cannot be used for ERAF payments. So from that standpoint we are not seeing a reduction in housing efforts by our members as a result of ERAF shifts. Page 2 of 2 Housing in Barstow Q - A number of bills have been introduced that appear aimed at changing the Unique Housing way redevelopment agencies do business in California. Could you describe some Development Strategy of the trends you see in this legislation ? Turns Around A Troubled Community Several bills are focused on how to encourage and stimulate more housing using redevelopment as a tool. Senator Torlakson's SB 521 falls in this category. He is proposing to expand the definition of blight around transportation nodes - rail stations, for example - to encourage greater density of housing. There is also legislation that would extend the life of project areas. This would make funds available for longer a period of time to work on housing. The Redevelopment Association doesn't have a position on these bills yet - our board is set to meet and review them later this week. In general, however, it's important that we conduct a complete analysis of possible impacts whenever we want to expand or modify current law governing the use of redevelopment tools. We need a comprehensive solution that will truly serve the state. Mr. Shirey has served in senior executive positions as City Manager of Cincinnati, Ohio, Assistant City Manager of Long Beach, California, and Assistant Chief Administrative Officer of Los Angeles County. He has been responsible for annual budgets over $1 billion and workforces of 5,000 to 75, 000 people. RECTOR, CHIEF OF POLICE ~ DATE: APRIL 6, 2005 SUBJECT: PARKING PROBLEM AT 19TM AND EYE STREETS COUNCIL REFERRAL NO. 1072 (WARD 2) Council Member Benham requested staff respond to correspondence received from Bob Campbell and contact Mr. Campbell regarding his request for "exempt" parking in the alley north of 19th Street between Chester Avenue and Eye Street on weekends. Traffic Commander, Lt. Jay Borton, assigned the downtown foot beat officer to check with the businesses on 19th and 20th Streets to determine any potential problems with changing the parking situation in the north alley of 19th Street. Thera is no opposition to this change so staff will proceed with Streets and the Corporation Yard. As of this date Mr. Campbell has been unavailable for contact, however, Lt. In our department's proposed Capital Improvement Project budget for 2005-2006 we have requested $150,000 to replace old play yard equipment city-wide. While funds are scarce, we will identify pieces of equipment at Quailwood Park that might be replaced along with other potential projects at all city parks. Replacing all the park equipment at this time is not possible with existing funds. DATE: April 4, 2005 SUBJECT: UPDATE FOR NEW RETENTION BASIN Referral No. 1075 (Meeting: 3/30105) COUNClLMEMBER BENHAM REQUESTED STAFF PROVIDE AN UPDATE REGARDING LONG RANGE PLANS FOR A NEW RETENTION BASIN AND THE FEASIBILITY OF SHORTENING THAT TIMELINE. In late 2000, the City, through the use of a consultant, completed a master drainage study for downtown Bakersfield. This comprehensive study identified ali deficient areas and made recommendations that, if implemented, would bring the downtown drainage system into compliance with our current standards. The total cost to implement all improvements totaled almost $17 million. Adjusting for inflation and current land values, these costs could approach a staggering $25 million in current valuation. The master drainage study identified several projects to be phased over a period of years. The new rm dr In th first recommended project included a sto a' along 24 Street east of Oak Street. This new storm drain was to connect to a basin located in the vacant lot at the southeast comer of 24th Street and Oak Street. The City recently purchased that lot to be used for not only the necessary drainage basin, but also the 24thStreet at Oak Street interchange project. Staff has also proposed a CIP project in the 2005/06 budget to construct the storm drain within 24th Street. Actual construction of the basin and storm drain system could begin next summer provided we get permission from CalTrans to allow the storm drain within their right of way on 24th Street. In addition, the City is proposing a storm drain project within the 2005/06 CIP that would alleviate a drainage problem at the intersection of 34th Street and San Dimas Street near Memorial Hospital. This project, coupled with another project at 38th Street and San Dimas Street will complete two other projects identified in the above mentioned master drainage study. With respect to the other projects identified in the master drainage study, staff is evaluating options that would provide cost effective alternatives to those identified in the master study. These, coupled with the projects outlined above should provide an adequate level of drainage protection for downtown Bakersfield. STINSO~,I~SISTANT CITY MANAGER SUBJECT: Televising Planning Commission Meetings City Council Referral Ref001059 According to Public Works Department the cost to televise the Planning Commission meetings is about $42,000 annually. This cost is based on the time required to staff the television equipment. This cost estimate assumes existing staff would shift from their current duties and responsibilities working in the telecommunications division (when not performing their other television related duties) to spending time operating the television equipment for the Planning Commission meetings. This would result in a reduction in productivity for the telecommunications division. According to the Public Works Operations Manager, the Audio Visual Specialist is currently working on the SCADA microwave alarm system programming project. He is spending approximately 50 hours every two weeks programming our SCADA alarm system, depending on his Council Chambers duties. The SCADA system was originally assigned to the Communications Engineer and then to a Communications Technician; neither has the available time to work on the programming. The old alarm system is failing and the new system is needed to support the City Data Network, telephone system, Police, Fire and Public Works communications infrastructure. When the new alarm system is online and operational, it will alert staff of equipment failure and also automatically put on line backup equipment to keep the systems operational for the short term until repairs could be made. This project is extremely important to the overall operation of the City communication infrastructure and safety of those who use the systems. These and similar tasks are performed by the Audio Visual Specialist when not performing duties related to Council meetings. B A K E R S F I E L D CITY OF BAKERSFIELD PUBLIC WORKS DEPARTMENT MEMORANDUM TO: Alan Tandy, City Manager FROM: Raul Rojas, Public Works Director DATE: April 4, 2005 SUBJECT: RELOCATE GET BUS STOP @ STOCKDALE HIGH Referral No. 1078 (Meeting: 3/30105) COUNCILMEMBER HANSON REQUESTED STAFF CONTACT GET AND COORDINATE WITH THEM TO RELOCATE THE BUS STOP AT WHITE LANE AND BUENA VISTA ROAD DUE TO TRAFFIC DIFFICULTIES GENERATED BY THE DROP OFF LOCATION AT STOCKDALE HIGH SCHOOL. The Traffic Engineer contacted Emery Rendes of Golden Empire Transit (GET). GET staff is well aware of the complaint regarding traffic on White Lane at the bus stop along Stockdale High School. GET is in contact with the resident who is concerned about the bus stop. Traffic is prohibited from stopping along White Lane by signs. Parents picking up or dropping off students disregard the signs and block traffic along White Lane. The Police Department is aware of the problem and provides enforcement as much as possible. GET is also working with the Kern High School Police to get enforcement of the "no parking" signage along White Lane to reduce the traffic difficulties. The graffiti was cleaned from Stonecreek Park on April 1, 2005. Staff contacted Cai Trans on March 31, 2005 to report the graffiti on the on/off ramp of highway 99 at Ming ' Avenue. ADDITIONALLY, SHE WOULD LIKE AN UPDATE ON INSTALLATION OF TRAFFIC ARROWS ON WHITE LANE AND AKERS ROAD. Extension of Akers Road south to Pacheco Road has been programmed into the proposed Capital Improvement Program budget for Fiscal Year 2005-06. The project will include an at-grade crossing with the railroad tracks, a culvert on the irrigation canal, and a traffic signal at the intersection of Akers Road and Pacheco Road. Design of this project must be coordinated with the owner of the property north of the railroad, the railroad companies and the canal district. Staff's goal is to have this project under construction by summer 2006. Traffic Engineering does not propose changes to the traffic signal operation of White Lane and Akers Road at this time. The addition of left turn arrows for Akers Road traffic would degrade the flow of coordinated traffic on White Lane. When the construction of the White Lane crossing of Highway 99 is completed, the traffic flow will improve and the signal coordination improvements possible along White Lane may allow the use of left turn signals for Akers Road at the traffic signal. Traffic Engineering will to-evaluate the signal operation again later this year.
