SUBJECT: General Information
1. As you already know, in advance of the May Revise, the Governor announced this week
that he intends to restore the Proposition 42 funding to the 2005-06 State budget. While
we are cautiously optimistic about this good news, the Legislature will have to approve
his proposal. We have yet to see if it will actually happen. We don't know how the
California Transportation Commission will set the allocation formulas, and it is also
uncertain if our local projects, the Fairfax Road Interchange and Westside Parkway -
Phase1, would actually receive funding in the upcoming fisca! year or be delayed. A
complete list of the STIP and TCRP projects that may receive funding is attached.
2. The list of read maintenance projects scheduled for the week of May 16th is enclosed for
your information.
3. A special thanks to the Employee Incentive Committee for coordinating the Employee
Appreciation Breakfast today. We also thank the Councilmembers for their participation.
It was very nice to be able to reinstate the breakfast this year as a way of saying thank
you to the City employees for their hard work and dedication. There were approximately
750 in attendance - our best turn out ever!

SUBJECT: Proposition 42 Transportation Funding - Governor's May Revise
On Wednesday June 11th the Governor announced that he intends to include $1.3
billion in restored transportation funds for Proposition 42 in his 2005-06 budget
proposal when his May Revise is presented this Friday. Based on information
available at this time the $1.3 would be distributed as follows:
· $678 million would go to the Transportation Congestion Relief Program
(TCRP)
· $254 million to the State Highway Account (SHA) for State Transportation
Improvement Program (STIP) projects
· $254 million to cities and counties for deferred maintenance of local roads
($127 million to cities, $127 million to counties)'
· $127 million to the Public Transportation Account, with half ($63.5 million)' of
those funds available for STIP projects and half ($63.5 million) for State
Transit Assistance (STA)
Although this preliminary information allocates funds to the above categories, we
don't know the formulas for specific allocation to cities and counties at this time. The
California Transportation Commission (CTC) will be setting the allocation formulas
and they have not yet been determined. The two categories above that most directly
impact the City are the State Highway Account for State Transportation
Improvement (STIP) Projects and funds for deferred maintenance of local roads.
Prop 42 was passed in 2002. This measure dedicated the sales tax on gasoline to
transportation programs. Funds were to be allocated on a 40/40/20 split, with 40
percent available to cities and counties for street and road maintenance (split 50-50);
40 percent to the State Transportation Improvement Projects (STIP); and 20 percent
to transit systems.
Prop 42 allows these funds to be transferred to the state general fund and
appropriated for non-transportation purposes during times when the state was in
fiscal difficulty. The funds have been transferred to the state general fund in each of
last two fiscal years since Prop 42 passed and the Governor's proposed budget
included a continued transfer for FY 2005-06.
'Due to the previous years capture of these funds, there are more eligible STIP
projects than funding available, so pending the allocation information for the STIP it
is still uncertain if city projects (Fairfax Rd. Interchange and Westside Parkway,
Phase I) will receive funding this upcoming fiscal year. Public Works staff has heard
that the CTC may be proposing that the two projects mentioned above would be
delayed to FY 2006-07 even with the Governor's new proposal. The amount of
funding available to cities for deferred maintenance of local roads of $127 million
state-wide is likely to be formula based and that allocation formula is also not yet
available.
Staff will continue to monitor this item and provide updated information as it
becomes available.

Gov. Schwarzenegger Announces Full Funding of Proposition 42
Transportation Funds
Governor Arnold Schwarzenegger announced today that his revised 2005-06 budget proposal will include
$1.3 billion in restored, transportation funds for Proposition 42 at a speech to the League of California
Cities.
"It's time for California to build again in the cities, the counties and everywhere across our state," said
Governor Schwarzenegger. "On Friday, I will present a budget for California that will fully restore
Proposition 42 and put more than $1.3 billion into transportation. This will allow us to move ahead with new
projects that were approved for construction years ago and finish or expand current projects that have
been stalled by the lack of funding."
The Governor credited an improving economy for reversing the need to borrow money earmarked by the
voters for transportation.
"Our economic recovery plan is working and as a result we have more revenues coming to the state," said
Governor Schwarzenegger. "We're going to create an infrastructure that reduces the gridlock on our roads,
builds the facilities that our cities need, speeds up the movement of goods in our state and creates more
jobs. I want a California where peoPle spend less time sitting on the freeway and more time with their
families at home."
Proposition 42, passed by the voters in 2002, requires that state sales and use taxes on the sale of motor
vehicle fuel be used for public transportation, city and county street and road repairs and improvements,
and state highway improvements. Proposition 42 was partially suspended in the 2003-04 budget and fully
suspended in the 2004-05 budget.
The Governor's current legislative budget control proposal, ACA 4X by Assemblymember Rick Keene (R-
Chico), would prohibit further suspension of Proposition 42 beginning in 2007-08. Furthermore, ACA 4X
provides for repayment of all Proposition 42 suspensions in equal annual increments by 2021-22.
The $1.3 billion would be distributed as prescribed by Proposition 42, as follows:
· $678 million would go to the Transportation Congestion Relief Program (TCRP)
· $254 million to the State Highway Account (SHA) for State Transportation Improvement Program
(STIP) projects
· $254 million to cities and counties for deferred maintenance of local roads ($127 million to cities,
$127 million to counties)
· $127 million to the Public Transportation Account, with half ($63.5 million) of those funds aVailable for

Governor Schwarzenegger will announce his full May budget revision on Friday, May 13.

STREET MAINTENANCE SECTION - WORK SCHEDULE

Resurfacing streets in the area Between Gosford Road and Spring Creek Loop, north of
Harris Road.
The forecast for the next few weeks is for good weather, so we will be back finishing the
pulverizing project on Pin Oak Park Blvd., between District Blvd. and White Lane.
We will be working on the widening of Jewetta Avenue, north of Brimhall Road.
Repairing curb, gutter and sidewalk on Columbus Street, between Mt. Vernon Ave. and
River Blvd., and on Oswell Street between Columbus Street and Auburn Street.
Preparing (grinding operations) streets for resurfacing in the area between So. "H"
Street and Hughes Lane, south of Planz Road and in the area between Beachwood
Street and Planz Road from Akers Road to Actis Road.
This weekend, May 14 and May 15, 2005, we will be applying an oil and seal on the
street surface of White Lane between Wible Road and Dovewood Street and also
between Wilson Road and Ashe Road.

SUBJECT: UPDATE ON STATE ROUTE 204 RELINQUISHMENT
COUNCILMEMBER BENHAM REQUESTED A STATUS REPORT ON THE POSSIBLE
RELINQUISHMENT OF STATE ROUTE 204 BY CALTRANS TO THE CITY OF
BAKERSFIELD.
City staff has been discussing with Caltrans staff for over a year the idea of the
relinquishment of State Route 204 to the City. City Staff requested several months ago
clarification from Caltrans on two items:
1, Without the relinquishment, is it possible for the Hageman Flyover to occur
and what conditions/improvements would be required (ultimately, how much
would it cost).
2. If State Route 204 is relinquished to the City, what assurances could be given
by Caltrans that they would allow the Hageman Flyover project to occur and
what conditiOns/improvements would be required.
Caltrans staff have been meeting internally a number of times over the past several
months to develop a response to these items. Just this week, a draft of a response
letter was received by City staff from Caltrans asking for City staff comments. City staff
does not believe the draft letter is clear and succinct enough in its response to the
above items, and is forwarding some recommended language back to Caltrans. Once
the letter is finalized, Caltrans staff will be coming to Bakersfield to deliver the letter and
discuss the relinquishment.

Dear Mr. Tandy:
The purpose of this letter is to discuss key design requirements on state highways for the
City of Balcersfield's project to extend Hageman Road across State Route 99. There are
two different scenarios related to this project. No specific traffic analysis has yet been
done, but based on proposed preliminary design geometrics in the draft Project Study
Report (PSR).two scenarios are identified. Scenario one assumes State Route 204 would
be relinquished to the City and scenario two assumes that State -Route 204 would remain
in the State Highway System.
Scenario One:
· State Route 204 would no longer be part of the California Highway System and the
Golden State Boulevard / Hageman Interchange would be considered a local street
interchange. Driver and traffic operation expectations are lower at a local street
interchange 'than at a State highway freeway to freeway interchange. This would also
allow a design that requires only 2000 feet of weaving distance between Hageman and
Olive Ave (local interchange spacing). The proposed design presented in the draft
PSR is very close to this weaving distance and appears it could satisfy this distance
with minor geometric changes.
· The proposal to date has shown the need for modifications to Golden State Boulevard.
Caltrans would not impose State highway standards on roadways outside of State right
of way, including the existing Airport Drive ramps.

Scenario Two:
· If State Route 204 is not relinquished and remains part of the State Highway System,
driver, s expectations and traffic' operations are higher and would require two mile
.spacing between interchanges on State Route 99. Also ramp geometry is more
demanding with a freeway-to-freeway interchange. It becomes very unlikely that the
Olive Drive Interchange ramps could remain at least without ·expensive modifications
and extensive right of way impacts. All interchanges within 2 miles of the State Route
99/204 Interchange would need to be evaluated for operational acceptability. This
would affect the Rte. 58/178 interchange and the Buck Owens Blvd. Ramps.
· Correction of nonstandard features on modified sections of State Route 204 would
need to be evaluated. The poor ramp spacing between State Route 99 and Airport
Drive is unlikely to satisfy driver's expectations and traffic operations on a State
highway,. Correction of cross-sectional elements like shoulder width could· extend the
project's limits across the Kem'River.
So far we have been reviewing the Hageman Road connection project under the
assumption that State Route 204 would be relinquished to the city. If this assumption
changes, our comments on the project would change drastically. If you have any

Councilmember Hanson requested staff investigate concerns of Mr. Mark Dewey regarding
the West Nile Virus and drainage issues at a sump located inside a park in his
neighborhood at Dos Rios Way and Montalvo Drive near Stockdale Elementary School.
Vice-Mayor Maggard also, requested staff formulate an informational program possibly with
the county, regarding standing water and its relationship to the West Nile Virus.
The Recreation and Parks Department maintains all sumps located inside City Parks. As
such, this department contacted the Parks Division to inform them of the citizen complaint
regarding the drainage problem at the sump. We were informed by the Parks Division that a
"clean out drain" was installed in the center of that sump last year as part of their sump
maintenance program. Based on that repair, the sump has been working well and normally
drains within a couple days leaving the area dry. We were also told that they have been
unsuccessful in contacting Mr. Dewey to date however; they would continue to try to
contact him as soon as possible to discuss the problem and bring it to a satisfactory
resolution.
As part of our normal inspection and maintenance process, City Water Resources staff
canvasses all drainage basins within our jurisdiction, looking for instances of standing water
or responding to citizen complaints. The wet sumps were plotted on a map and staff met
with the district manager and operations superintendent of the Kern Mosquito District to
relay our findings to the district. The district reviewed our map and assured us that our wet
sumps are being covered by district personnel including overlap to intensify coverage. The
district notifies the City of those sumps that have problems, such as weed and brush growth
that could inhibit effective mosquito treatment. City staff will place those basins on highest
priority for cleaning and will direct additional resources to expedite cleaning. The district
uses mosquito fish or a non-toxic larvicide, called VectoBac, one of the least toxic
pesticides in use today, for mosquito control. Individuals may contact the district to pick up
mosquito fish for use in private ponds or any private location that may have standing water.

CITY DRAINAGE BASIN ISSUES AND WEST NILE VIRUS

California Water Service Co. has agreed to insert notices in the monthly billings to all
customers in the Cai Water service area and the City domestic water service area to
combine the messages of "water conservation" and "awareness of mosquito habitat
created by "standing water". A joint notice has been developed and should begin going out
to customers by late June 2005. The notices will go out to over 100,000 residences and
businesses in both the incorporated and unincorporated areas of Bakersfield.
In addition, the City Water Resources Department prepared, in conjunction with the Kern
Mosquito and Vector Control District and the City Manager's office, a Public Service
Announcement (PSA) that is scheduled to run continuously on KGOV over the next few
months. Part of the PSA is text dialed into the Bakersfield area, part is a canned video
prepared by the California Mosquito Control Association that speaks in wider terms about
mosquitoes and the virus.

Councilmember Sullivan requested weed abatement near the former ZodY's building on Ming
Ave. and requested staff to prepare'a letter to the property owner attempting to enlist the owner's
assistance in keeping weeds under control.
Code Enforcement sent a Seven Day Notice and later sent a Second Notice to owner to appear
before the hearing officer on May 3, 2005, no one appeared. The Hearing Officer ordered to
abate the nuisance. The Code Officer is in the process of getting bids from contractors to abate
the problem.

COUNCILMEMBER SCRIVNER REQUESTS STAFF TO REVIEW TRAFFIC
CONCERNS OUTLINED IN ATTACHED LETTER.
Traffic Engineering staff reviewed the traffic related items of concern as presented in the
letter and have the following responses.
The stop sign installed recently on Pacheco Road at Gasoline Alley Street is a location
that has been warranted for a traffic signal since May of 2003. In response to a
Councilmember referral and individual public requests, Traffic Engineering staff
reviewed the intersection operation and recent traffic accidents. Recent changes in
traffic patterns, increases in traffic and new accidents indicated that traffic control is
needed now. Since the signal installation is at least two or more years away, an interim
multi-way Stop sign control was installed for safety concerns. While improving the safety
of the intersection until the signal can be installed, the traffic congestion is increased
and drivers experience more delay in the commute time. This will be alleviated when a
traffic signal is installed in the future.
The Wible/White Lane intersection is still a,part of the construction activity taking place
with the White Lane/Highway 99 interchange project. Until all construction activity
affecting this intersection is completed, the signal operation will not be efficient and
congestion will occur. Traffic Engineering staff have developed new timing parameters
to help ease the congestion. The new timing will be operational in the next few weeks,
assuming no unforeseen delays in the construction activity.
Construction of the roadway and widening of narrowed segments on Panama Lane,
west of Wible is dependent on new development. Plans for new development at this
location have been proposed by the adjacent land owners. When the developer/land
owner begins construction, they will also have to widen the road to accommodate the
ultimate lane configuration of Panama Lane. An exact date when the developer will do
the required construction is not known, but appears to be in the near future.

South H Street is also progressing with development. As areas adjacent to the road are
developed into housing tracts or retail centers, the segments of South H Street along
such areas are constructed by the developers. Such things as canal bridges along
South H Street are done with traffic impact fee funds and other sources for projects that
benefit the community or they may be done by the developer to complete his required
street improvements. The developer is responsible for connecting his portion of the
roadway to the bridge.
The stop sign the letter writer refers to on District Blvd was part of the major detour of
White lane during last year's construction activity to rebuild the roadway. The temporary
stop signs were installed to facilitate the detour traffic and safely control the intersection
during the detour period. When the construction activity was complete, the temporary
stop sign installation was removed and the roadway returned back to the previous
condition. No changes are proposed.
