HomeMy WebLinkAboutORD NO 2363ORDINANCE NO. 2363 HEW SERIES AN ORDINANCE AMENDING SECTION 17.12.020 OF CHAPTER 17.12 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Cormnission and City Council have held hearings respectively, on a motion of the Planning Commission to zone certain property now being annexed to said City, and WHEREAS, the City Council has determined after due con- sideration of the motion and the recommendation of the Planning Conmaission, herein on file, together with the reasons advanced at the hearing for the zoning of said property, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That Section 17.12.020 of Chapter 17.12 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain properties in the County of Kern located north and east of Highland High School, and known as Fairfax No. 1 Annexa- tion, in an R-1 (One Family Dwelling) Zone, or more restrictive, Zone; in an R-1-CH (One Family Dwelling-Church) Zone, or more restrictive, Zone, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: To an R-1 (One Family Dwelling). or more restrictive zone: Parcel 1: A parcel of land situate in the County of Kern, State of California, being a portion of Section 13 and 14, Township 29 South, Range 28 East, M.D.B.&M., and more particularly described as follows: Beginning at the northeast corner of the southwest quarter of said Section 13; Thence (1) southerly, 1320 feet more or less, along the east line of said southwest i/4 to intersect the south line of the north one-half of said southwest 1/4; being also a point of the Corporate Boundary of the City of Bakersfield. Thence (2) westerly and along the various courses of said Corporate Boundary to intersect the north line of the southeast 1/4 of said Section 14; Thence (3) departing from said Corporate Boundary, easterly, 3960 feet, more or less, along the north line of the southeast 1/4 of said Section 14 and the north line of the southwest 1/4 of said Section 13 to the Point of Beginning. EXCEPTING THEREFROM the following parcel: Co~Lm~encing at the northwest corner of the southwest quarter (SW 1/4) of said Section 13, thence South 00° 01'10" East along the west line of said southwest quarter (SW 1/4), 847.018 feet to the north right-of- way of Panorama Drive, 90.00 feet in width, and the True Point of Beginning; thence North 89o34'08" East along said right-of-way line, 390.059 feet; thence, North 00o25'52" West, 20.000 feet to the beginning of a tangent curve, concave to the west; thence, northerly along said curve an arc length.of 409.426 feet, through a central angle of 14°36'57" wzth a radius of 1605.000 feet, said curve being parallel to and 195.000 feet from the centerline of the proposed aligr~nent of Fairfax Road, 110.00 feet in width; thence, South 89o34'08" West, 335.067 feet to a point on the aforesaid west line, said point being 424.980 feet from the True Point of Begin- ning; thence, continuing South 89o34'08" West, 210.000 feet; thence, South 10°54'47" West along a radial 404.567 feet to a point on a curve, concave to the north, being the aforesaid north right-of-way line; thence Easterly along said curve an arc length.of 288.080 feet, through a central angle of 11o20'39" wzth a radius of 1455.000 feet; thence, North 89o36'08" East continuing said north right-of-way line, 0.323 feet to the True Point of Begin- ning. To an R-1-CH (One Family Dwelling-Church), or more restric- tive, Zone: Parcel 2: A portion of the Northeast quarter (NE 1/4) of the Southeast quarter (SE 1/4) of Section 14, and the Northwest quarter (NW 1/4) of the Southwest quarter (SW 1/4)'of Section 13,.Township 29 Sguth, Range 28 East, M.D.M., more partzcularly descrzbed as follows: Commencing at the Northwest corner of the Southwest quarter (SW 1/4) of said Section 13, thence South 00°01'10" East along the west line of said Southwest quarter (SW 1/4), 847.018 feet to the north right-of- way of Panorama Drive, 90.00 feet in width, and the True Point of Beginning; thence, North 89o34'08" East along said right-of-way line, 390.059 feet; thence North 00 25 52 West, 20.000 feet to the beginning of a tangent curve, concave to the West; thence, northerly along said curve an arc length.of 409.426 feet, through a central angle of 14°36'57" wzth a radius of 1605.000 feet, said curve being parallel to and 195.000 feet from the centerline of the proposed alignment of Fairfax Road, 110.00 feet in width; thence, South 89°34'08" West, 335.067 feet to a point of the aforesaid west line, said point being 424.980 feet from the True Point of Begin- ning; thence, continuing South 89°34'08" West, 210.000 feet; thence, South 10°54'47" West along a radial 404.567 feet to a point on a curve, concave to the north, being the aforesaid north right-of-way line; thence, easterly along said curve an arc length of 288.080 feet, through a central angle of 11°20'39" with a radius of 1455.000 feet; thence, North 89°36'08" East continuing said north right-of-way line, 0.323 feet to the True Point of Beginning. SECTION 2. This ordinance shall become effective upon the annexation of the above-described territory to the City of Bakersfield. .......... o0o ..........
