AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD REPEALING SECTION 3.18.136,
AMENDING SUBSECTIONS (e) AND (g) OF SECTION
3.18.200 OF THE MUNICIPAL CODE CONCERNING
COMPENSATION FOR OFFICERS AND EMPLOYEES OF
THE CITY OF BAKERSFIELD.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
That Section 3.18.136 of Chapter 3,18 of Title 3 of the
Municipal Code of the City of Bakersfield is hereby repealed, the
subject matter of such section to be regulated by resolution.
SECTION 2.
Subsection (e) of Section 3.18.200 of Chapter 3.18 of
Title 3 of the Municipal Code of the City of Bakersfield is hereby
amended to read as follows:
(e) Computation of Sick Leave--Fire Department 24-Hour Duty
Shift. Fire Department employees assigned on a 24-hour duty shift
basis, shall be allowed sick leave with full pay, computed upon a
basis of .216 of a 24-hour duty shift for each bi-weekly period of
service with the City, to yield 5.6 twenty-four hour duty shifts
annually.
SECTION 3.
That subsection (g) of Section 3.18.200 of Chapter 3.18
of Title 3 of the Municipal Code of the City of Bakersfield is hereby
amended to read as follows:
(g) Accumulation of Sick Leave and Additional Vacation in
Lieu of Accumulation of Sick Leave. Sick leave may be accumulated
up to a maximum of one hundred and twenty days; or 56 shifts for Fire
Department employees assigned on a 24-hour duty shift basis. Addi-
tional vacation time shall be credited in conjunction with unused
sick leave earned as hereafter provided. Such accumulation and
additional vacation is to be interpreted for police and fire employees
in the same manner as otherwise set forth in this chapter.
1. 0-60 Days or Equivalent Shifts Unused Accumulated Sick
Leave. Up to sixty days (60) or equivalent shifts unused sick leave
will be accumulated with no additional vacation allowed.
2. 60-120 Days or Equivalent Shifts Unused Accumulated
Sick Leave. Accumulated sick leave in this category with additional
vacation time will be accumulated in the calendar year as follows:
In any calendar year, six (6) days or equivalent shifts
of unused sick leave will be accumulated. Fifty percent (50%) of the
remaining unused sick leave will be credited to additional vacation
and fifty percent (50%) will be accumulated sick leave.
3. 120 Days and Equivalent Shifts or Over Unused Accumu-
lated Sick Leave. All unused sick leave earned during the calendar
year over one hundred and twenty days or equivalent shifts accumulated
will be converted into additional vacation time at fifty percent (50%)
of the unused balance.
4. Those employees who, on July 10, 1972, have a total of
more than one hundred and twenty days (120) accumulated sick leave
will retain their accumulated sick leave but will not be credited
with any further accumulated sick leave, but in lieu thereof, shall
be entitled to one-half day vacation for every day of sick leave
earned subsequent to July 1, 1972. Such vacation shall be taken in
the calendar year following the earned sick leave.
5. Absence on account of illness occurring to any employee
in number 4 above, not including members of the Management Unit,
General Employees Supervisory Unit and Police Supervisory Unit,
shall be deducted first from that portion of accumulated sick leave
exceeding the one hundred and twenty days accumulated sick leave.
6. When any member of the Management Unit, General Employees
Supervisory Unit and Police Supervisory Unit, is absent from work due
to an off-the-job illness or injury, sick leave credit shall first
be deducted from his current year's sick leave accumulation.
7. Fire Department employees assigned on a 24-hour duty-
shift basis may accumulate sick leave up to a maximum of 56 shifts.
Such employees who, on July 1, 1977, have a total of more than 56
shifts accumulated sick leave, when absent from work due to an off-
the-job illness or injury, shall be subject to the following: when
such absences for the year exceed the current year's accrual of sick
leave credit, such excess absences shall be deducted from that por-
tion of accumulated sick leave exceeding the maximum 56 shifts,
until such credit is reduced to 56 shifts.
SECTION 4.
This ordinance to become effective 30 days from the date
of its passage and to become operative on or after July 1, 1977,
upon the effective date.
